AUGUST 30, 2000
A Regular Meeting of the McHenry City Council was called to order by Mayor Cuda
at 7:30 P.M. on Wednesday, August 30, 2000 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey,
Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito,
City Clerk Althoff, City Attorney McArdle, Chief of Police Kostecki, Director Public Works
Batt, Director Community Development Napolitano, Assistant Administrator Maxeiner.
Absent: Director Parks and Recreation Merkel.
TEN MINUTE PUBLIC INPUT SESSION
Tim Rouletta of 110 North Creekside Trail addressed Council requesting a stop sign
be installed at the intersection of Creekside Trail and Greenbrier Drive. Mr. Rouletta also
submitted a Petition signed by area residents supporting his request.
Alderman Baird suggested Mr. Rouletta's request be addressed at a Public Works
Committee Meeting. It was the consensus of Council to address Mr. Rouletta's request at
the next Public Works Committee Meeting and to invite Mr. Rouletta to attend.
PUBLIC HEARING: ANNEXATION, MAP AMENDMENT AND USE VARIANCE —
KENNETH EHREDT, 3310 BULL VALLEY ROAD
Mayor Cuda called the Public Hearing on the Ehredt Annexation, Map Amendment,
and Use Variance for the property located at 3310 Bull Valley Road to order at 7:33 p.m.
Marvin Keys, attorney for Petitioner Kenneth Ehredt, was in attendance.
Attorney Keys of Diamond, LeSueur and Associates informed Council the Petitioner
is requesting:
■ Annexation of 1.5 acres of property located at 3310 Bull Valley Road;
■ A map amendment to RS-1 Low Density Single Family Residential upon annexation;
■ A use variance to permit the continued operation of an underground utility installation
business on the subject premises for a three year period.
He noted the property is currently located in unincorporated McHenry County and zoned
A-1 Agricultural. The property is improved with a single family residence, garage and
metal pole barn.
Mr. Keys also noted appearance concerns raised by adjacent property owner
Windsor Development Corporation have been addressed. Appropriate landscape
screening, appearance guidelines, and a reduction from five to a three-year limitation on
the use variance have been agreed to by the Petitioner.
In response to Alderman Glab's inquiry, Attorney Keys stated the property would
continue to be used as a residence, as well as the base of operations for Mr. Ehredt's
underground utility installation operation. The Petitioner has also agreed to limiting outside
storage to specified equipment and vehicle types. Some discussion followed.
Attorney Keys agreed to better landscape screening along Bull Valley Road, in
response to Alderman Baird's request.
In response to Alderman Glab's inquiry, Attorney Keys noted an RS-2 Zoning Map
Amendment was not requested as the property has slightly less than 200 feet of frontage
on Bull Valley Road and could not be subdivided into two lots. A minimum lot frontage of
100 feet is required in the RS-2 Zoning District. In addition, the adjacent 3.5-acre parcel to
the east is owned by a relative and may be combined with Mr. Ehredt's parcel to permit a
future residential subdivision.
Mayor Cuda opened the Hearing to audience comment and/or questions. There
were none. In response to Mayor Cuda's inquiry, City Clerk Althoff stated there had been
no written or verbal comments received in the City Clerk's Office regarding the Ehredt
Petition for annexation, map amendment and use variance.

Motion by Glab, seconded by Bolger, to close the Public Hearing at 7:42 p.m.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Bolger, seconded by Baird, to accept the unanimous recommendation of
the Zoning Board of Appeals, and to direct Staff to prepare the required annexation,
annexation agreement, zoning reclassification, and use variance ordinances for a zoning
map amendment to RS-1 upon annexation of a 1.5 acre parcel located at 3310 Bull Valley
Road.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.

REQUEST FOR SPECIAL USE PERMIT FOR VETERANS PARK - BILL SIZEMORE
The applicant, Bill Sizemore, was in attendance. Mr. Sizemore addressed Council
requesting use of the Veterans Park Gazebo on Sunday, September 10, 2000 for a free
concert program between the hours of 3:00 p.m. and 7:00 p.m. and the waiving of all
associated park rental fees. The gazebo would be utilized for a Christian Concert. No food
or beverages would be sold or supplied.
In response to Alderman Glab's inquiry, Mr. Sizemore noted access to the Gazebo
will be required approximately two hours before the event at 1:00 p.m.
Alderman Murgatroyd noted the Holy Apostles Fall Fest is being held on September
71h, 8 ,91h , 2000 and may produce potential competition.
Motion by McClatchey, seconded by Glab, to approve the request of Bill Sizemore
for use of Veterans Park Gazebo for a free Christian Music Concert on Sunday, September
10, 2000 between the hours of 1:00 p.m. and 7:00 p.m., and to waive all associated park
rental fees.
Voting Aye: Bolger, Glab, McClatchey, Baird.

