HomeMy WebLinkAboutMinutes - 07/05/2000 - City Council REGULAR MEETING J U LY 5, 2000 A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, July 5, 2000 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Baird. Alderman Murgatroyd arrived at 7:34 p.m. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director Public Works Batt, Director Parks and Recreation Merkel, Director Community Development Napolitano, Assistant Administrator Maxeiner. Absent: None. '— SWEARING IN CEREMONY Chief of Police Kostecki introduced Police Commission Chairman Timothy Wirfs. Chairman Wirfs conducted the Swearing In Ceremony of 21-year City of McHenry veteran Patrol Officer Thomas Beyer. Officer Beyer is being promoted to the position of Sergeant. Officer Beyer joined the McHenry Police Department on January 8, 1979. Sergeant Beyer is a member of the City of McHenry Police Department's Critical Accident Team and is a Truck Enforcement Specialist. Mayor Cuda and Council congratulated Sergeant Beyer on his promotion to the position of sergeant. Alderman Murgatroyd arrived at 7:34 p.m. TEN MINUTE PUBLIC INPUT SESSION Diana Mantzoros of 1904 North Oak Drive addressed Council, stating her continuing concerns regarding the integrity of the water main located along her property's frontage. She cited two recent breaks and the subsequent flooding of her home. She again requested Council consider a replacement program for the water mains in Lakeland Park. Linda Schmidt of 1914 North Oak Drive, addressed Council stating she shared Ms. Mantzoros' concerns regarding the integrity of the water main located along the frontage of their properties. Some discussion followed. At Mayor Cuda's suggestion, Public Works Committee Chairman Alderman Bolger scheduled a Public Works Committee Meeting for Wednesday, July 12, 2000 at 7 p.m. in the Aldermen Conference Room to discuss the integrity of the water mains in the area of Oak Drive in Lakeland Park. Both Ms. Mantzoros and Ms. Schmidt were invited to attend. PRESENTATION: ECO-FRIENDLY AWARDS BY THE MCHENRY ENVIRONMENTAL ADVISORY COMMISSION Environmental Advisory Commission (EAC) Chairman Thomas McCarthy presented the Eco-Friendly Environmental Plaque of Commendation to the following City of McHenry businesses: Cunat Brothers Inc. Elizabeth's House of Charm Fawn Ridge Apartments Gattone Pharmacy Lakeland Animal Hospital Landmark School Lillian Street Apartments McHenry Post Office Nature's Cornucopia Rex Auto Body Shop St. Mary's Church Southgate Apartments Westside Crest Ltd. In conclusion, EAC Chairman McCarthy thanked Mayor Cuda and Council for their continuing support of the Environmental Advisory Commission's recognition of their commercial recycling recognition program. In response to Mayor Cuda's request, Council agreed to address Agenda Item Mayor Statement and Reports next. Page 2 7/5/00 MAYOR STATEMENT AND REPORTS Mayor Cuda announced the North Route 31 Property Owners and Developers have informed Staff that three major retailers have agreed to locate within their development: ■ Home Depot ■ Kohl's Department Stores ■ Meijer's Department Stores. The Developers have opined these retail establishments will generate $400,000,000 in sales tax revenue. Efforts are also being made to attract a Borders Book Store, Office Max, Chili's Restaurant, and electronic dealer Circuit City. Mayor Cuda expressed his gratitude to Staff for their efforts in coordinating and assisting the developers with this project. Citing the increased development within the corporate boundaries of the City, Alderman Glab suggested Council schedule Special Meetings whose Agendas are dedicated to developmental issues only. CONSENT AGENDA Motion by Bolger, seconded by Glab, to approve the Consent Agenda as follows: ■ Approval: Resolution approving David Huff Memorial; • Approval: Resolution approving the MFT 2000 Street Reconstruction Program; ■ Approval: Ordinance amending certain sections of Chapter 13 of the Municipal Code; ■ Approval: Amendment to Preliminary Plat and granting variance to Inland Business Park; • Approval: Promotion to Wastewater Operator II - Russell Ruzicka; • Approval: Health Plan Partnership Sharing for 99/00 Plan Year; ■ Approval: Block Party Requests: ■ Stacey Atkins -618 S. SIGN VARIANCE REQUEST — MCHENRY CORPORATE CENTER Director Community Development Napolitano informed Council McHenry Corporate Center President Kit Carstens submitted a request for a variance to install a temporary sign at the Ridgeview Drive entrance/exit to the McHenry Corporate Center. The proposed two-sided sign would be 4' X 8' or 32 square feet with a 6' height. Side one welcomes visitors to the McHenry Corporate Center, while side two thanks visitors for coming to the Corporate Center. Mr. Carstens has agreed to remove the sign once the McHenry Corporate Center is entirely built out. In response to Alderman Murgatroyd's inquiry, Staff noted the McHenry Corporate Center Business Park is approximately 80% built out. Alderman Murgatroyd also suggested the