FEBRUARY 16, 2000
A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda
at 7:30 P.M. on Wednesday, February 16, 2000 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey,
Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito,
City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director of Public Works
Batt, Director of Parks and Recreation Merkel, Director of Community Development
Napolitano, Assistant Administrator Maxeiner. Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
Gregg Gabel, land planner, representing American National Bank and Trust
Company Trust No. 117509-08 d/b/a Inland Business Park, addressed Council requesting
consideration and direction regarding potential modifications of the Inland Business Park
Final Plat and Annexation requirements. Citing the difficulty in and selling Lots 51,52,53
and 55, Inland Business Park is considering the realignment of Capitol Drive, increasing
the depth and marketability of said lots. As per the terms of the existing Annexation
Agreement, Lots 51,52,53, and 55 are restricted to office use. Inland is requesting the
elimination of this restriction.
Direction is also sought regarding Lot 54. The Preliminary Plat and Annexation
Agreement reserve Lot 54 for municipal purposes. Inland is seeking release from this
obligation or confirmation of the City's use intent.
And finally, Inland is requesting Council approval for the reallocation of Lot 13 as
opposed to Lot 9 for the required access to the Gordon Stade property.
In Response to Council inquiry, Mr. Gabel agreed on Inland's behalf to additional
landscaping along the rear yard setback of Lots 51,52,53 and 55, if the office use
restriction were removed.
Mayor Cuda suggested Mr. Gabel meet with representatives of the Irish Prairie
Homeowners Association regarding the zoning reclassification issue. He also
recommended Director of Community Development Napolitano be invited to attend any
such meeting.
At Alderman Glab's suggestion, Staff was directed to provide Council the following
in Friday's Agenda Packet:
■ all pertinent annexation agreement sections;
■ copies of the existing preliminary plat;
■ copies of the proposed final plat; and
■ Staff comments.
Consideration of this issue and appropriate direction will be addressed as a regularly
scheduled Council Meeting Agenda Item.
CONSENT AGENDA
In response to Alderman Murgatroyd's inquiry, City Administrator Lobaito explained
the expenditure policy outlined in the McHenry Economic Development Commission
Riverwalk Committee Resolution mirrors the City of McHenry's existing purchasing policy.
In response to Alderman Murgatroyd's request for clarification, Staff noted any and all
unresolved conflicts including expenditure approval, will be brought to full Council for final
resolution.
Motion by Murgatroyd, seconded by Bolger, to approve the Consent Agenda, as
follows:

• Approve Request to Advertise for Bids - Neumann Park Landscape Improvements;

ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS FOR SPECIAL SERVICE
AREA NO. 1 A
Staff provided Council with a brief synopsis regarding the creation of a Special
Service Area to pay for traffic lane improvements from Bull Valley Road south to Shamrock
Lane and the installation of a traffic signal at the intersection of Shamrock Lane and Route
31. Staff continued, noting, as the Special Service Area was established, the total project
cost determined, and bids obtained for bond purchase, Council must now formally approve
the issuance of bonds in the amount of $455,000 for the purpose of Route 31 traffic lane
improvements from Bull Valley Road to Shamrock Lane, as well as the installation of a
traffic signal at the intersection of Shamrock Lane and Route 31. As per State Statute, a
copy of the ordinance authorizing the issuance of bonds and the annual tax levy will be
filed with the County Clerk.
Invitations to bid on the City's bond issuance were sent to thirteen financial
institutions. Three bids were received with the low bidder Home State Bank with a net
interest cost percentage of 5.50%. It is Staffs recommendation to approve the Bond
Ordinance for the issuance of $455,000 in bonds for Route 31 traffic lane improvements
from Bull Valley Road south to Shamrock Lane and the installation of a traffic signal at the
intersection of Route 31 and Shamrock Lane through Home State Bank.
Motion by Murgatroyd, seconded by McClatchey, to pass an ordinance approving
the issuance of bonds in the amount of $455,000 for Route 31 Traffic Lane Improvements