REPORT: UPDATE ON McCULLOM LAKE SANITARY SEWER PROJECT
Village of McCullom Lake Trustee and Utility Committee Chairman Doug Youmans
was in attendance. Trustee Youmans reminded Council plans were progressing for the
Village of McCullom Lake to extend the City of McHenry Sanitary Sewer System to service
residents of the Village of McCullom Lake. Mr. Youmans reported the feasibility study has
been completed. A Community Development Block Grant was awarded the Village to
monitor the City of McHenry's sanitary sewer system and develop a Facility Plan for the
Village of McCullom Lake. It is anticipated the Facility Plan will be completed within the
next four weeks. Subsequently, partnership talks with City of McHenry representatives will
be resumed. The Village of McCullom Lake Board would like to present the completed
sanitary sewer service plan to village residents prior to the end of the 2000 calendar year.
Some discussion followed.
In response to Alderman Bolger's inquiry, Trustee Youmans stated a majority of
residents supported the sanitary sewer service proposal. In addition, the Village of
McCullom Lake was ranked fourth in need for sanitary sewer services by the Illinois
Environmental Protection Agency.
Mayor Cuda and Council thanked Trustee Youmans for his report. Mayor Cuda
noted additional information will be sent to the Public Works Committee for consideration
and recommendation to full Council.

REQUEST FOR FENCE VARIATION TO CORNER SIDE YARD — 4319 CRESTWOOD
DRIVE
Petitioner Janet Cherrette of 4319 Crestwood Drive was in attendance. Ms.
Cherrette is requesting a fence variance to permit the installation of a four-foot high chain
link fence in the corner side yard of her lot located at 4319 Crestwood Drive. The proposed
fence would be located along Lillian Street with a setback of two feet from the property
line, starting at the rear of the residence. Current City of McHenry ordinance requires a
residential fence be at least fifteen feet from the corner side lot line. Ms. Cherrette
explained a large Hickory tree is located in the back yard of her property along Lillian
-- Street. Passersby are tossing trash into the yard, specifically, into the trunk divisions of the
tree. Ms. Cherrette opined the installation of a fence would eliminate and/or reduce the
trash problem. In addition, the installation of a fence would provide containment for her
dog. Ms. Cherrette has agreed to install trees and bushes along the fence line to improve
its appearance.
Staff noted similar chain link fences exist both at 4319 and 4501 Crystal Lake Road.
The abutting property, 4320 South Street, also contains a four-foot picket fence along the
corner side yard.
Ms. Cherrette noted the proposed fence will be installed along only one-half of the
Lillian Street corner sideyard.
Motion by Glab, seconded by Bolger, to grant the request for a four foot high chain
link fence in the corner sideyard setback of the property located at 4319 Crestwood Drive,
no closer than the adjacent neighboring fence along the Lillian Street property line.

REQUEST FOR CONDITIONAL USE PERMIT — CULVERS RESTAURANT, 1101
ADAMS DRIVE
Petitioner Rich Adams and his attorney, Mark Saladin of Militello, Zanck and Coen,
were in attendance. Attorney Saladin stated Petitioners Mr. and Mrs. Richard Adams are
requesting a conditional use to permit the construction and operation of a Culvers
Restaurant with a drive-through facility on the property located at 1101 Adams Drive in the
Adams Business Park. Staff noted the property is approximately 1.25 acres in size and has
230 feet of frontage along State Route 120. Access to the site is through a shared
driveway along the north property line. This private driveway will serve as access for all
lots within the Adams Business Park with frontage along State Route 120. Direct access
from State Route 120 will be prohibited. Staff noted the proposed site plan is in

spaces for the drive-through facility. Staff also noted the Petitioners appeared before the
Zoning Board of Appeals on August 21, 2000 and received a unanimous recommendation
for approval of the conditional use.

