REQUEST FOR TEMPORARY USE PERMIT AND WAIVER OF CAPITAL DEVELOPMENT FEES -AMERICAN COMMUNITY BANK Petitioner Charie Zanck, Chief Executive Officer of American Community Bank, and her attorney Mark Saladin of Militello, Zanck and Coen, were in attendance. Attorney Saladin informed Council American Community Bank is requesting approval of a temporary use permit to allow a temporary financial institution with a drive through facility at the northeast corner of Route and Albany Street. A zoning reclassification and conditional use permit petition for a permanent facility on property located at the southeast corner of Route 31 and Albany Street will be forthcoming within the next fifteen months. The temporary structure consists of a 28' X 40' modular trailer including paved parking for seventeen vehicles and five stacking spaces for the drive through facility. Access for the temporary facility will be from existing Route 31 and Albany Street curb cuts. A 4' X 8' temporary sign would be installed along Route 31 to identify the facility. Attorney Saladin stated the Petitioner is also requesting City of McHenry water and sewer service for the temporary facility. Because of the temporary nature of the facility, the Petitioner is requesting a waiver of the capital development fees. The Petitioner, however, has agreed to be responsible for tap-on, meter and usage fees. Page 5 9/20/00 Staff is recommending approval of the temporary use and the waiving of associated capital development fees for the temporary structure, subject to the following conditions: ■ The site shall be developed in substantial conformance with the site and grading plan dated 9/12/00 and the October 1,1999 elevation drawing; ■ The temporary use shall expire on December 20,2001; ■ Within sixty days of the expiration of the temporary use, the trailer and all site improvements shall be removed and the site shall be restored to its original condition prior to the temporary use; ■ Upon abandonment of the trailer, water and sewer lines installed for the -- temporary use shall be abandoned and capped. Attorney Saladin stated the Petitioner has agreed to comply with all points included in Staffs recommendation. In response to Alderman Murgatroyd's inquiry, Director of Community Development Napolitano responded the Petitioner will still be required to follow City of McHenry Zoning Ordinance. The Petitioner will appear before the Zoning Board of Appeals for consideration and recommendation of zoning reclassification and conditional use permit for the permanent structure to be located at the southeast corner of Route 31 and Albany Street. In response to Alderman Glab's inquiry, Director of Community Development Napolitano stated the capital development fees would total approximately $5,400. City Administrator Lobaito clarified capital development fees are assessed to replace lost capacity of existing water and sewer infrastructure. He also noted, as per Staffs recommendation, the temporary connections would be abandoned and capped when the temporary use is terminated. A building permit will be required to reuse these water and sewer lines. -- Alderman Baird suggested Council consider collecting the capital development fees for the temporary structure. The collected fees could then be credited at time of building permit for the permanent structure. Some discussion followed. Page 6 9/20/00 ORDINANCES TO APPROVE ANNEXATION AGREEMENT, ANNEXATION, REZONING, PRELIMINARY PLAT AND VARIANCE—CASSIE ESTATES SUBDIVISION Petitioner Christine Galanopoulos and her attorney Edward Dean of Crystal Lake were in attendance. The Petitioner is requesting the following: ■ Annexation of 2.33 acres of property located at the southeast corner of Barreville Road and Beach Drive; ■ Reclassification to RS-2 Medium Density Single Family Zoning District; and ■ A variance to City of McHenry Subdivision Control Ordinance to permit a $22,000 monetary contribution in lieu of Beach Drive and/or Barreville Road street improvements, including curb and gutter, and the installation of sidewalks. The Public Hearing for the proposed annexation was conducted on June 14, 2000. At that time, Council directed Staff to work with the Petitioner to revise the annexation agreement to address the following concerns: ■ Minimum square footage requirements for new single-family homes to be similar to those used for Biscayne Highlands Subdivision: ■ Tying the proposed per lot streettsidewalk contribution to yearly inflationary increases; and ■ Burying of overhead utilities. Staff noted annexation agreement has been amended to reflect these issues. Attorney Dean requested Council reconsider the minimum square footage requirements for homes within the proposed subdivision. Mayor Cuda requested the minimum square footage parameters outlined in the Biscayne Highlands Annexation Agreement be considered. Square footage minimums stated in the Biscayne Highlands Annexation Agreement are 1,400 square foot for a ranch and 1,900 square foot for tri-level or bi-level. The proposed annexation agreement requires a minimum square footage of 1,600 for a ranch home, and 1,900 for a tri-level, bi-level or two-story home, exclusive of porches and garages. Ms. Galanopoulos has agreed to the 1,600 square foot minimum for a ranch home, however, is requesting a 1,600 square foot minimum for the tri-level, bi- level, or two story home model, as well. Some discussion followed. Motion by Baird, seconded by Bolger, to direct Staff to prepare ordinances approving the: ■ Annexation Agreement of the 2.33 acre Cassie Estates property, subject to the inclusion of language requiring a minimum of 1,600 square feet for