JUNE 22, 1998
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Monday, June 22, 1998 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Director of
Community Development Napolitano. Absent: Chief of Police Joyce, Director of Parks
and Recreation, Director of Public Works Batt.

REQUEST FOR USE OF PETERSEN PARK
Charles Wheelock, a Stone Ridge Community Church Parishioner, was in
attendance. Mr. Wheelock addressed Council requesting use of Petersen Park to
conduct an evangelistic tent revival meeting July 22nd through July 25, 1998, from
approximately 7:00 p.m. to 8:30 p.m. each evening. The tent revival meetings will
be conducted by the First Baptist Church, Stone Ridge Community Church, and
Alliance Bible Church, free of charge, and no offerings will be solicited. The tent
revival meetings are to promote fellowship. Each meeting will include singing, live
music and a message.
In response to Council inquiry, Mr. Wheelock stated the churches will be
responsible for clean-up. Mr. Wheelock requested Council permit the tent to remain
in place until after the last meeting. Council concurred. In response to Mr.
Wheelock's statement, Council limited the meeting times to 8:30 p.m. on the evenings
of July 22, July 23, July 24, and July 25, 1998. Insurance certificates from each of
the churches naming the City of McHenry as additional insured are to be provided prior
to July 22, 1998.
In response to Alderman Bolger's inquiry, Mr. Wheelock stated the tent will be
erected near the Petersen Park picnic area. City Administrator Lobaito also noted the
three churches were requesting a waiver from any fees associated with the use of
Petersen Park. As the City of McHenry currently does not have a fee structure in

place for the use of City Parks, no Council action is required. City Administrator
Lobaito stated due to the frequency of these types of requests, Director of Parks and
Recreation Merkel is exploring the implementation of a fee to offset Staff costs. He
suggested this specific issue be discussed during the 1999-2000 Budget process.
Alderman Glab requested the implementation of a fee structure for the use of city
parks be sent to the Parks and Recreation Committee for first consideration.
Motion by McClatchey, seconded by Baird, to grant the request of the First
Baptist Church, Stone Ridge Community Church, and Alliance Bible Church for the use
of Petersen Park to conduct an evangelistic tent revival meeting on the evenings of
July 22, 1998 through July 25, 1998, between the hours of 7:00 p.m. and 8:30 p.m.,
subject to Staff approval of the site and parking plans and the submission from each
church of certificates of insurance, naming the City of McHenry as additional insured.

AMENDMENTS TO MUNICIPAL CODE AND ZONING ORDINANCE RELATING TO
ANIMALS
Director of Community Development Napolitano reported the Community
Development Committee at its April 29, 1998 meeting, had directed Staff to amend
Chapter 6 of the City of McHenry Municipal code dealing with Animals and Fowl. The
City of McHenry's Animal Ordinance was reviewed and compared to other municipal
animal ordinances, including the Village of Algonquin, the Village of Cary and the City
of Crystal Lake. As the City of McHenry's regulations on animal cruelty, noise,
running at large, dangerous animals, and the removal of excrement are similar to other
McHenry County municipalities, it is Staff's recommendation to retain the current
language exhibited in Chapter 6 of the City of McHenry's Municipal Code regarding
Animals and Fowl. An issue of concern raised by Alderman Glab as a direct result of
a problem with a City of McHenry resident, relates to the number of dogs allowed on
a residential site. Currently, the only reference for a specified number of permitted
animals can be found in the City of McHenry's Zoning Ordinance, under the definition
of "Kennel". The City of McHenry's current definition of kennel, clearly applies to a
commercial situation, in which pets are sold, roomed, boarded, and/or placed. It also
applies to an animal shelter which boards, sells and provides medical treatment to
pets. The definition is ambiguous as it applies to household pets kept on a residential
site. It is Staff's recommendation to adopt a new definition of 'Kennel" similar to that
of the Village of Algonquin, as follows:
Kennel: Any lot or premises or portion thereof on which more than four dogs,
cats, or other household domestic pet animals over four months of age are
kept, or on which more than two such animals are boarded for compensation
or kept for sale.
After some discussion, Alderman Murgatroyd suggested Staff also draft a clear
definition of "household domestic animal". In response to Alderman Baird's inquiry,
Director of Community Development Napolitano stated breeders having litters of pups
would not be in violation under the proposed language amendment of the animal
ordinance as long as the puppies were under the age of four months.
Motion by Glab, seconded by Murgatroyd,to direct Staff to draft an amendment
to Chapter 6 of the City of McHenry 's Municipal Code regarding Animals and Fowl,
with the inclusion of a definition for "Household Domestic Animals" and to draft an
amendment to the City of McHenry's Zoning Ordinance with a new definition of
"Kennel" similar to that of the Village of Algonquin.

