APRIL 12, 2000
A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda
at 7:30 P.M. on Wednesday, April 12, 2000 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey,
Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito,
City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director of Public Works
Batt, Director of Parks and Recreation Merkel, Director of Community Development
Napolitano, Assistant Administrator Maxeiner. Absent: None.
INTRODUCTION
Chief of Police Kostecki introduced the following five new Patrolmen:
■ Jill Foley;
■ Robert Handrock;
■ Bryan Hartgraves;
• Josh Shirey;
■ John Birk.
Mayor Cuda and Council welcomed the new officers to McHenry and wished them
success in their new position.
TEN MINUTE PUBLIC INPUT SESSION
James Doran of 4400 Shamrock Lane addressed Council expressing his concern
with the great number of potential residential developments being considered and
approved by Council, including Shamrock Farm Development, Riverside Hollow, Village
Green, Kresswood Trail Townhomes, and Deer Park Development. He noted the
importance of providing adequate infrastructure to meet the needs of the proposed
developments and ensuring these developments pay for themselves. In addition, he stated
his concern with increasing property tax numbers, the community's inability to pass the
high school referendum question, and the possibility that many people who work in
McHenry soon will not be able to afford living in McHenry. In conclusion, Mr. Doran
informed Council the flag halyard in front of the Municipal Building needed repair.
Scott Smith of 3710 Lee Street and Economic Development Commission Riverwalk
Concept Plan Sub-committee Chairperson addressed Council, stating the preliminary
Riverwalk Concept Plan had been distributed by City Staff for their review and comment.
He requested Council contact either Riverwalk Committee Chairman Kit Carstens, Anne
Rodenkirch, or him with comments and recommendations. The Committee will also begin
to contact affected property owners to obtain their input and suggestions on the
preliminary Riverwalk Concept Plan.

REQUEST FOR USE OF PETERSEN PARK - HAUNTED HAYRIDE, WONDER LAKE
WATER SKI SHOW TEAM
Wonder Lake Water Ski Show Team representative Kim Carlsten of 1518 Flower
Street, McHenry, was in attendance. Mr. Carlsten addressed Council, requesting use of
Petersen Park to host the Third Annual Wonder Lake Water Ski Show Team Haunted
Hayride event. The event would take place on October 14,20,21,27, and 281h , 2000. The

rides will begin at 7 p.m. and ticket sales will end at 10:15 p.m. with the last ride
concluding at 11 p.m. Cleanup will take approximately one hour, with the park being
vacated by midnight. Ms. Carlsten also noted, as the Wonder Lake Water Ski Show Team
is not-for-profit organization, Council approve waiving any and all fees associated with the
use of Petersen Park. In addition, the Wonder Lake Water Ski Show Team is seeking
council approval to place five 4' X 4' free-standing sandwich-style signs advertising the
event throughout the month of October at the following locations:
■ R.A. Adams, Route 120;
• 302 North Front Street; -.
■ Ridge Road on the Gerstad Property;
■ Crystal lake Road and Bull Valley Road Intersection;
■ Petersen Park Road and McCullom Lake Road.
Ms. Carlsten noted last year's event was a success, entertaining over 3,500 people.
Donations were made on behalf of the City of McHenry to the Big Brothers, Big Sisters
Organization, as well as to the Parks and Recreation Department directly. It is the Team's
intent to repeat these donations, if the Haunted Hayride event is as successful this
calendar year.
At Alderman McClatchey's initiation, some discussion followed regarding noise
complaints Council received from the adjacent neighborhood. Ms. Toni Meyer of the
Lakewood Subdivision was in attendance. She provided Council with specific examples of
problems the neighborhood experienced last year during the Haunted Hayride event. Ms
Meyer agreed to the Wonder Lake Water Show Ski Team's proposed adjusted schedule
stopping ticket sales at 10:15 p.m. and prohibiting rides beyond 11 p.m. Ms. Meyer
emphasized the need for enforcement of these time constraints.
It was the consensus of Council to permit the Wonder Lake Water Ski Show Team's
Haunted Hayride event this year and at its conclusion, reviewing its conduct and affect on
the adjacent neighborhood. —
Motion by Murgatroyd, seconded by Bolger, to approve the Wonder Lake Water Ski
Show Team's request for the use of Petersen Park on October 14,20,21, 27, 28, 2000 for
the Haunted Hayride with a beginning event time of 7 p.m., ticket sales ending at 10:15
p.m., and the last ride concluding at 11 p.m.; the waiving of all associated fees; and
permitting the display of five 4' X 4' free-standing sandwich-style advertising signs through
the month of October at the following locations:

INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF MCHENRY AND
MCHENRY COUNTY HIGHWAY DEPARTMENT FOR THE PURCHASE OF MILLER
ROAD STREETLIGHTS
City Administrator Lobaito reminded Council the City of McHenry requested and
received a $20,000 Illinois First Grant for the purchase and installation of four streetlights
along Charles J. Miller Road. Inadvertently, $10,000 of this grant was sent to the McHenry
County Highway Department. The Illinois Department of Transportation (IDOT), in an effort
to correct the mistake, requested McHenry County Highway Department and the City of
McHenry enter into an Intergovernmental Agreement, transferring the $10,000 received by
the McHenry County Highway Department to the City of McHenry, upon execution of the
Agreement, in exchange for the City of McHenry assuming all the County's obligations
pursuant to the maintenance terms of the original grant agreement.

Motion by Bolger, seconded by Baird, to authorize the Mayor and City Clerk's
execution of an Intergovernmental Agreement between McHenry County and the City of
McHenry to transfer $10,000 received from IDOT in exchange for the City of McHenry
assuming all of the County's obligations, specifically maintenance, for the purchase and
installation of four street lights along Charles J. Miller Road.

NEUMANN PARK LANDSCAPE IMPROVEMENTS BID AWARD
Director of Parks and Recreation Merkel reminded Council a landscape plan for the
development of Neumann Park on Green Street had been submitted approximately three
years ago. The plan incorporated features of the existing Green and Elm Street Park, in an
effort to promote continuity along Green Street. A brick paved walkway connects the rear
public parking area with the Green Street frontage. The plan also includes a garden that
will be dedicated and marked in memory of Beautification Committee chairwoman and
former Alderwoman Liz Nolan. The proposed 2000-2001 Budget includes a $50,000 line
item in the Developer Donation Fund for this project. Minor improvements will be installed
by City crews, including the installation of an underground water vault. The park will also
include benches and trash receptacles.
Director Merkel informed Council specifications were prepared and three bids for
Neumann Park landscape improvements were submitted and opened on Tuesday, March
28, 2000 at 11:30 a.m. The low bidder was Earth Developments of Richmond, Illinois, in an
amount of$41,470.
Director of Parks and Recreation Merkel, as well as City Administrator Lobaito,
presented the proposed landscape plan to Green Street merchants on Tuesday, April 11,
2000, at 3 p.m. Overall, the Green Street merchants supported the proposed landscape
design.
In response to Alderman Baird's inquiry, City Administrator Lobaito noted the Green
Street merchants did request an update regarding the City's future commitment to Green
Street's revitalization, specifically Phase II, from north Route 120 to Pearl Street, and
Phase III, from the Green Street Bridge south to Waukegan Road. Some discussion
followed.
In response to Alderman Glab's inquiry, Staff noted all Neumann Park drainage
issues will be addressed during development.
Motion by McClatchey, seconded by Baird, to grant the Neumann Park landscape
improvements contract to low bidder Earth Developments Inc., of Richmond, Illinois, in an
amount not-to-exceed $41,470.
Voting Aye: Bolger, McClatchey, Murgatroyd, Baird.

INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF MCHENRY AND THE
VILLAGE OF JOHNSBURG FOR DISPATCH SERVICES
Chief of Police Kostecki informed Council the proposed Intergovernmental
Agreement between the City of McHenry and the Village of Johnsburg for Dispatch
Services was drafted by City Attorney McArdle. The Village of Johnsburg formally
approved the Agreement as presented and the document has been executed by both the
Village President and Village Clerk. If approved, dispatch services for the Village of
Johnsburg will begin May 1, 2000. Chief of Police Kostecki also noted the McHenry Police

In response to Council inquiry, Chief of Police Kostecki explained the annual fee of
$19,476 is based on the cost per officer on duty. Further discussion followed regarding
sufficient Staff and liability concerns. In response to Alderman Baird's inquiry, Chief
Kostecki noted currently the Village of Johnsburg is under contract with the County to
provide dispatch services.
Mayor Cuda referenced the current trend to establish regional dispatch areas. City
Attorney McArdle offered to provide Council with a written opinion regarding potential _
exposure and liability.
Chief Kostecki informed Council the $19,476 fee will be reviewed and adjusted
annually each April. Council requested a status report be provided in March 2001 for their
review. Further discussion followed addressing liability concerns, adequate insurance
coverage, and service levels.
Motion by Bolger, seconded by McClatchey, to approve and authorize the Mayor
and City Clerk's execution of the Intergovernmental Agreement between the City of
McHenry and the Village of Johnsburg for Dispatch Services as presented, effective May
1, 2000 for the period of one year.

UNIVERSAL HIRING PROGRAM GRANT APPLICATION
Chief of Police Kostecki informed Council the Office of Community Oriented Policing
Services (COPS) within the Department of Justice has announced a new series of funding
opportunities under the Universal Hiring Program. The COPS office is committed to
assisting law enforcement agencies secure additional funding to add officers to increase
community policing services. The Universal Hiring Program pays up to $75,000 per officer
for three years. The City of McHenry in 1995 and 1996 received funds under this program,
hiring five additional officers. Chief of Police Kostecki clarified monies received through
this grant program must reflect an increasing percentage of participation on the part of the
receiving agency. Monies can not be used to supplant already budgeted amounts. These
grant funds could, therefore, not be utilized to pay for the three additional patrol officers
requested by Chief Kostecki in the 2000-2001 Budget.
In response to Council inquiry, Chief Kostecki noted grant funds are awarded in a
first-come first-served fashion. Staff presented the following two options for Council
consideration:
■ Approve the Police Department's request for three additional officers in the
2000-2001 Budget, accelerating the hiring of patrol officers by hiring three
additional officers for a total of six for the Fiscal Year 2000-2001;
■ Deny the Police Department's request for three additional officers in the 2000-
2001 Fiscal Year, and submit the grant application, hoping for approval.
Some discussion followed. Chief Kostecki noted the Police Department presented
material to the Finance and Personnel Committee at its July 13, 1999 meeting, supporting
personnel requests for eight additional officers over the next three years, two additional
community service officers, and additional supervisory personnel. Chief Kostecki also
noted Council could approve the three patrol officers requested for the 2000-2001 Fiscal
Year, and apply for the three additional officers, through the Universal Hiring Program
grant. If the grant were to be awarded and Council subsequently determined the hiring of
six officers during the 2000-2001 Fiscal Year was cost prohibitive, the grant monies could
be refused. A brief discussion followed.

Universal Hiring Program grant application to the Department of Justice COPS Office for
three additional police officers for the 2000-2001 Fiscal Year.

MAYOR STATEMENT AND REPORTS
Mayor Cuda informed Council Alderman Bolger has approached Representative
Franks to solicit his support for the installation of a westbound left-turn lane on Route 120
at Valley View School. Mayor Cuda suggested Council also pass a resolution in support of
this action.
Motion by Murgatroyd, seconded by Baird, to pass a resolution in support of the
installation of a westbound left-turn lane and/or the construction of an eastbound
deceleration lane in front of Valley View School on Route 120.

