AUGUST 16, 2000
A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda
at 7:30 P.M. on Wednesday, August 16, 2000 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey,
Murgatroyd. Alderman Baird arrived at 7:33 p.m. Absent: None. City Staff in attendance
were: City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki (arrived at 7:50
p.m.), Assistant Director Public Works Marcinko, Director Parks and Recreation Merkel,
Planner Maggio, Assistant Administrator Maxeiner. Absent: City Administrator Lobaito.
TEN MINUTE PUBLIC INPUT SESSION
Ron Samuelson of 4903 Willow Lane addressed Council requesting an update on
and/or a projected date of resolution for the flooding problems he experiences on his
property at 4903 Willow Lane. Director of Public Works Batt stated the dredging of the
Meadow Lane ditch was scheduled for the week of August 21s.
Alderman Baird arrived at 7:33 p.m.
Mayor Cuda instructed Director Batt to stay in contact with Mr. Samuelson informing
him of all planned activities and results.
Alderman McClatchey informed Council he had spoken with State Representative
Franks regarding obtaining member initiative funds to complete the entire dredging project.
CONSENT AGENDA
Citing dissatisfaction with the Riverstream Drive and Judy Lane micro sealing,
Alderman Bolger requested the payment to Curran Contracting be removed from the List of
Bills to be approved for payment. Some discussion followed.
In response to Mayor Cuda's inquiry regarding the 2000 Streets Program, Staff
confirmed parking spaces located along the right-of-way were removed to facilitate the
'— installation of curb and gutter. Mayor Cuda directed Staff to make a greater effort to notify
affected home and property owners of the removal of these illegal parking spaces.
Alderman McClatchey noted he too had received numerous complaints regarding
the Streets Program work and landscape replacement.
Director of Public Works Batt suggested retaining an additional $25,000 until
Council was completely satisfied with the Streets Program work being completed by
Curran Contracting. Director Batt also noted next year's Streets Program will be designed
to require separate contracts for the concrete and asphalt work. This procedural revision
will require both contractors to meet the Illinois Department of Transportation's
specifications and qualifications.
Motion by Bolger, seconded by Baird, to approve the Consent Agenda subject to the
condition an additional $25,000 be withheld from Curran Contracting Inc. of Crystal Lake,
Illinois, until all terms of the 2000 Streets Program contract are met to the satisfaction of
Council.

Liquor License and waiver of all associated fees;

Trustees for September 28th Board Meeting;

CLASS F(2) LIQUOR LICENSE APPROVAL - LAROSITA GROCERY STORE, 4605
WEST ELM STREET
Class F(2) Liquor License Applicants Laura and Sergio Perez were in attendance.
Mayor Cuda informed Council Mr. and Mrs. Perez are the current owners of LaRosita
Grocery Store located at 4605 West Elm Street and have submitted an application for a
Class F(2) Liquor License for the retail sale of packaged alcoholic beverages. A Class F(2)
Liquor License permits the sale of alcoholic beverages in packages only and for
consumption off-premises, where 50% or more of the public sales area of the premises is
devoted to goods and commodities other than alcohol. Mr. and Mr. Perez met with Mayor
Cuda on June 28, 2000 and have submitted all the necessary paperwork, including the
$800 license fee. Mr. Perez has been fingerprinted and a satisfactory result has been
received.
Mayor Cuda also noted the liquor license approval is conditioned upon an English-
speaking employee being on the premises at all times when the store is open. Mayor Cuda ._..
requested this condition to facilitate store enforcement of the City's regulations relating to
the sale of alcoholic beverages to minors. Mr. and Mrs. Perez have agreed to the
condition. Some discussion followed.
In response to Alderman McClatchey's inquiry, Mr. and Mr. Perez noted ownership
of a second store located in Crystal Lake. The Crystal Lake Police Department on only one
occasion cited this establishment. Mayor Cuda noted he and Staff had thoroughly
investigated this infraction, and were recommending Council approve the issuance of a
Class F(2) Liquor License to Perez and Rivera Inc, d/b/a LaRosita Grocery Store.
Motion by Baird, seconded by Bolger, to approve the issuance of a Class F(2)
Liquor License to Perez and Rivera Inc, d/b/a LaRosita Grocery Store at 4605 West Elm
Street, subject to the condition an English-speaking employee must be on the premises at
all times when the store is open; and to pass an ordinance increasing the number of F(2)
Liquor Licenses from six (6) to seven (7).
Voting Aye: Bolger, Glab, Murgatroyd, Baird.