PUBLIC IMPROVEMENTS - FOXVIEW HIGHLANDS
City Administrator Lobaito informed Council quotes were sought to complete
the Foxview Highlands Public Improvements including parkway improvements, and the
regrading of a drainage ditch. The low quote for parkway restoration was Custom
Landscaping in an amount not-to-exceed $7,774. The low quote for the drainage
ditch work was also Custom Landscaping in an amount not-to-exceed $8,561 . City
Administrator Lobaito stated it is Staff's recommendation to waive bids and authorize
the hiring of Custom Landscaping permitting the immediate completion of these Public
Improvements in Foxview Highlands. City Administrator Lobaito noted the Public
Improvements work would be expensed against the developer's Letter of Credit
balance. City Administrator Lobaito noted the City of McHenry had elected to call this
Letter of Credit on May 29, 1998. City Administrator Lobaito also reported the
developer's sub-contractor Midwest Horizon has been working to complete the
parkway improvements and drainage ditch since the developer's Letter of Credit had
been called by the City of McHenry. Some discussion followed.
Staff noted all Letter of Credit funds will be returned to the developer if his
contractors complete all of the Public Improvements. The developer will also be
notified of the City of McHenry's intent to hire Custom Landscaping to complete the
Foxview Highlands Public Improvements.
Motion by McClatchey, seconded by Baird, to waive the bid process and
authorize Staff to hire Custom Landscaping to complete the Foxview Highlands
parkway restoration work in an amount not-to-exceed $7,774 and the Foxview
Highlands drainage ditch work in an amount not-to-exceed $8,561 .

MAYOR - STATEMENT AND REPORTS
Mayor Cuda informed Council representatives from McHenry County
Transportation Department have reported they anticipate the right-of-way acquisition
for Phase II of the Bull Valley Arterial to be completed by July 8, 1998. Mayor Cuda
also reported he and Council had been awarded a Plaque of Commendation from the
McHenry DARE Parents Organization for their support of the program. The Plaque
was distributed for Council's viewing. In conclusion, Mayor Cuda reminded Council
of the Governmental Municipal Mass on Tuesday, June 30, 1998 at 6:30 p.m. at
Church of the Holy Apostles.
COMMITTEE REPORTS
Parks and Recreation Committee Chairman Alderman Baird reported the Parks
and Recreation Committee had met with representatives from the architectural firm of
Sente and Rubel to develop a Recreational Center Concept Plan. the minutes of this
meeting will be forthcoming for full Council review.
Finance Committee Chairman Alderman Murgatroyd informed Council the next
Finance Committee Meeting Agenda will be devoted to the Comprehensive Review of
the City of McHenry's bonding status, including bonding capacity and bonding
authority. Alderman Murgatroyd opined a comprehensive review of this type will
assist Council in prioritizing responsibly proposed City projects. Finance Committee
Chairman Alderman Murgatroyd also reminded Council a review of the City's current
Personnel Policy Manual is scheduled to begin in the next few weeks. He requested
all comments from Staff and Council be forwarded to City Administrator Lobaito
before the month's end.
Mayor Cuda reported the Adhoc Committee to develop a Boundary Agreement
with the Village of Johnsburg met prior to this evening's regularly scheduled Council
Meeting to review the first draft of the proposed Border Agreement. The Committee's
recommended changes will be incorporated into the proposed Agreement and
distributed for full Council's review. A tentative date of July 8, 1998 at 6:30 p.m. in

the Aldermen's Conference Room in the McHenry Municipal Building has been
scheduled for a Joint Adhoc Committee Meeting to submit to the village of Johnsburg
the City of McHenry's amendments.
Mayor Cuda reported an Adhoc Development Committee Meeting will also be
scheduled for the first Thursday in August at 7:30 a.m.
STAFF REPORTS
Director of Community Development Napolitano informed Council the
Community Development Department was in receipt of requests to permit the
establishment of roadside stands to sell Fourth of July novelties. Director Napolitano
requested Council direction on how to proceed with these requests, as the City of
McHenry's Zoning Ordinance is ambiguous with regard to the sale of Fourth of July
novelties. In response to Council inquiry, Director Napolitano explained the State of
Illinois prohibits the sale of fireworks, but permits the sale of Fourth of July novelties.
Some discussion followed. Director of Community Development Napolitano noted the
difficulty in regulating the sale of only novelties. Frequently the sale of prohibited
fireworks is attempted.
In response to Alderman McClatchey's inquiry, Director of Community
Development Napolitano noted the requests for roadside stands are for the following
locations:
• U.S. Route 120 in front of the Eagle Food Store
• U.S. Route 31 in front of the Just for Fun Roller Rink.
Alderman McClatchey noted Fourth of July novelties can currently be purchased
at local retail establishments, such as Wart Target, WalMart, Jewel and Dominick's.

stands to sell Fourth of July novelties.

City Administrator Lobaito, referencing his memo, drew Council's attention to
the attached Landmark Commission letter recommending the plaquing of the Petersen
Farm Homestead. The recommendation by the Commission to plaque the Petersen
Farm Property must be approved by the City Council for landmark status.
Motion by Murgatroyd, seconded by Baird, to accept the recommendation of
the Landmark Commission and authorize the plaquing of the Petersen Farm Property
for City of McHenry Landmark status.

NEW BUSINESS
Alderman Glab requested Staff investigate who was mowing the west side of
Water's Edge as a small portion along the north side of Dartmoor Drive was being
excluded and needed attention. He also requested the Community Development
Committee again review the City of McHenry's current sign ordinance. The existing
ordinance permits a 4' X 8' For Sale on any residential lot which he opined may be
excessive.
Alderman Murgatroyd complimented Molly Zerbe, owner of the Rainbow
Playground Equipment building, located at 4611 West Elm Street. He noted the
exterior of the building in addition to the outside sales lot are attractive and
welcoming. He challenged other West Route 120 businesses to follow their lead.
Mayor Cuda directed Staff to send a letter of commendation to Ms. Zerbe.
