HomeMy WebLinkAboutMinutes - 07/19/2000 - City Council REGULAR MEETING JULY 19, 2000 A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, July 19, 2000 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director Public Works Batt, Director Parks and Recreation Merkel, Director Community Development Napolitano. Absent: Assistant Administrator Maxeiner. PRESENTATION BY STATE REP. JACK B. FRANKS OF MEMBER INITIATIVE FUNDS State of Illinois District 63 House Representative Jack Franks presented $353,000 in Member Initiative monies to the City of McHenry for the following programs: $128,000 McHenry Police Department Programs and/or Equipment $100,000 Project Zone Skatepark $100,000 City Athletic Field Development and Improvement $ 20,000 Senior Citizen Bus Program $ 5,000 McHenry DARE Program Mayor Cuda and Council thanked Representative Franks for his efforts and unfailing support. Motion by McClatchey, seconded by Glab, to pass a resolution recognizing and commending the Honorable Representative Jack Franks for his support in securing funds for the benefit and general welfare of the citizenry of the City of McHenry. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Mayor Cuda presented the resolution to Representative Franks. RECOGNITION AWARD PRESENTATION TO THE MCHENRY AREA JAYCEES ORGANIZATION Mayor Cuda acknowledged the efforts of the McHenry Area Jaycees Organization in raising funds to underwrite the City of McHenry's Annual Fourth of July Fireworks Display. He noted their endless hours of volunteerism and community involvement. Motion by Baird, seconded by Glab, to pass a resolution recognizing the McHenry Area Jaycees Organization for their efforts and contributions on behalf of the City of McHenry and specifically for procuring funds to underwrite the Annual McHenry Fireworks Display. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Mayor Cuda presented the resolution and commendation plaque to Carla Welsh, President of the McHenry Area Jaycees. AAIM AWARD PRESENTATION TO MCHENRY POLICE OFFICER MARY LEE ESCHBACH Chief of Police Kostecki informed Council the Alliance Against Intoxicated Motorists has recognized Officer Mary Lee Eschback for her exemplary record of driving-while- intoxicated enforcement during the calendar year 1999. Officer Eschbach removed twenty intoxicated motorists from the streets of McHenry. This accounted for over 20% of the department's activity in 1999. Chief of Police Kostecki presented Officer Eschbach with an award from the Alliance Against Intoxicated Motorists and an exemplary performance award from the City of McHenry Police Department. Page 2 7/19/00 Motion by Glab, seconded by Murgatroyd, to pass a resolution acknowledging the dedication and professional excellence of City of McHenry Police Department Officer Mary Lee Eschback for removing twenty intoxicated motorists from the streets of McHenry in 1999. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Mayor Cuda presented Officer Eschback with the resolution and thanked her for her efforts. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minute Public Input Session. PUBLIC HEARING: 2000-2001 ANNUAL APPROPRIATION ORDINANCE At 7:53 p.m. Mayor Cuda called to order the Public Hearing for the 2000-2001 Annual Appropriation Ordinance. Mayor Cuda informed Council as per State Statutes, the City must adopt an Appropriation Ordinance in the first quarter of the City's fiscal year. The Appropriation Ordinance provides the legal authority to allocate funds to specific spending activities and establishes the City's legal spending limit for the 2000-2001 Fiscal Year. Although the Appropriation Ordinance in the amount of $29,905,106 exceeds the City's anticipated spending levels, all foreseeable expenditures have been included. Staff noted the Appropriation Ordinance establishes the maximum level of expenditures which can be authorized only if adequate revenues are available. The City's 2000-2001 Operating Budget approved at the May 17, 2000 regularly scheduled Council Meeting, of $25,875,700 is a more accurate reflection of Council's anticipated expenditures. In response to Council inquiry, City Administrator Lobaito also noted the Appropriation Ordinance does include an overall 10% increase for gas and oil expenditures. He noted the significant increase in gas prices necessitated this action. In addition, the Capital Development Fund expenditure amount was increased to reflect the recent land purchase for the expansion of the Central Wastewater Treatment Plant. Mayor Cuda opened the floor to audience questions and/or comments. There were none. In response to Mayor Cuda's inquiry, City Clerk Althoff stated there were no written and/or verbal comments received in the Office of the City Clerk with regard to this Public Hearing. Motion by Glab, seconded by Murgatroyd, to close the Public Hearing at 8:00 p.m. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Motion by Murgatroyd, seconded by McClatchey, to pass an Appropriation Ordinance in the amount of$29,905,106 establishing the City of McHenry's legal spending limit for the 2000-2001 Fiscal Year. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. BLOCK PARK REQUEST FOR PEARL STREET REQUESTED BY JASON WHITT City Administrator Lobaito explained Staffs concerns regarding this particular Block Party request. He noted Pearl Street is one of two major thoroughfares across the Fox River. In addition, the request is for Sunday, July 23`d, which may conflict with the City- planned Fiesta Days Parade activity. A lengthy discussion followed. Motion by Baird, seconded by Bolger, to deny the Block Party request for Pearl Street by Jason Whitt of 3409 Pearl Street. Voting Aye: Bolger, Glab, Murgatroyd, Baird. Voting Nay: McClatchey. Absent: None. Motion carried. SEMI-ANNUAL DISTRIBUTION OF DEVELOPER DONATIONS TO CITY OF MCHENRY TAXING ENTITIES As outlined in the City's Subdivision Control Ordinance, Council must approve and direct the City Clerk's semi-annual disbursement of Developer Donation Fees to the following taxing districts: McHenry Elementary School District 15 McHenry High School District 156 McHenry Public Library District McHenry Township Fire Protection District. Page 8 7/19/00 Developer Donation Fees collected for the first half of 2000 are as follows: McHenry School District 156 $112,847.00 McHenry School District 15 $209,573.00 McHenry Public Library District $ 26,948.00 McHenry Township Fire Protection District $ 26,312.00 TOTAL $375,680.00. City Clerk Althoff also noted the City of McHenry's Park and Recreation Department received $223,641 in Developer Donation Fees for the same time period. Motion by Murgatroyd, seconded by Glab, to approve and direct the City Clerk's disbursement of Developer Donation Fees for the first half of 2000 as follows: McHenry School District 156 $112,847.00 McHenry School District 15 $209,573.00 McHenry Public Library District $ 26,948.00 McHenry Township Fire Protection District $ 26,312.00. CONDITIONAL USE PERMIT AMENDMENT - COMMUNITY SELF STORAGE, 4108 ORLEANS STREET Council at its regularly scheduled July 12, 2000 meeting directed Staff to draft an ordinance granting a conditional use amendment for a mini-warehouse facility at 4108 Orleans Street, subject to specified conditions. The drafted ordinance including the following conditions was presented for Council action: ■ The subject property shall be developed in substantial conformance with the latest site plan (prepared 7/28/99, last revised 3/28/00) and building elevations _ (dated 4/11/00); ■ Extensive landscaping approve by Staff shall be installed and maintained along Oak Drive and to the south of the proposed expansion area; ■ The condition of Ordinance 0-98-860 requiring landscaping along the eastern boundary of the property to provide screening from nearby residential properties shall remain in full force and effect. AMOCO SUBDIVISION REQUESTS: al ANNEXATION AGREEMENT AMENDMENT AND REQUEST FOR MAP AMENDMENT—AM_OCO CORPORATION, 5301 BULL VALLEY ROAD bl ZONING MAP AMENDMENT REQUEST — PEASE/LOOS, 5403 BULL VALLEY ROAD Property owners and Petitioners Jack Pease and Kathy Loos Shaw, and representatives from the Amoco Oil Corporation were in attendance. Council at its regularly scheduled June 7, 2000 meeting directed both Petitioners Jack Pease and Kathy Loos Shaw, as well as Amoco Oil Corporation representatives, to revisit the access to both Lots 1 and 2. The Amoco Property is a 4.965 acre parcel located at 5301 Bull Valley Road and consists of two lots. Lot 1 is the Amoco Service Station which is zoned C-1 Convenience Commercial with a Conditional Use Permit to allow the operation of a service station. Lot 2 is currently vacant and zoned RS-1 Residential, but is under contract to be purchased and improved with a condominium office building. Prior to the sale of Lot 2, Amoco is seeking resubdivision to increase the size of Lot 1 by a 30' strip along the west and south boundary of Lot 1. Amoco is requesting a zoning reclassification of the 30' strip and is requesting resubdivision of the property to incorporate the 30' strip into Lot 1 and remove it from Lot 2. Director of Community Development Napolitano noted the 30' strip was originally required by the terms of the Amoco Annexation Agreement to buffer the service station from the adjacent residentially zoned Lot 2. Inasmuch as Lot 2 is being reclassified to 0-1 Local Office Park for use as an office condominium complex, the 30' buffer is no longer needed between the two lots. The McHenry County Department of Transportation has agreed to the new Crystal Lake Road access subject to two conditions: ■ Submission of a revised site plan; and ■ Submission by Amoco Oil Corporation of a revised Final Plat of Subdivision. An Amoco representative addressed Council explaining Amoco Oil Corporation will permit the construction of the new Crystal Lake Road access in conjunction