Chief of Police Kostecki arrived at 7:50 p.m.
SIGN VARIANCE REQUEST —WHITE HEN EXPRESS, 508 SOUTH ROUTE 31
Property owners John and Rosemary Swierk were in attendance. Staff explained,
subsequent to the inspection and issuance of an installation permit, the freestanding
"White Hen Express" sign was installed with a 3.6' setback from Route 31 as opposed to
the City of McHenry ordinance requirement of 5'. The sign installation firm explained they
misunderstood the City's setback requirement, measuring from the sign panel, as opposed
to the sign structure. Staff explained the setback violation was not discovered until after
the sign was installed. Removal and relocation of the sign would be difficult as the sign is
installed with concrete masonry piers. Ms. Swierk is requesting a setback variance for the
freestanding sign.

Motion by Bolger, seconded by McClatchey, to grant a 1.4' setback variance to LK
Properties to allow the installation of a freestanding sign with a setback of 3.6', at 508
South Route 31.

REQUEST TO ADVERTISE FOR BID - KNOX PARK AND FREUND FIELD
PLAYGROUND EQUIPMENT
Director of Parks and Recreation Merkel introduced Landscape Architect Todd King.
Director Merkel reported the 2000-2001 Budget includes line items for the purchase of
playground units to be installed at both Knox Park and Freund Field. Todd King addressed
Council presenting the plans and playground unit specifications he developed for both
Knox Park and Freund Field. Mr. King explained the Knox Park playground units will be
installed west of the Knox Park Swimming Pool. An asphalt walkway from the swimming
pool to the playground units has been included in the specifications. Freund Field
playground equipment will be installed and constructed in the northeast corner of the park.
Mr. King then presented the Freund Field Master Plan. He noted, after further discussion
with Staff and area residents, the ballfield site may be relocated. Director Merkel noted the
bid specifications as developed meet all ADA guidelines and follow all safety standards.
He also noted the ground cover as specified is a resilient material which facilitates better
drainage.
In response to Alderman McClatchey's inquiry, Director Merkel citing winter
construction, stated the anticipated completion date for both projects is May, 2001.
Responding to Alderman Murgatroyd's inquiry, Mr. King noted the difference in cost
estimates was due in most part to a five-month separation in bid preparation.
Motion by Glab, seconded by Baird, to authorize Staff to advertise for bid the
construction of playground units at Knox Park and Freund Field.

REQUEST TO ADVERTISE FOR BID - MCHENRY ZONE SKATEPARK
Director of Parks and Recreation Merkel reported Thompson Dyke and Associates
have completed the plan and bid specifications for the McHenry Zone Skatepark. Bids will
be advertised locally as well as submitted to the bidders list supplied by Thompson Dyke
and Associates. The deadline for bid submission is Wednesday, August 30, 2000 with the
bid opening scheduled for 11 a.m. Bid results will be presented to Council at the regularly
scheduled September 6, 2000 meeting. Director Merkel also stated the volunteer fund
raising committee will present at the September 6, 2000 regularly schedule meeting a
status update regarding their efforts to obtain funds and donated materials. Director Merkel
distributed a list of material contributions.
In response to Council inquiry, Director Merkel noted:
■ Approximately $163,000 in monetary contributions have been pledged;
■ The project has been phased with bid options to accommodate potential
financial constraints;
• The bid specifications are only for the concrete skatepark, although a local
contractor has pledged excavation services for the BMX track;
■ The projected cost estimate with no material donations is approximately
$270,000.

Alderman Baird requested Council receive detailed information regarding the status
of materials and money collected, as well as bid options, prior to award of the skatepark
bid.

AUTHORIZATION TO UTILIZE NORTH CENTRAL NARCOTICS TASK FORCE FUNDS
Chief of Police Kostecki informed Council the City of McHenry in 1999 received
reimbursement expenses in the amount of $6,000 from the North Central Narcotics Task
Force (NCNTF) for personal costs associated with the City of McHenry's officer assigned
to the Narcotics Task Force Unit. These funds are provided through a grant administered
by the NCNTF. In 1999 these funds were utilized to purchase Police Equipment that had
not been included in the 1999-2000 Budget. Chief of Police Kostecki noted the City again
has received reimbursement monies in the amount of $6,000. Chief of Police Kostecki
requested Council approve the use of these funds to purchase a laptop computer for the
Police Officer assigned to the NCNTF Unit. The officer assigned to NCNTF finds it
necessary to travel to McHenry in order to prepare criminal complaints, search warrants,
perform computer inquiries, and file reports. The necessary equipment is unavailable at
the NCNTF offices. The laptop computer can also be used to access law enforcement
databases while in the field. Chief Kostecki noted the total purchase price of a laptop
computer with associated attachments is $6,408.93. He proposed utilizing a $450 savings
from the purchase of Nextel equipment to fund the purchase shortfall.
Motion by McClatchey, seconded by Bolger, to authorize Staff to purchase a laptop
computer and associated attachments, utilizing reimbursement funds from the North
Central Narcotics Task Force in an amount not to exceed $6,409.