recommendation of the Zoning Board of Appeals and to pass an ordinance granting a
conditional use to permit the construction and operation of a restaurant with a drive-

classifications. Council directed Staff to investigate and explore the development of an

zoning classifications.
REQUEST FOR MAP AMENDMENT AND CONDITIONAL USE PERMIT — TOOL LAND,
2350 W. ROUTE 120
Petitioner David Zickus and his attorney Kenneth Clark were in attendance.
Attorney Clark stated Petitioners Mr. and Mrs. David Zickus are requesting a map
amendment to C5 Highway Commercial Zoning with a conditional use permit to allow the
operation of outside storage and sale of landscape materials and seasonal products,
subject to the following conditions, as specified by the Zoning Board of Appeals:
1. All outdoor storage shall be contained within the 40' X 80' area at the northwest
corner of the paved parking area, as depicted on the site plan;
2. Outdoor storage shall be limited to:
a. Agricultural products, including pumpkins, gourds, cornstalks, Christmas
trees, wreaths, and garland; and
b. Earth products, all of which shall be contained in bags or on pallets, including
gravel, dirt, rocks, rock salt, decorative stone, fertilizer, grass seed, weed
control products, firewood, plants and trees;
3. Arbor Vitae (or similar landscaping material), 5 feet in height, shall be planted
and maintained along the north edge of the outdoor storage area;
4. A light standard shall be installed at the southeast corner of the outdoor storage
area.
The subject property is located on the north side of State Route 120, 300 feet east
of Hillside Lane with an address of 2350 West Route 120. The property is approximately
one acre, has 150 feet of frontage on State Route 120, and is currently zoned E Estate.
The Petitioners appeared before the Zoning Board of Appeals on August 7, 2000. The
Zoning Board of Appeals unanimously recommended approval of the requested rezoning
and conditional use permit with the previously stated four conditions. The Petitioners are
requesting an amendment to condition #4, requiring a light standard be installed at the
southeast corner of the outdoor storage area. Mr. Clark suggested the four existing lights
located on the commercial structure provide adequate illumination.
In response to Alderman Baird's suggestion to install a pole light on the western
perimeter of the outside storage area, Mr. Clark responded the suggested alternative was
cost prohibitive. He cited the expense of digging up and replacing the existing parking lot.
Some discussion followed.
Motion by Bolger, to accept the unanimous recommendation of the Zoning Board of
Appeals and grant the Petitioners' request for a map amendment to C5 Highway
Commercial Zoning and grant a conditional use permit to allow outside storage and retail
sales of landscape and seasonal materials, subject to the following conditions, citing
financial hardship to the Petitioners:
1. All outdoor storage shall be contained within the 40' X 80' area at the northwest
corner of the paved parking area, as depicted on the site plan;
2. Outdoor storage shall be limited to:
a. Agricultural products, including pumpkins, gourds, cornstalks, Christmas
trees, wreaths, and garland; and ._.
b. Earth products, all of which shall be contained in bags or on pallets, including
gravel, dirt, rocks, rock salt, decorative stone, fertilizer, grass seed, weed
control products, firewood, plants and trees;
3. Arbor Vitae (or similar landscaping material), 5 feet in height, shall be planted

MAYOR STATEMENT AND REPORTS
Mayor Cuda reported the graduation of Jason Glaw created a student vacancy on
the Human Relations Commission. Human Relations Commission Chairman Patricia
Buhrman interviewed two potential candidates for the West Campus student vacancy.
Mayor Cuda is recommending the appointment of Aubrey Coursin as the new Human
Relations Commission West Campus student representative.
Motion by McClatchey, seconded by Glab, to approve the mayoral appointment of
Aubrey Coursin to the Human Relations Commission as the West Campus student
representative.

Mayor Cuda also reported he, City Administrator Lobaito, and Alderman Bolger, met
with McHenry High School District 156 representatives on August 24t' regarding the
Shamrock Farm Development. A subsequent meeting including Shamrock Farm
Development representatives has been scheduled for Thursday, August 31'. Council will
be kept apprised of all developments.
Mayor Cuda informed Council State Representative Franks has pledged $500,000
toward the McHenry Riverwalk Project, subsequent to a monetary match by the City of
McHenry.
Director of Community Development Napolitano then noted he would also be
pursuing grant monies for the McHenry Riverwalk Project. Council approval to proceed
with the grant application will be sought under the Department Head Report portion of this
evening's regularly scheduled Council meeting.
COMMITTEE REPORTS
Parks and Recreation Committee Chairman Alderman Baird scheduled a Parks and
Recreation Committee Meeting for Tuesday, September 12, 2000 at 7:00 p.m. Alderman
Glab requested development of the Petersen Park Waterfront Plan be included as an
Agenda item.