with the renovation of the existing Amoco Service Station. The new Crystal Lake Road access will be relocated further south. In response to Alderman Baird's inquiry regarding the timing of the Amoco Service Station renovation and Crystal Lake Road access relocation, Amoco representatives stated the renovation was dependent upon the level of sales growth. It is anticipated the renovation will occur within the next three years. Alderman Baird expressed reservations regarding the absence of a specified completion date for the new Crystal Lake Road cross- easement access. Page 10 7/19/00 City Administrator Lobaito explained as McHenry County Transportation Department will not permit the proposed office condominium development to construct its own access to Crystal Lake Road, a cross-access easement with the Amoco Service Station will permit the office condominium development to use the existing Crystal Lake Road access until such time as the Amoco Service Station is redeveloped and the new access point is designed. The future cross-access easement will require a written agreement to be recorded with the McHenry County Recorder of Deeds. Alderman Glab requested language addressing the building height restrictions be placed in the ordinance granting the zoning map amendment and amending the existing conditional use. Attorney McArdle suggested the motion granting the zoning map amendment include language referencing the site and architectural plans. Staff noted the amendment to the existing Annexation Agreement must be approved prior to the zoning map amendment. Some discussion followed regarding a specific date for the completion of the new cross-easement Crystal Lake Road access. Mr. Pease provided Council with a description of the proposed Bull Valley Road and Crystal Lake Road intersection improvements. Specifically, Bull Valley Road will be increased from two lanes to three lanes from the intersection west to the beginning of the Winding Creek Subdivision entrance at Brookwood Trail. Director of Community Development Napolitano noted as the proposed zoning map amendment would reclassify the adjacent property from RS-1 to 0-1, the amendment to the Amoco Oil Annexation Agreement approved by Council on August 2,1989, should eliminate all restrictions placed on the property to protect the adjacent residential district, specifically: ■ Car wash hours of operation; ■ Additional landscape screening requirements when commercial property is developed adjacent to residential zoning district. MCHENRY RIVERWALK PLANNER SELECTION Economic Development Commission Riverwalk Committee Vice Chairman Scott Smith was in attendance. Mr. Smith stated since the Riverwalk Committee's last appearance before Council at the May 31, 2000 regularly scheduled Council Meeting, the Riverwalk Committee developed Request for Proposals to assist with the initial planning and designing of the McHenry Riverwalk. The Request for Proposal was distributed to numerous professional planning and design consultants. Proposals were received from six planning and/or design consulting firms. Of the six proposals, members of the McHenry Economic Development Commission and Riverwalk Committee selected three firms that most completely agreed with the City and Economic Development Commission's vision of the Riverwalk. Members of McHenry City Staff and the Economic Development Commission interviewed representatives of the three firms. One firm, Hitchcock Design Group of Naperville, was selected for formal Council consideration and approval. In response to Council inquiry, Mr. Smith responded Hitchcock Design Group has been involved in the planning of more than ten comparable Riverwalks and waterfront projects, including Riverwalks in Naperville, Illinois; Batavia, Illinois; Aurora, Illinois; and Waukesha, Wisconsin. In response to Alderman Baird's inquiry regarding the services provided for a cost not-to-exceed $45,000, Mr. Smith enumerated the following scope of services: ■ Preparation of alternative schematic concepts, for the study area; • Identifying potential land uses, open space, parks, parking and traffic circulation; ■ Preparation of alternative schematic prototypes for public and private Riverwalk improvements, including walls, structures, landscaping, lighting, fencing, piers, etc. ■ Preparation of preliminary implementation strategies for the public Riverwalk improvements, including probable construction costs, funding opportunities, phasing potential, design engineering and permitting process; ■ Preparation of a final report including public Riverwalk improvements and implementation recommendations. City Administrator Lobaito noted copies of Hitchcock Design Group's full proposal are available in both his office as well as in the office of the City Clerk. Responding to Alderman Murgatroyd's inquiry, Mr. Smith stated submission of a finalized document is anticipated for October with fund raising efforts initiated in