MAIN STREET REVITALIZATION BID AWARD
Director of Public Works Batt reported bid specifications were developed and
submittals sought for the Main Street Revitalization Project. Two bids were submitted and
opened on Tuesday, August 8, 2000. The estimated project cost and budget amount for
this project is $165,000, which includes drainage improvements estimated at $15,000.
Option A, bid separately, consists of the planting of six trees and installation of tree grates
along Main Street. The following bids were submitted:

$16,000 for construction supervision services could be incurred. Council has also
previously approved the expenditure of $35,272.60 for the purchase of new streetlights.
Total construction costs for the completed Main Street Revitalization Project could exceed
$223,000. Some discussion followed.
In response to Alderman McClatchey's inquiry, Director Batt noted Main Street will
be resurfaced as part of the 2001 Streets Program.

�.- AWARD OF CONTRACT FOR WELL#11 — MOSELE AND ASSOCIATES
Director of Public Works Batt reported bids were developed and submittals sought
on May 23, 2000 for the construction of Well #11 located within Adams Commercial
Center. The sole bidder was Mosele and Associates of Ingleside, Illinois. Council, at Staffs
recommendation, rejected this sole bid. Council authorized Staff to proceed with the
project, purchasing materials and elements, and hiring well and electrical contractors.
Project costs were obtained totaling $89,000, excluding City Staff labor costs. In recent
discussions with Mosele and Associates representatives, Mosele has agreed to construct
and install Well #11 at their original bid price. Staff is recommending Council approve a
contract services agreement with Mosele and Associates of Ingleside, Illinois to construct
and install Well #11 within Adams Commercial Center in an amount not-to-exceed
$92,104.
In response to Council inquiry, Director of Public Works Batt noted Mosele and
Associates in the past have satisfactorily completed numerous City projects. In response to
Alderman Murgatroyd's inquiry, Director Batt noted the project cost was originally
estimated at $70,000.

authorize the execution of a contract services agreement between the City of McHenry and
Mosele and Associates of Ingleside, Illinois, to construct and install Well #11 within Adams
Commercial Center in an amount not-to-exceed $92,104.

DISCUSSION: REFERENDUM QUESTION FOR RECREATION CENTER
Assistant Administrator Maxeiner stated, as per Council direction at the July 12,
2000 regularly scheduled Council Meeting, Staff drafted a simple advisory referendum
question regarding the construction of a recreation facility. The following language was
presented for Council consideration:
"Shall the City of McHenry construct and operate a community recreation center —
which would include a gymnasium, fitness center, indoor lap pool, activity rooms,
racquetball courts, and preschool/toddler care rooms — to address the recreational
programming needs of the residents of the City of McHenry?"
Mayor Cuda informed Council he had directed City Attorney McArdle to investigate
the State Statute requirements regarding recreation center referenda in response to
concerns expressed by Bond Counsel Kelly Kost of Chapman and Cutler. Bond Counsel
Kost has opined, as per State Statute 5/11-95-1, in order to use general fund monies for
the acquisition, conduct, equipment or maintenance of a recreation center, authority from
the electorate must be obtained. Attorney McArdle stated further investigation and
research was warranted.
Alderman McClatchey suggested the pending North Route 31 commercial
development sales tax revenue be earmarked for the recreational facility construction and
operation. Attorney McArdle notes sales tax revenue is considered general fund monies,
which still might necessitate a referendum question.

Alderman Glab suggested Special Council Meetings devoted to development issues
be scheduled. He also opined any additional sales tax revenue from new commercial
development would be needed for future infrastructure improvements. Some discussion
followed.

referendum question as per the request of High School District 156, until further research
regarding the need for electorate authority can be determined.

indefinite postponement of the recreational facility question. He requested Council

Consolidated Election.