standard annual review provision be required. Motion by Baird, seconded by Glab, to grant a variance to the McHenry Corporate Center for the installation of a two-sided 4' X 8', 6' high, temporary sign, subject to an annual review by Council and ultimate removal upon the complete build out of the McHenry Corporate Center. Page 3 7/5/00 2000-2001 MCMRMA RENEWAL Assistant Administrator Maxeiner informed Council the City of McHenry has been a member of the McHenry County Municipal Risk Management Agency (McMRMA) since the pool's inception in 1988. The City's 2000-2001 Budget reflects a $300,000 expenditure for McMRMA's annual renewal premium. Actual renewal cost is $279,456.25. This renewal cost includes $13,728.25 for loss prevention training and activities. The funding level remains at 88%. In response to Council inquiry, Assistant Administrator Maxeiner noted MCMRMA is -- comprised of eight member communities including: Algonquin, Fox River Grove, Huntley, Island Lake, McHenry, Spring Grove, Woodstock, and the Woodstock Fire and Rescue District. Assistant Administrator Maxeiner opined approximately 400 employees are covered under McMRMA's pool. In response to Alderman Baird's inquiry, Assistant Administrator Maxeiner noted the 88% funding level is based on annual loss averages for the total pool. Motion by Murgatroyd, seconded by McClatchey, to approve and authorize the expenditure of$279,456.25 for the 2000-2001 annual McMRMA premium renewal. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. DIEDRICH FARM PROPERTY ANNEXATION Property Owner, Mr. Roger Gerstad and his attorney Samuel Diamond of Diamond and LeSueur were in attendance. As per Council direction at the June 19, 2000 regularly scheduled Council Meeting, City Administrator Lobaito contacted Diedrich Farm Property Owner Roger Gerstad via letter requesting he reconsider annexation to the City of McHenry at the proposed maximum density of 191 lots. Mr. Gerstad and Staff presented for Council consideration an annexation agreement for approximately 100 acres located north of Lincoln Road and west of Chapel Hill Road. Staff noted the Public Hearing for the proposed annexation was conducted on August 24, 1998. In addition, all registered objectors were notified of this evening's meeting and provided a copy of this evening's Agenda including consideration of the Diedrich Farm annexation. Mayor Cuda opened the floor to audience comment. Mr. Frank Van Bree addressed Council respectfully requesting Council table consideration of this annexation. He cited traffic concerns, density and the Concerned Citizen's on Growth inability to review the proposed plan. Receiving no other audience comments, Mayor Cuda requested Council comment and/or inquiry. City Administrator Lobaito reported the proposed annexation agreement is essentially the same as the agreement proposed in August of 1998. Several issues have been resolved since that date, including: ■ the purchase by the Illinois Department of Transporation of the proposed FAP 420 corridor; ■ the extension of water service east of the Fox River. Page 4 7/5/00 The proposed agreement also provides for limited representation relative to the Concept Plan binding on both parties. These representations are contained on page 2, #12, of the agreement and include: ■ Location, but not dimensions, of storm water detention ponds; ■ sole discretion by the McHenry City Council of the location of donated park land consisting of not-less-than 2 acres; ■ Location of the proposed access to Stanley Archaki's property located east of the proposed development; ■ Staff approval of the proposed landscape screening abutting the Garski Subdivision; • A maximum density of 191 residential lots; and ■ Overall compliance with the City of McHenry's Subdivision Control Ordinance. The annexation agreement also establishes a fixed parks cash contribution amount and requires the development of any/all recreational park lot(s), as approved by Council, at the property owners expense. Alderman Murgatroyd noted the proposed development must still go through the preliminary and final plat review and approval process before the Plan Commission. Mayor Cuda provided the following comparative statistics between the proposed Diedrich Farm Development in the Village of Lakemoor versus the City of McHenry: Village of Lakemoor City of McHenry School Impact Fees $336,000 $1,224,000 High School Student Differential - 20 Elementary School Student Differential - 51 Park Impact Fees $0 $336,500 Mayor Cuda also noted the proposed development will also extend sanitary sewer services to the area. Aldermen Baird and Bolger stated their support of the proposed annexation. Motion by Baird, seconded by Glab, to pass an ordinance authorizing the Mayor and City Clerk's execution of an Annexation Agreement between the City of McHenry First Midwest Trust No. 13255 and Gerstad Builders Inc. beneficiary, for the annexation of approximately 100 acres, located north of Lincoln Road and west of Chapel Hill Road. Voting