Mayor Cuda also informed Council he and City Administrator Lobaito had met the
new owners of the McHenry Market Place whom have stated their intent to renovate and
refurbish the Market Place fagade and parking lot. These improvements are scheduled for
summer construction.
Alderman Glab recommended Staff suggest the new Market Place property owners
meet and, when possible, work with adjacent property owners to improve this area in
general.
COMMITTEE REPORTS
Finance and Personnel Committee Chairman Alderman Murgatroyd informed
Council the Finance and Personnel Committee had met just prior to this evening's
regularly scheduled Council meeting to begin budget discussions for the 2000-2001 Fiscal
Year. The Committee will meet again tomorrow, Thursday, April 13, 2000 at 7p.m. in the
Parks and Recreation Department Conference Room.
Community Development Committee Chairman Alderman McClatchey scheduled a
Community Development Committee meeting for Wednesday, May 17, 2000 at 7 p.m. to
review the adoption of the 1996 BOCA Code.
STAFF REPORTS
Director of Community Development Napolitano reminded Council comments on the
Shamrock Farm Concept Plan are due before next Monday, April 17, 2000. Planning
Resources has completed a preliminary draft of the Crystal Lake Road Traffic Study. Once
provided Staff, copies will in turn be distributed to Council.
Director of Public Works Batt reported Staff had conducted interviews for the City
Engineering Inspector position. City Administrator Lobaito and Director Batt will interview
the top two candidates sometime within the next two weeks. Director Batt and Assistant
Director Marcinko met with Baxter and Woodman representative Al Stefan to review the
proposed Motor Fuel Tax Streets 2000 Program. The original project estimate was $1.9
million; however, after Staff review, the estimate has been reduced to $1.1 million. Staff is
recommending the removal of Riverside Drive from the program in light of the potential
development and infrastructure improvements along stretches of Riverside Drive. Director
Batt also reported Staff would be meeting with Waste management representatives on
Friday, April 14, 2000 to conclude negotiations regarding the proposed three-year contract
extension. Director Batt noted Hank DeBoer of Marengo Disposal has expressed an
interest in submitting a bid for the City's waste hauling contract.

Director of Parks and Recreation Merkel reported the volunteer Project Zone
Skatepark Facility Committee would be meeting tomorrow, Thursday, April 13, 2000 to
discuss funding options as well as to continue design recommendations with Thompson
and Dyke architectural firm representatives.
Chief of Police Kostecki reported Ricky Bjorklund was hired to replace retiring
Officer William Fitzgerald. Mr. Bjorklund will begin training at the Police Academy next
week.
City Administrator Lobaito reported a Whispering Oaks Neighborhood Meeting had
been scheduled by Alderman Glab for Monday, April 24, 2000 at 7 p.m. at the Whispering
Oaks Community Center. City Administrator Lobaito reminded Council the Recreation
Center facility information was distributed for Council review and consideration at the
Monday, April 10, 2000 Committee of the Whole Meeting. The adoption of a
Telecommunications Tax will be considered at the April 19, 2000 regularly scheduled
Council Meeting. He noted Staff is available to provide additional information and/or
answer questions.
City Clerk Althoff reported technical difficulties were experienced by A T & T Cable
during the televising of last week's April 5, 2000 regularly scheduled Council meeting. This
meeting will be aired directly following tonight's meeting on Friday, April 14, 2000 at 7 p.m.
NEW BUSINESS
In response to Alderman Glab's inquiry regarding the need for a Public Works
Committee Meeting to discuss the 2000 Streets Program, it was the consensus of Council
to bring the program to full Council on or prior to the May 3, 2000 regularly scheduled
meeting. Alderman Glab also thanked Staff for their efforts in providing better PACE
service throughout the McHenry Corporate Center.
At Alderman Glab's initiation a discussion followed regarding the need for a traffic
signal at the intersection of Bull Valley Road and Ridgeview Road. Alderman Glab
suggested Council consider requiring a traffic signal at this intersection prior to the
conclusion of additional development on the Pacini Property. Director of Public Works Batt
noted this intersection was currently a three-way intersection. Mayor Cuda suggested Staff
conduct a traffic count now. Information obtained from this study can then be compared to
information obtained from future studies. This information could then be used to support
the need for the installation of a traffic signal at this intersection.
Citing the lack of Senior Citizen Programs, Alderman Glab stated his opposition to
the development of a recreational facility.