MAYOR STATEMENT AND REPORTS
Mayor Cuda reported he and City Administrator Lobaito had met with
representatives from Metra, including Rick Mack, to discuss the relocation and renovation
of the Main Street Metra Station. He noted both of the Pacini Properties, the one located at
the northwest corner of the intersection of Route 31 and Bull Valley Road, as well as the
one located west of Route 31, south of the McHenry Corporate Center, had been
discussed as possible future sites. The Pacinis have expressed interest in donating
property for the relocation of a Metra Station; however, the City has had no recent
conversations with the Pacinis regarding this matter.
Mayor Cuda also noted Council will review the Department Head evaluations at the
next regularly scheduled Council Meeting on August 30, 2000, during Executive Session.
COMMITTEE REPORTS

STAFF REPORTS
Director of Community Development Napolitano reported the structure located at
the northeast corner of the intersection of Route 31 and Main Street experienced a
significant fire damage this afternoon. The building contained thirteen apartment units and
has been declared uninhabitable. The cause of the fire has yet to be determined and may
have been electrical in nature. No injuries were sustained. A full report will be provided in
Friday's Agenda Packet. Director of Community Development Napolitano also reported the
Riverwalk Committee would be meeting with representatives of the Hitchcock Design
Group to begin the development of a conceptual plan. A workshop has been tentatively
scheduled for Tuesday, August 29, 2000 at 7:30 p.m. Representatives of the Hitchcock
Design Group will be meeting with community representatives to obtain further input
regarding Riverwalk design, aesthetics, and standards.
Director of Public Works Batt reported Devonshire Court residents requesting the
City of McHenry again consider accepting Devonshire Court as a City street had contacted
his offices. These residents have offered to work with the City ensuring Devonshire Court
meets City standards prior to acceptance. Director Batt will investigate the offer further,
and stated his intent to report back to Council.

Director of Parks and Recreation Merkel reported landscaping work will begin at
Neumann Park on Green Street tomorrow, August 17, 2000. Completion is anticipated
within three weeks. Director Merkel also reported the Union Pacific HandCar Races which
benefit "For the Children" are scheduled for Sunday, August 20, 2000 at Petersen Park.
The Brake Parts Employee Appreciation Picnic is scheduled for Saturday, August 19, 2000
at Petersen Park. In conclusion, Director Merkel reported meetings have been set with the
ball leagues to discuss and determine the fall ballfield schedule.
Chief of Police Kostecki reported, in conjunction with the fire experienced at the
structure on Main Street and Route 31, Front Street was closed between 11:30 a.m. and
3:00 p.m. today. He also reported that Route 120 east of the Fox River was closed on
Friday, due to a gas main break. Chief Kostecki also reported the City of McHenry's Police
Department had participated in the state Click-it or Ticket Program, whose purpose was to
increase the use of seatbelts. All participants were entered into a drawing. The City of
McHenry was selected to win an in-car video camera. The camera was delivered yesterday
and will be installed next week.
City Attorney McArdle reported the Horizon Pipeline Project no longer is a concern
to the City of McHenry as its terminus has been designed north of the City's corporate
limits.
Assistant Administrator Maxeiner referenced his memo, which was distributed just
prior to this evening's regularly scheduled Council Meeting. He explained he and Assistant
Director of Public Works Marcinko had met with Illinois Department of Transportation
representatives regarding the Street Improvements Program and the issuance of Motor
Fuel Tax Bonds to finance these improvements. Staff was informed a Resolution of Intent
must be filed with the State prior to the issuance of Motor Fuel Tax Bonds. Assistant
Administrator Maxeiner presented a Resolution of Intent for formal Council action.
Motion by McClatchey, seconded by Murgatroyd, to pass a Resolution of Intent to
initiate a Streets Improvement Program of approximately 168,960 feet to be financed with
the proceeds of a Motor Fuel Tax Fund Bond issue in the amount of$4.2 million.

City Clerk Althoff reminded Council of the Parkland School Re-Dedication
scheduled for Sunday, August 20, 2000 at 1:30 p.m. She also reported the McHenry

August 23, 2000 at Chapel Hill and is being hosted by adjacent municipality, the Village of
McCullom Lake. Anyone interested in attending should contact the City Clerk prior to
Friday, August 181' at 5:00 p.m.
NEW BUSINESS
Alderman Bolger reported the Green Street Restriping Project is scheduled for the
week of August 21st, probably Wednesday or Thursday. Staff noted all affected Green
Street properly owners have been notified.
In response to Alderman Glab's inquiry regarding the completion of the Wiltshire
Drive water service line replacement, Staff stated a complete project update will be
provided in the Friday Report.
In response to Alderman Glab's inquiry regarding the meeting between Mayor
Cuda, Alderman Bolger and representatives from McHenry High School District 156
regarding the Shamrock Farm Development Concept Plan Proposal, Mayor Cuda reported
a meeting had not yet been scheduled. Staff also informed Alderman Glab the Crystal
Lake Road Study will be brought before Council at the first regularly scheduled Council
Meeting in September.