Aye: Bolger, Glab, Murgatroyd, Baird, Cuda. Voting Nay: McClatchey. Absent: None. Motion carried. Motion by Glab, seconded by Baird, to pass an ordinance annexing the Diedrich Farm 100-acre property located on the north side of Lincoln Road and west of Chapel Hill Road. Voting Aye: Bolger, Glab, Murgatroyd, Baird, Cuda. Voting Nay: McClatchey. Absent: None. Motion carried. Motion by Murgatroyd, seconded by Glab, to pass an ordinance granting a zoning map amendment to RS-2 Medium Density Single Family District for the Gerstad Diedrich Farm 100 acre property located north of Lincoln Road and west of Chapel Hill Road. Voting Aye: Bolger, Glab, Murgatroyd, Baird. Voting Nay: McClatchey. Absent: None. Motion carried. Page 5 7/5/00 Staff noted the City's recently approved Comprehensive Plan proposes this area be developed as RS-2 Residential which equates to 1-4 units per acre. The Diedrich Farm Development as approved, permits a maximum density of less than two units per acre. COMMITTEE REPORTS There were no Committee Reports. STAFF REPORTS Director Community Development Napolitano requested Council schedule a Committee of the Whole Meeting to consider the proposed McAndrews Farm Concept Plan. Some discussion followed. It was the consensus of Council to conduct Special Meetings for the presentation of new development concept plans and require the developer to reimburse the City for Council attendance. A Special Meeting was scheduled for Monday, July 24, 2000 at 7:30 p.m. to consider the McAndrews Farm Concept Plan. Director Napolitano also informed Council the Ramada Inn located on South Route 31 experienced a fire on Sunday, July 2, 2000. Overnight guests are being prohibited until the sprinkler and alarm systems are operational and the McHenry County Health Department has inspected and approved the facility for habitability. Director Parks and Recreation Merkel congratulated the McHenry Area Jaycees organization on the fine fireworks display conducted at Petersen Park on Saturday, July 1, 2000. Mayor Cuda noted a resolution commending them for their efforts will be created and presented to the McHenry Area Jaycees at the July 19th regularly scheduled Council Meeting. In response to Alderman Glab's inquiry, Staff noted Petersen Park experienced an adult larvicide spray prior to the fireworks celebration. Alderman Glab also expressed some concerns regarding the future location of the fireworks projections in light of the proposed Petersen Park waterfront improvements. Chief of Police Kostecki reported telecommunications dispatcher Ed Kilcullen had �- submitted his resignation. Staff will be requesting permission to advertise for a replacement. Chief Kostecki also reported Council will be asked to recognize those members of the midnight patrol responsible for the safe and prompt evacuation of the Ramada Inn during the Sunday July 2"d fire. City Clerk Althoff requested those individuals, both Council and Department Heads, interested in participating in the Fiesta Days Dunk Tank, as part of the July 21" Ice Cream Social events, contact her as soon as possible. NEW BUSINESS In response to Alderman Murgatroyd's inquiry, City Clerk Althoff noted the Great Lakes Navy Band has been asked to return and participate in next year's Fourth of July activities. In response to Alderman Murgatroyd's request, Chief of Police Kostecki stated traffic congestion problems experienced subsequent to the fireworks display will be addressed and corrected by the McHenry Police Department prior to next year's festivities. City Administrator Lobaito, requesting Council's latitude referenced his Department Head Memo dated July 5, 2000. Per Council request, the recently passed ordinance prohibiting left turns from Green Street onto Elm Street between the hours of 7 a.m. and 7 p.m. was to be reviewed. Chief of Police Kostecki provided Council with an investigative study of the ordinance's effectiveness. Chief of Police Kostecki opined traffic flow in the area has been improved overall. After some discussion, it was the consensus of Council to retain the ordinance. Alderman Glab requested Council consider the request of Devonshire Court residents to assist monetarily, at a 50% participation level, their road improvement efforts. He noted Devonshire Court is a private roadway. He suggested Council consider accepting the road as a public street. A lengthy discussion followed. Aldermen Bolger and Baird noted similar requests have been denied. Page 6 7/5/00 Director Public Works Batt suggested the road be brought up to City standards prior to City acceptance. Council suggested the appropriate homeowner association submit their request to the Mayor and City Council in writing. Alderman Baird suggested information regarding the establishment of a Special Service Area be provided Council. EXECUTIVE SESSION: POTENTIAL LITIGATION Motion by Glab, seconded by Bolger, to go into Executive Session to discuss Potential Litigation at 8:45 p.m. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.