November, continuing throughout the 2000-2001 winter season. Mayor Cuda opened the floor to audience comment. Page 12 7/19/00 Andy Boss of 3415 Venice Court addressed Council requesting an explanation regarding the lack of notification to area residents about the proposed Riverwalk project. He expressed concerns regarding public access to the private properties located across the Fox River. Staff and Council responded the proposed scope of services from Hitchcock Design Group includes solicitation and comment participation by area residents. Mr. Chiappetta of 3409 Venice Court addressed Council stating the development of a Riverwalk along Boone Creek was an invasion of privacy to area residents. Michael Mathizus of 3411 Venice Court addressed Council stating he had concerns and reservations regarding the proposed Riverwalk Project. Pam Nolan of 3403 Venice Court addressed Council expressing concern regarding flooding, as well as restricted area boat traffic because of the proposed walking bridge construction. Some discussion followed. Motion by McClatchey, seconded by Baird, to accept the recommendation of the Economic Development Commission's Riverwalk Committee and approve and authorize the Mayor's execution of a Design Services Agreement to prepare the Phase 1 Planning and Design for the McHenry Riverwalk with Hitchcock Design Group of Naperville, Illinois, in an amount not-to-exceed $45,000. EDGEBROOK/ANNE STREET DRAINAGE WAY IMPROVEMENTS City engineering firm Baxter and Woodman representative Mark Kolczaski was in attendance. Director of Public Works Batt stated, as per Council direction, City engineering firm Baxter and Woodman investigated alternative storm sewer routes for the Edgebrook Drainage Way. Suggested improvements consist of a 45" X 73" arch pipe to transmit storm water from the existing waterway south and west of Edgebrook Elementary School to the McHenry Country Club Golf Course. Two alternative pipeline routes are suggested: ■ Alternate A involves construction of approximtely 1,000 lineal feet of storm sewer along Kane Avenue to the existing culverts under Green Street. This route begins at the upstream end of the existing storm sewer between Edgebrook Elementary School and McHenry Junior High School. This alternate would also include stabilization of the waterway banks at the existing pipe outfall near 719 North Green Street. Easements must be obtained from McHenry Elementary School District 15 and the owners of two lots just north of Kane Avenue on Green Street. The estimated cost of Alternate A is between $300,000 and $350,000. ■ Alternate B involves construction of approximately 1,400 lineal feet of storm sewer extending east to the golf course. This route would begin approximately 200' upstream of the inlet point for the existing storm sewer. Although preliminary investigation _ recommended an open waterway in the golf course rough, preliminary discussions with the McHenry Country Club Board revealed their desire for a pipeline along the edge of the golf course, instead of an open waterway. Easements would be required from McHenry Elementary School District 15, McHenry Country Club, and the owner of the vacant lot on East Green Street. The estimated cost of Alternate B is between $400,000 and $450,000. The advantages of Alternate B include: ■ Less traffic disruption; ■ Less interference with existing utilities; ■ Less disruption for McHenry Elementary School District 15; ■ Less need for easement acquisition. Page 13 7/19/00 The advantages of Alternate A include: • Less cost; ■ Less disruption to the golf course; ■ Less replacement of existing pipe. In response to Alderman Baird's inquiry, Staff explained conducting the smoke test will in no way release the City's obligation to initiate drainage way improvements for the Anne Street area. In response to Alderman Murgatroyd's inquiry, Staff noted monies have been included in the 2000-2001 Budget for these improvements. Some discussion followed. Alderman McClatchey left the meeting at 9:30 p.m, Staff also explained utilization of the existing storm sewer route was discarded, as the existing route is convoluted and ineffective. Permits from both the Illinois Department of Natural Resources and the United States Army Corps of Engineers will be required. It is Staffs recommendation to request a design engineering agreement proposal from City engineering firm Baxter and Woodman for Alternate A. Motion by Baird, seconded by Bolger, to select Alternate A involving the construction of approximately 1,000 lineal feet of storm sewer along Kane Avenue to existing culverts under Green Street at an estimated cost between $300,000 and $350,000, and to direct City engineering firm Baxter and Woodman to submit a Design Engineering Agreement Proposal for formal Council consideration and action. SOUTH WASTEWATER TREATMENT PLANT SCREENING MODIFICATION BID AWARD Director of Public Works Batt reported bid specifications were developed