a ranch model home, and 1,900 square feet for a tri-level, bi-level, or two story model home; ■ Annexation of the 2.33 acre Cassie Estates property; ■ Reclassification of the Cassie Estates property to RS-2 Medium Density single family zoning district, and approval of a variance to the City of McHenry Subdivision Control Ordinance to permit a $22,000 monetary contribution in lieu of Beach Drive and/or Barreville Road street improvements, including curb and gutter, and the installation of sidewalks. ORDINANCES TO APPROVE THE ANNEXATION, REZONING, VARIANCE AND CONDITIONAL USE — RUBLOFF DEVELOPMENT GROUP, VARIOUS PROPERTIES NORTH ROUTE 31 James Loarie, Rubloff Development Group Principal and Attorney Joseph Gottemoller of Madsen, Sudgen and Gottemoller, were in attendance. As per Council direction at the September 6, 2000 regularly scheduled meeting, Staff prepared the ordinances approving annexations, rezoning, variai,:. , and conditional use permits for the 100-acre commercial development located on Route 31 south of the FAP 420 right-of way. Page 7 9/20/00 Mayor Cuda noted Staff had met with Rubloff Engineers regarding the feasibility of extending the existing berm and planting landscape screenings along its ridge as directed by Council at the September 6, 2000 regularly scheduled Council Meeting, He and Attorney Gottemoller explained, connecting the existing berms would not be feasible due to storm water management and drainage design. As an alternative, Rubloff Development Group has submitted a revised landscaping plan dated September 20, 2000. This plan includes 300 10-foot trees located primarily between the existing berms and along the berm ridge. Attorney Gottemoller also requested Rubloff Development Group, as opposed to Meijer Stores, be responsible for the McCullom Lake Road landscape screening and plan as developed by Woolpert LLP and dated September 20, 2000. Some discussion followed. Motion by McClatchey, seconded by Bolger, to approve ordinances granting the following: ■ Annexation and reclassification to C5 for a 1-acre parcel on the east side of Route 31, approximately 1000 feet north of the Burger King located at 2180 N. MAYOR STATEMENT AND REPORTS Mayor Cuda reported he had received a letter from the Illinois department of Transportation stating their intent to proceed with Route 120 Improvements in front of Valley View School. He complimented Alderman Bolger on his letter writing campaign to facilitate this project. He also informed Council of his intent to send a memo in Friday's Agenda Packet referencing elected official salaries. In response to Council request, Staff was directed to provide comprehensive salary comparisons for area municipalities. Alderman Baird requested the City Clerk/Collector position be reviewed. These items should be placed on the October 4, 2000 regularly scheduled Council Meeting Agenda. COMMITTEE REPORTS Finance and Personnel Chairman Alderman Murgatroyd scheduled Finance and Personnel Committee meetings for Wednesday, October 4, 2000 at 6:30 p.m. and Wednesday, October 11, 2000 at 6:30 p.m. to discuss the 1999-2000 Audit and the Department Head Salary Ranges, respectively. DEPARTMENT HEAD REPORTS Director of Community Development Napolitano informed Council the shared part time Public Works and Community Development receptionist submitted her resignation. He requested Council authorize Staff to advertise for a replacement candidate. Motion by McClatchey, seconded by Glab, to direct Staff to advertise to fill the vacant part time Public Works and Community Development receptionist position. Director of Public Works Batt noted the September 6, 2000 City Council Minutes contain an error due to incorrect information being provided in the Agenda Supplement. Under the discussion regarding the authorization to purchase two dump trucks for the Public Works Department, the total cost for two trucks should be $76,134 plus the cost for the add-on items of $47,868 for a grand total of $124,002 for the two trucks. He reminded Council of the continuation of the Public Works Committee Meeting next Wednesday, September 27, 2000 at 7:00 p.m. Page 9 9/20/00 NEW BUSINESS Alderman Baird noting the unanimous recommendation from the Public Works Committee, suggested Council take formal action on the creation of a stop street intersection at Greenbrier and Creekside Trail, stopping traffic both northbound and southbound on Creekside Trail at it intersection with Greenbrier Drive. Motion by Baird, seconded by McClatchey, to direct Staff to draft an ordinance creating a stop street both northbound and southbound on Creekside Trail at its intersection with Greenbrier Drive. In response to Alderman McClatchey's question regarding flooding on Prestwick, Director Batt noted Staff is currently working with the adjacent property owners to the north to obtain a 25' wide easement. City Administrator Lobaito referenced his Department Head Report regarding the McAndrews Farm and its development. The McAndrews Family is requesting annexation and development within the City of McHenry on well and septic. The McAndrews Family attorney Sam Diamond is seeking Council direction. Some discussion followed. It was the consensus of Council to object the development of the McAndrews Farm on well and septic. Council directed City Administrator Lobaito to respond to Attorney Diamond in writing, stating Council's decision. Alderman Glab requested Council be provided an update at of the status of the proposed boundary agreements with the Village of Prairie Grove, the Village of Bull Valley and the Village of Lakemoor at the next regularly scheduled Council Meeting, October 4, 2000.
