MAY 20, 1998
The Regular Meeting of the McHenry City Council was called to order by Mayor
Steven J. Cuda on Wednesday, May 20, 1998 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, Director of Public Works Batt, Director of
Parks and Recreation Merkel, Director of Community Development Napolitano, Chief
of Police Joyce, City Attorney McArdle. Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
No one signed in to speak during the Ten Minute Public Input Session.
CONSENT AGENDA
Alderman Bolger, referencing Consent Agenda Item No. 8 amending the regular
schedule for June Council meetings, noted he would be unable to attend the June 24,
1998 rescheduled meeting. Some discussion followed. It was the consensus of
Council to reschedule the Monday, June 15, 1998 meeting to Monday, June 22,
1998.
Motion by Bolger, seconded by Murgatroyd, to approve the Consent Agenda as
follows, subject to the following amended June Council Meeting Schedule for regular

PROPOSED HISTORIC PRESERVATION ORDINANCE
Landmark Commission Chairperson Nancy Fike and Commission Members Maria
Arza, Robert Novak, Carol Jean Smith, Anneliese West, Lori Wilhelm and Sara Wilhelm
were in attendance. Director of Community Development Napolitano explained a
historic preservation ordinance was first discussed by City of McHenry Council in
September, 1996. The proposed ordinance is the result of review and input with the
Landmark Commission members, Plan Commission members, Zoning Board of Appeals
members, City Attorney and Staff. The preservation ordinance is modeled after the
McHenry County Historic Preservation Ordinance and establishes a formalized process
for designating landmarks and evaluating proposed modifications to designated
landmarks. Director Napolitano stated the Landmark Commission had resolved the
remaining four issues at their last meeting on May 5, 1998. Director Napolitano
highlighted the following pertinent provisions of the ordinance:
• In the event an owner of a proposed landmark, or 25% of the owners of
a proposed landmark district, object to the nomination, only the Mayor
and City Council by a simple majority can nominate a landmark or
preservation district.
• Properties, structures and districts must be at least 50 years old and
meet one of fourteen other criteria to be eligible for nomination. The
Landmark Commission, after a public hearing, makes a recommendation
to the City Council regarding the nomination of a property structure
and/or district. The City Council has the final authority to designate
landmarks.
• A Certificate of Appropriateness must be received prior to any exterior
construction, alteration, demolition or removal by designated landmark
properties, structures and districts.
• A public hearing is held by the Landmark Commission to review a request
for Certificate of Appropriateness. In the event an applicant is denied,
an appeal can be made to the City Council.

• If a Certificate of Appropriateness is denied, the Commission may issue
a Certificate of Economic Hardship, but only if it is determined that the
denial of the Certificate of Appropriateness will deny the owner/s all
reasonable use of, or return on, the property. An applicant can appeal
to the City Council if the Landmark Commission denies their request for
a Certificate of Economic Hardship.
Chairperson Fike also noted the removal of a membership attendance provision.
She noted a 50% absenteeism rate would have resulted in a formal action to terminate
membership. In response, Mayor Cuda requested he and the City Council be informed
of these situations. A formal letter can then be sent to the affected member. In
response to Alderman Bolger's request for clarification, Director Napolitano explained
enforcement of this ordinance will be the responsibility of the Community
Development Department. In response to Alderman McClatchey's inquiry, Chairperson
Fike explained the minimum age criteria of 50 years is the standard adopted by the
National Registry of Historic Preservation.
Motion by Baird, seconded by Glab, to direct staff to proceed with the
incorporation of the Historic Preservation Ordinance within the City's Municipal Code
presenting the finalized ordinance version for Council approval at the June 3, 1998
regularly scheduled Council Meeting.

MEYER MATERIAL LANDSCAPING
The following individuals were in attendance: Allen Miller representing Meyer
Material Corporation; Mark Artner, George Janac, and Robert Farina representing the
Concerned Citizens of Ridge Road; and Norman Wolf of Country Cabin Orchard and
Nursery of Woodstock, Illinois.
City Administrator Lobaito stated at the May 13, 1998 regularly scheduled
meeting, Council postponed consideration of Meyer Material Corporation's request to
be released from their annexation obligation to pay the City of McHenry $45,000.00
for landscaping along Ridge Road. Subsequent to Council's action approving the
Meyer Material Corporation Annexation Agreement containing the $45,000.00
landscaping requirement, the Ridge Road residents and Meyer Material reached an
agreement with respect to the Ridge Road landscaping. The proposed landscaping
plan was distributed for Council review earlier this week. In order to permit Country
Cabin Orchard and Nursery of Woodstock, Illinois to proceed with the proposed
landscaping work along Ridge Road, a waiver releasing Meyer Material Corporation
from their annexation obligation for Ridge Road landscaping must be drafted. Council
action authorizing the Mayor's execution of said waiver would also be required. In
addition, the waiver would release the City of McHenry from their obligation to water
and fertilize the landscape plantings. Some discussion followed.
Mr. Farina addressed Council noting the landscaping proposal from Country
Cabin Orchard and Nursery included the transplanting of desirable mature trees already
on the property in addition to the planting and maintenance through September 30,
1998 of 155 Scotch Pines ranging in height from ten to fourteen feet for the specified
$45,000.00 amount. In response to Alderman Baird's inquiry, Mr. Farina also noted
the sign-off letter requested by Council had not, in fact, been submitted. He stated,
however, this letter could be submitted within twenty-four hours. Further discussion
followed. In response to Alderman Glab's inquiry, Mr. Miller stated his intent to
remove any and all plantings which do not survive, however, the plantings will not be
replaced. Mr. Farina acknowledged the Ridge Road Concerned Citizens' acceptance
of this policy. Further discussion clarifying the "zig-zag" installation pattern and tree
spacing ensued. Mr. Miller noted prior berm landscaping efforts by Meyer Material
included the planting of 350 trees with a 100% survival rate. In response to Council
inquiry, Mr. Wolf of Country Cabin Orchard and Nursery stated a two to three-year
time period would yield significant growth coverage.