TAX ABATEMENT ORDINANCE FOR SPECIAL SERVICE AREA NO. 1A
Assistant Administrator Maxeiner explained as per previous Council determination,
the City of McHenry will share the annual debt service cost of the Special Service Area No.
1A established for the payment of Route 31 Traffic Lane Improvements from Bull Valley
Road south to Shamrock Lane and the installation of a traffic signal at the intersection of
Route 31 and Shamrock Lane, on an annual basis as part of the City's public benefit
portion. As property taxes are levied and pledged for bond repayment, the City must abate
the public benefit portion in the amount of $25,000 annually. If the levy is not abated,
property owners located within the Special Service Area will be taxed at a higher rate than
proposed. It is Staffs recommendation to pass an ordinance abating real estate taxes
levied for the 1999 Tax Levy Year as the City's public benefit portion of the Special Service
Area No. 1A Project, Route 31 Traffic Lane Improvements from Bull Valley Road south to
Shamrock Lane and the installation of a traffic signal at the intersection of Shamrock Lane
and Illinois State Route 31, in an amount of$25,000.
Motion by Baird, seconded by Murgatroyd, to pass an ordinance abating real estate
taxes levied for the 1999 Tax Levy Year as the City's public benefit portion of the Special
Service Area No. 1A for the purpose of underwriting the cost of Route 31 Traffic Lane
Improvements from Bull Valley Road south to Shamrock Lane and the installation of a
traffic signal at the intersection of Shamrock Lane and Illinois State Route 31, in an
amount of$25,000.

In response to Council inquiry, Director of Public Works Batt noted Staff anticipates
an early March date for activation of the traffic signal.
POLICE DEPARTMENT VEHICLE PURCHASE AUTHORIZATION FOR FISCAL YEAR
2000-2001
Chief of Police Kostecki reported the Finance and Personnel Committee at its
February 2, 2000 meeting recommended the purchase of eight police department vehicles
through the State of Illinois pricing program subject to the condition every effort is made to
obtain comparable purchase prices from local dealers. Chief of Police Kostecki explained
every year the State of Illinois develops specifications for patrol, administrative and utility
vehicles for police department operations. These specifications are advertised for bid with
the State awarding a statewide contract to the lowest qualified vendor(s). This year
specifications were developed for both Ford and Chevrolet models. It was the
recommendation of the Finance and Personnel Committee to purchase five Ford Crown
Victorias to be utilized as patrol vehicles, two Ford Tauruses to be utilized as unmarked
investigative vehicles, and one GMC Sonoma and/or Ranger to be utilized for the
community service vehicle. Local dealerships were contacted; however, only Mitchell Buick
Olds Dealership can supply the GMC Sonoma, Community Service Officer Vehicle with the
same Illinois State contract price program equipment and price. An additional piggyback
fee of $200 will be incurred, however, as the $150 delivery fee is eliminated, the City will
incur a net price increase of only $50. Buss Ford, the local Ford Dealership, informed
Chief Kostecki they are unable to acquire the five Ford Crown Victoria and two Ford
Taurus vehicles. Therefore, these vehicles will be ordered directly from the contract
vendors Bob Riding Ford of Taylorville, Illinois and Landmark Ford of Springfield, Illinois.
In response to Council inquiry, Chief of Police Kostecki noted the successful State
of Illinois Ford vendor would not deal with any intermediary dealerships.
Motion by McClatchey, seconded by Murgatroyd, to authorize and approve the
purchase of eight police department vehicles: seven through the Illinois State Contract
Purchasing Program from the lowest qualified vendors:
■ five Ford Crown Victoria vehicles from Bob Ridings Ford of Taylorville, Illinois in
an amount not-to-exceed $101,945;
■ two Ford Taurus vehicles from Landmark Ford of Springfield, Illinois, in an
amount not-to-exceed $30,928;

and one vehicle from local GMC Dealer Mitchell Buick Olds of McHenry, Illinois:
■ one GMC Sonoma extended cab pickup truck in an amount not-to-exceed
$15,483.49,
subject to delivery and payment after May 1, 2000 and the beginning of the City's Fiscal
Year.

REQUEST TO ADVERTISE FOR EMPLOYEE — PUBLIC WORKS ENGINEERING
INSPECTOR
Director of Public Works Batt reported as per the recommendation of the Finance
and Personnel Committee as well as the Public Works Committee, Staff is seeking
authorization to advertise for the City Inspector/Engineer position. This position was
vacated when Daniel Marcinko was promoted to Assistant Director of Public Works. A copy
of the job description was distributed for Council review. Staff clarified although this
position appeared as a line item in the 1999-2000 Budget, the salary was reallocated to
the Assistant Director of Public Works upon Mr. Marcinko's promotion. Staff is
recommending the vacancy be filled immediately and the 1999-2000 Budget be adjusted
accordingly. Staff anticipates a hire date no earlier than April 2000, just one month prior to
the beginning of the 2000-2001 Fiscal Year.
Motion by Baird, seconded by Glab, to approve and authorize the advertisement for
the City Inspector/Engineer position immediately, and to budget monies within the 2000-
2001 Fiscal Year for this position with the understanding the qualified candidate is located,
the position may be filled within the 1999-2000 Fiscal Year.