and sought for screening modification for the South Wastewater Treatment Plant to resolve existing overflow problems. Four bids were submitted and opened on Tuesday, July 11, 2000: ■ Advance Mechanical Contractors in the amount of $155,000 Racine, Wisconsin • Kovilic Construction Company in the amount of $167,512 Franklin Park, Illinois ■ Manusos General Contractors in the amount of $173,400 Fox Lake, Illinois ■ Bowen Engineering Corporation in the amount of $215,800 Crown Point, Indiana The low bidder was Advance Mechanical Contractors of Racine, Wisconsin in the amount of $155,000. The estimated project cost was $150,000 with the budgeted amount o$165,000. Staff is recommending Advance Mechanical Contractors of Racine, Wisconsin be awarded the Screen Modification Bid for the South Wastewater Treatment Plant. Director of Public Works Batt noted the required Bidder's Certification of Compliance with the State of Illinois Drug Free Workplace was not provided by any of the four bidders. The low bidder, Advance Mechanical Contractors of Racine, Wisconsin, did subsequently supply the certification upon request. Mayor Cuda also informed Council the McHenry County Municipal Association will be considering a revision of their Bylaws in addition to the hiring of an Executive Director at its monthly meeting on Wednesday, July 26 h. He has submitted a written response opposing the Association's proposal to develop an Executive Director position. He opined municipalities would in all likelihood pay a pro rats share of the Director's salary, benefits, and associated expenses. He will be attending the July 26"' meeting. Page 15 7/19/00 COMMITTEE REPORTS Public Works Committee Chairman Alderman Bolger reported he, City Attorney McArdle, and Director of Public Works Batt visited the Lakeland Park Subdivision in the vicinity of Willow and Oak, specifically Mr. Samuelson's property. Some assistance to alleviate area flooding can be accomplished with ongoing maintenance of culverts under Meadow Lane. Director of Public Works Batt will also be providing a swale design to City resident Diana Mantzoros in an effort to alleviate her flooding problem relating to area water main breaks. Director of Public Works Batt will also be providing Council with several options to consider to correct Mr. Samuelson's flooding problems. STAFF REPORTS Director of Community Development Napolitano reminded Council of the Special Meeting scheduled for Monday, July 24, 2000, to consider the McAndrews Farm Property Concept Plan. Director of Public Works Batt, referencing his memo of July 19th regarding the establishment and posting of speed limits policy, requested Council direction. Mayor Cuda suggested Council review the proposed policy for a time. Staff was directed to include the proposed policy on a future regularly scheduled Council Meeting Agenda. Director of Parks and Recreation Merkel reported the Fiesta Days activities were proceeding nicely. He also commended Staff for their efforts in assisting with the Twin Cities/Wisconsin/Chicago AIDS Ride. Director Merkel also informed Council the Marlins Swim Team will be hosting a divisional swim meet at Knox Park over the July 22"d -23`d weekend. Chief of Police Kostecki informed Council hearings were conducted for the four liquor establishments cited in the State's underage drinking sting. Each establishment received a monetary fine and agreed to attend the B.A.S.E.T.T. training. Chief of Police Kostecki also reported the Pro Life Action League conducted a 1 '/z hour protest on Route 120 as U.S. Route 31. The City of McHenry was one of 32 municipalities targeted for the demonstration over the past ten days. City Administrator Lobaito reported Staff is in receipt of formal notification from the Illinois Department of Transportation that Route 31 from Route 176 to Bull Valley Road has been slated for roadway improvements. These improvements will take place sometime between 2001 and 2005. The Illinois Department of Transportation is seeking preliminary information from the City of McHenry for planning purposes. The City of McHenry will subsequently be informed of any potential shared costs. City Administrator Lobaito also reported the proposed Intergovernmental Agreement with McHenry Elementary School District 15 regarding pre-annexation City services and conditions will not be pursued in light of the recent Diedrich Farm Property Annexation. Staff will pursue annexation of the School District property as it is now contiguous to the City. The original August completion date may be somewhat delayed. NEW BUSINESS Alderman Bolger reported the Illinois Department of Transportation has agreed to permitting the installation of a left turn lane near Valley View School from U. S. Route 120. All costs must be borne by the City of McHenry. Alderman Bolger suggested Council consider authorizing engineering expenses and request financial reimbursement from Representative Franks.