DEPARTMENT HEAD REPORTS
As previously reported, Director of Community Development Napolitano informed
Council the Illinois Tomorrow Grant Program administered by the Illinois Department of
Transportation is designed to assist local governments in developing land use and
infrastructure plans, promoting the efficient use of transportation facilities, and enhancing
the quality of life. Project funding is a 90/10 percentage split with the local government
expected to provide the 10% funding match. The grant must be submitted by September
13'. Director Napolitano also reported Council-approved Riverwalk design planners
Hitchcock Design Group conducted a planning workshop on Tuesday evening, August
29t'. Civic leaders, elected officials, and affected property owners were invited. Director
Napolitano reported the workshop was well attended. A brief discussion followed.

Director of Public Works Batt reported Curran Contracting of Crystal Lake, Illinois
has agreed to redo the Riverstream Drive and Judy Lane micro sealing. Director Batt
reminded Council formal action at the regularly scheduled August 16, 2000 meeting
authorized an additional $25,000 be withheld from Curran Contracting until all terms of the
2000 Streets Program contract are met to the satisfaction of Council. Director Batt also
noted the micro sealing work was not included in the prior payout request by Curran
Contracting approved by Council at the August 16, 2000 regularly scheduled meeting. The
micro sealing will not be submitted and/or approved for payment until Council is satisfied
with the micro sealing work.
Chief of Police Kostecki reported the City of McHenry Police Department will be in
receipt of a third squad car video camera as part of the Driving Under the Influence Grant
Award whose submission was previously approved by Council at the April 19, 2000
regularly scheduled Council meeting.
City Administrator Lobaito reported McHenry homes tested by Nicor for mercury
contamination were found to be clear of any mercury contamination. In addition, identified
homes with McHenry addresses were located outside the City of McHenry's corporate
boundaries.
City Administrator Lobaito reported the annexation of Hilltop School was moving
forward. The Adams Property Recapture figures must yet be determined.
City Administrator Lobaito also reported the skatepark bid opening scheduled for
today, August 301h , was postponed to September 12, 2000. City Administrator Lobaito
explained skatepark design architects Thompson Dyke and Associates were notified by
two significant contractors their submitted bids for the skatepark project would be high.
Each contractor cited busy fall schedule and the necessity to hire additional staff. City
Administrator Lobaito suggested Council consider postponing bid submittals until Spring —.
2001. Some discussion followed.
Alderman Bolger expressed concern regarding potential time limitations for the
expenditure of the $100,000 Member Initiative monies from State Representative Franks.
Alderman Baird requested additional information regarding fund raising efforts and
pledges be provided Council in Friday's Agenda Packet. It was the consensus of Council
to go forward with the submission and opening of bids on Tuesday, September, 12, 2000.
Bid results will be reviewed and addressed by the Parks and Recreations Committee at its
September 12, 2000 meeting.

City Clerk Althoff reminded Council of the White Hen Express Grand Opening
scheduled for tomorrow August 31, 2000 at 4:30 p.m. She also noted the McHenry
Municipal Center will be closed for the Labor Day Holiday on September 4tn
NEW BUSINESS
Alderman Bolger noted a potential conflict with the scheduled Shamrock Farm
Meeting and the White Hen Grand Opening.
Alderman Baird requested additional police patrols be conducted in the area of
Huntington Drive and Winding Creek Drive.
Public Works Committee Chairman Alderman Bolger scheduled a Public Works
Committee Meeting for September 20, 2000 at 6:30 p.m. to discuss Mr. Rouletta's request
for City installation of a stop sign at the intersection of Creekside Trail and Greenbrier
Drive.
In response to Alderman Glab's inquiry, City Administrator Lobaito noted the 2000-
2001 Budget included monies for the Crystal Lake Road and Royal Drive intersection
engineering. City Administrator Lobaito explained prior Council action had delayed
consideration of the Royal Drive and Crystal Lake Road engineering until Planning
Resources of Wheaton, Illinois, submitted their Crystal Lake Road Planning Study for
Council review. The Crystal Lake Road Planning Study will be presented to Council for
consideration during the month of October, 2000. Alderman Glab also reported PACE
Suburban Bus Service has begun site work at their lot in McHenry Corporate Center,
eliminating the possibility of a Ridgeview Drive extension to the adjacent Pacini South
Commercial Center.
Alderman Baird expressed support for the Red Ribbon Substance Abuse
Awareness Program included within the Consent Agenda items. He requested Staff invite a
Red Ribbon representative to appear before Council to provide additional information
about the proposed Program.