CONSIDERATION OF PROPOSED STOP STREETS
Krista Shelton of 5047 Glenbrook Trail was in attendance. Director of Public Works
Batt reported in response to Ms. Shelton's request regarding the installation of stop signs
on intersecting streets with Glenbrook Trail, Staff conducted a review of the subdivision.
Staff discovered stop signs at the following intersections:

■ Glenbrook Trail (NB/SB) Driftwood Trail
■ Driftwood Trail (NB/SB) Glenbrook Trail
■ Driftwood Trail (NB/SB) Winding Creek Drive

■ Winding Creek Drive (EB/WB) Crystal Lake Road.
Staff is recommending stop signs be installed at the following streets intersecting
Glenbrook Trail: --�

■ Colony Court.
Some discussion followed. In response to Alderman Baird's request for clarification,
Staff noted a policy had been adopted requiring residential developers designate and/or
establish stop streets as part of their developmental process. City Administrator Lobaito
noted this policy would be incorporated into the proposed draft revision of the City's

current Subdivision Control Ordinance. City Administrator Lobaito also noted, since this
policy's creation, no significant residential developments have appeared before Council for
final review and approval.
Alderman Glab suggested a four-way stop be installed at the Glenbrook Trail and
Cross Trail intersection. Further discussion followed regarding the effectiveness of stop
signs versus yield signs.
Ms. Shelton addressed Council noting this subdivision houses Riverwood School
and experiences significant bus and pedestrian traffic. She cited the need for safety and
noted without additional stop signs, Glenbrook Trail was a natural speedway.
Motion by Baird, seconded by Murgatroyd, to direct Staff to draft an ordinance
creating stop streets as presented by Director of Public Works Batt, and a four-way stop at
the intersection of Glenbrook Trail and Cross Trail.

MAYOR STATEMENT AND REPORTS
Mayor Cuda reported he had met with a representative of the Loos Development
Company regarding the possible development of an office building on the south side of
Bull Valley Road between Midwest Bank of McHenry County and the Amoco Service
Station. The development and construction of an office building will require a zoning
reclassification. In response to Council inquiry, Mayor Cuda noted the proposed building
would be three stories in height. However, due to the area's unusual topography, the
building would appear to be only one-story from the Bull Valley Road exposure.
COMMITTEE REPORTS
Parks and Recreation Committee Chairman Alderman Baird tentatively scheduled a
Parks and Recreation Committee Meeting for Tuesday, February 29. 2000 at 7:00 p.m.
STAFF REPORTS
Director of Community Development Napolitano reported the Arby's Restaurant
located on North Route 31 in the McHenry Plaza Shopping Center experienced a small
fire. No one was hurt and the damage was minimal. Director Napolitano reminded Council
of the Committee of the Whole Meeting scheduled for Wednesday, February 23, 2000 at
7:30 p.m. to review and comment on the proposed Deer Park Concept Plan.
In response to Director Napolitano's request, a Committee of the Whole Meeting
was tentatively scheduled for Monday, March 13, 2000 at 7:30 p.m. to review the proposed
Pacini Commercial Development on West Route 31, south of the McHenry Corporate
Center.
Director Napolitano also noted the Shamrock Farm Concept Plan was also ready for
a Committee of the Whole development review. Mayor Cuda requested Staff discover if the
Shamrock Farm developers had any reservations regarding the recently increased City of
McHenry Developer Donation Fees.
Director of Public Works Batt reported, in an effort to prepare for the Motor Fuel Tax
Funding of the City's Streets 2000 Program, other Motor Fuel Tax projects are being
submitted to the Illinois Department of Transportation for final audit and closure. He
requested any Council inquiries be directed to his attention.
Director of Parks and Recreation Merkel reminded Council of the Recreational
Facility Open House scheduled for Wednesday, February 23, 2000, between 4:00 p.m.
and 7:00 p.m. Representatives from the consulting architectural firm Sente and Rubel will
also be in attendance.