Motion by McClatchey, seconded by Bolger, to direct City Attorney McArdle to
draft a waiver releasing Meyer Material Corporation from their Annexation Agreement
obligation of a $45,000.00 payment to the City of McHenry for Ridge Road berm
landscaping, and releasing the City of McHenry from its obligation to water and
fertilize these plantings stated in Section 13 Item (c) of the Meyer Material
Annexation Agreement dated April 22, 1998, and to authorize the Mayor's execution
of the waiver, subject to the submission of a sign-off letter acknowledging the City of
McHenry's action waiving Meyer Material Corporation's $45,000.00 landscaping
obligation payment to the City of McHenry, executed by 65% of the Concerned
Citizens of Ridge Road homeowners.
Voting Aye: Bolger, McClatchey, Murgatroyd, Baird.
Voting Nay: Glab.

MAYOR - STATEMENT AND REPORT
Mayor Cuda reported he and City Administrator Lobaito had met with Financial
Consultant Harold Warren of Warren Associates to preliminarily discuss financing
mechanisms for the following projects:
• The widening of U.S. Route 31 from Bull Valley Road, south to Shamrock
Lane, including the installation of a traffic signal at the intersection of
Shamrock Lane and U.S. Route 31 ;
• The extension of sanitary sewer service to the Hunterville Subdivision
located east of the Fox River; and,
• The possible purchase of Eastwood Manor Water Company.
Mayor Cuda also informed Council a preliminary special services map
designating the properties affected by the proposed Route 31 improvements will be
provided for review and comment. Any and all comments should be directed to City
Administrator Lobaito. In response to Alderman Baird's inquiry, Mayor Cuda noted the
special services or assessment amount is based on the rate of property assessment.
COMMITTEE REPORTS
Community Development Committee Chairman, Alderman McClatchey, informed
Council the Community Development Committee had met prior to this evening's
Council meeting to discuss Mr. Gerstad's variance request for an increase in the
residential driveway width for the Timber Trails development in Boone Creek Joint
Venture's sign variance request for placement of an off-site sign on the northwest
corner of Bull Valley Road and Crystal Lake Road. The Committee's recommendation
granting a variance to Mr. Gerstad for an increase in the residential driveway width on
Pine Street will be forthcoming for Council review at the regularly scheduled June 3,
1998 Council Meeting. The Committee requested staff provide further information
with regard to the Boone Creek Joint Venture sign variance request.
Finance Committee Chairperson, Alderman Murgatroyd, reported the Revolving
Loan Committee had met just prior to this evening's Council meeting to review the —
Revolving Loan Application from D &J Automotive Supply business owner Mr. Joseph
Rabino. Alderman Murgatroyd stated the Committee had directed Mr. Rabino to work
with staff to provide the Committee with a specific cost analysis of his proposed
project. He also stated the Finance Committee's intent to begin review and
amendment of the City's current Personnel Policy. He requested all comments and
recommendations be submitted to City Administrator by June 30, 1998 for Committee
consideration.
Parks and Recreation Committee Chairperson, Alderman Baird, reminded Council
of the Parks and Recreation Committee meeting scheduled for tomorrow, Thursday,
May 21 , 1998 at 7:00 P.M.

STAFF REPORTS
Director of Community Development Napolitano reported the City had been
contacted by the owner of the property located on the northeast corner of McCullom
Lake Road and Riverside Drive regarding possible annexation.
Director Napolitano reminded Council of the Comprehensive Plan Steering
Committee meeting scheduled for Thursday, May 28, 1998 at 7:30 P.M.
Chief of Police Joyce invited Mayor Cuda and the Aldermen to the Third Annual
D.A.R.E. graduations of Valley View School on May 27, 1998; Riverwood School May
28, 1998 and Montini School on May 29, 1998. All graduations take place at 1 :00
.M.

School Annual Mock City Council Meeting.