Chief of Police Kostecki reported the newly hired crossing guard, Ms. Billie
Mazurek, started Monday, February 14, 2000.
Referencing the Union Pacific Railroad letter previously provided Council, City
Administrator Lobaito reported telephone conversations with Union Pacific Railroad
representatives have revealed their intent to renegotiate the existing property lease. As the
City has an existing sub-lease with tenant Tom and Trey Corporation d/b/a The Main
Street Station, Staff has provided the required 180 day notification. City Administrator
Lobaito noted Union Pacific Railroad sustained significant maintenance and repair
expense this past year and may be seeking a more favorable property lease. Negotiations
will be initiated sometime next week. -`
City Administrator Lobaito also informed Council, he, Mayor Cuda and City Clerk
Althoff received notification from Wireless Telecommunications Corporation, Metro Com, of
their intent to pursue a right-of-way agreement with the City of McHenry to permit the
installation of electronic devices on existing City-owned poles. Additional information will
be provided Council.
City Clerk Althoff, noting the retirement of Officer James William Fitzgerald after 25
years of service, requested Council authorize the expenditure of$100 for a retirement gift.
Motion by McClatchey, seconded by Glab, to authorize the expenditure of $100 for
the purchase of a retirement gift for Officer James William Fitzgerald.

City Clerk Althoff also noted a Good Luck Retirement Party will be hosted for Officer

NEW BUSINESS
Alderman Baird informed Council he was in receipt of a request from the Riverwood
School Spring Fling Chairperson, Linda Eaton. Ms. Eaton is requesting Council approval
to install eight signs advertising the Spring Fling Craft Show at Riverwood School on
Saturday, March 18th. These signs would be installed for a two-week period prior to the
event. Alderman Baird distributed copies of Ms. Eaton's letter. Some discussion followed.
Alderman Glab requested the Front Royal and Crystal Lake Road location be
limited to the northwest corner.
Motion by Baird, seconded by Bolger, to approve the placement of signs advertising
the Riverwood School Spring Fling Craft Show at the following locations two weeks prior to
the Saturday, March 18th event:

In response to Alderman McClatchey's inquiry, Director of Public Works Batt stated
the initiation of a "No Right Turn on Red" from Pearl Street onto Northbound State Route
31 was not feasible. Some discussion followed. As per Council direction, City Administrator
Lobaito agreed to include a map and informational memo to Council regarding the
implementation of a "No Right Turn " from Pearl Street onto Northbound State Route 31.
In response to further inquiry by Alderman McClatchey, Director of Parks and
Recreation Merkel reported price quotes were being obtained for the purchase of
playground equipment at Freund Field. This expenditure will be included in the Parks and
Recreation Department budget proposal for Fiscal Year 2000-2001. In response to
Alderman McClatchey's inquiry, City Clerk Althoff noted three City Seal renderings were
presented by local illustrator Lori Wilhelm to Staff and Mayor Cuda for comment and
review. Comments were provided Ms. Wilhelm for further revision. These renderings will
then be presented to full Council for formal consideration.
Alderman Glab requested Staff address his request for stop signs on Oakwood
Drive at Kensington and Royal. He also requested further information on the feasibility of
constructing an island on Royal Drive. Alderman Glab also requested Council consider
approving expenditure of monies to enhance and improve the Dartmoor Bridge.
In response to Alderman Glab's inquiry, City Administrator Lobaito noted Pace has
agreed to add a route through McHenry Corporate Center as per City of McHenry request.
A schedule has been promised, but has yet to be provided. In addition, Pace will install a
shelter within the McHenry Corporate Center. However, maintenance will be the
responsibility of the City of McHenry. At Council's direction, once the shelter's location has
been determined and a schedule provided, Staff was directed to contact the Human
Resources Department of all McHenry Corporate Center businesses with the
aforementioned information.

In response to Council inquiry, City Administrator Lobaito reported Wetland
Mitigation efforts are being coordinated by Parks Maintenance Supervisor Tom Schmidt in
cooperation with Hey and Associates, consultants hired by the City of McHenry to meet all
wetland mitigation obligations. City Administrator Lobaito also noted if the City of McHenry
is successful in acquiring the eight-acre Green Street property located on the northeast
corner of Green Street and Miller Road, additional mitigation obligations will be assumed.
Noting the absence of several Council members and himself during the week of
March 27, 2000, Mayor Cuda suggested the Council Meeting scheduled for March 29th be
scheduled to March 22"d.
