At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Baird. Absent: Murgatroyd. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Community Development Napolitano. Absent: None. �-- TEN MINUTE PUBLIC INPUT SESSION None one signed in to speak during the Ten Minute Public Input Session. PUBLIC HEARING - ANNEXATION, ZONING AND PRELIMINARY PLAT - ADAMS COMMERCIAL PARK - 2600 WEST ROUTE 120 Mayor Cuda opened the Public Hearing on the Annexation, Zoning and Adams Commercial Park Preliminary Plat approval at 7:33 p.m. The Petitioner Richard A. Adams, his attorney, Mark Saladin of Militello, Zanck and Coen, and surveyor, Charles Mionske of Charles A. Mionske Land Surveyors, were in attendance. Attorney Saladin addressed Council stating the Petitioner, Mr. Adams, is seeking Annexation of a 20-acre parcel of property located approximately 1600 feet north of Illinois State Route 120 and Adams Drive, north of Adams Enterprises Trailer Sales and Service located at 2600 West Route 120, McHenry, Illinois. The subject property is part of Property Index No. 09-25-326-008 and extends from the northernmost boundary of the Adams Property to the north, having approximately 160 feet of frontage along Lincoln Road. The Petitioner is seeking a Business Park Zoning Classification for 4 acres which are incorporated into the proposed Adams Commercial Park Preliminary Plat, as Lots 15 and 16. An Estate Zoning Classification is sought for the remaining 16 acres. Attorney Saladin explained the City of McHenry annexed the current Adams Property in 1995 as part of the large-scale East of the Fox River Annexation of properties. The Business Park and C-5 Highway Commercial Zoning granted by the McHenry City Council at the time of annexation were delineated by a Metes and Bounds legal description as opposed to actual lot lines. Mr. Adams subsequently acquired the 20-acre parcel adjacent to the northernmost boundary of his existing property to the north including approximately 160 feet of frontage along Lincoln Road. This property is the 20-acre parcel being considered for annexation and zoning during this evening's Public Hearing. The original plan for the Adams Business Park has been reconfigured as a result of final engineering, citing an extensive wetlands area at the northwest corner of the proposed Commercial Park Subdivision. The proposed Adams Commercial Park Preliminary Plat depicts two cul-de-sacs rather than the circular road. Two access points to the Commercial Park Subdivision from Illinois State Route 120 are proposed and tentatively approved by the Illinois Department of Transportation. The first access point is at Adams Drive, with the second access point being an easement on the west edge of Lot 1 , between Lots 6 and 7, which will be a right-in, right-out, as per the Illinois Department of Transportation's directive. Due to the reconfiguration of the Adams Commercial Park Preliminary Plat, the Petitioner is requesting the appropriate Zoning reclassifications to achieve compliance with the proposed Adams Commercial Park Preliminary Plat. Lots 18 and 19 of the proposed Adams Commercial Park Preliminary Plat and portions of Lot 4,5, and 6, would be reclassified from Business Park to C-5 Highway Commercial. A portion of Lot 7 would be reclassified from C-5 Highway Commercial to Business Park. The Zoning Board of Appeals at the June 15, 1998 Public Hearing considered and unanimously recommended, upon annexation to the City of McHenry, the granting of a Business Park Zoning classification to the four acres indicated as Lots 15 and 16 on the Adams Commercial Subdivision Preliminary Plat located immediately north of the existing Adams Business Park Property, and the granting of Estate Zoning classification to the remaining 16 acres of property located adjacent to the northernmost boundary of the existing Adams Property, extending north including approximately 160 feet of frontage along Lincoln Road. During the same Public Hearing, the Zoning Board of Appeals also considered and unanimously recommended July 29, 1998 Page 2 Council approval of the zoning reclassification of Lots 18 and 19 and the northernmost portions of Lots 4,5, and 6, as indicated on the Adams Commercial Subdivision Preliminary Plat from Business Park to C-5 Highway Commercial, and the reclassification of the easternmost half of Lot 7, as indicated on the Adams Commercial Subdivision Preliminary Plat, from C-5 Highway Commercial to Business Park. The City of McHenry Plan Commission, at their May 7, 1998 regularly scheduled meeting, considered and unanimously recommended the approval of the revised Adams Commercial Park Preliminary Plat prepared by Charles Mionske dated �--, February 9, 1998 with a revision date of May 7, 1998, subject to the following conditions: 1 . Compliance with the following engineering and Community Development Department's written comments: • The City Engineer shall review and approve the Preliminary Plat, and all points addressed in the Baxter and Woodman correspondence of April 30, 1998 reference the Adams Commercial Park plan review shall be brought into compliance; • Evidence of coordination with IDOT regarding the dedication of right-of-way and future improvements along Route 120 shall be provided; • A title commitment for an owner's title insurance policy shall be provided in the initial amount of $5,000 covering title of the real estate being subdivided and covering a date not more than 14 days prior to the date the preliminary plat is filed; • An Endangered Species Consultation Agency Action Report from the Illinois Department of Conservation shall be provided; • The existing and requested zoning within the subdivision shall be labeled on the preliminary plat; • The location, widths, and names of all existing and platted streets, alleys, or other public ways and easements, railroad, and utility rights-of-way, parks, cemeteries, water courses, drainage ditches, permanent buildings, and bridges within 300 feet of the proposed subdivision shall be shown on the preliminary plat; • The required 75-foot rear yard setback for Lots 16-20 shall be shown on the preliminary plat; • In accordance with the City Attorney's comments, restrictions on the proposed detention area and conservation easement area shall be clarified as required. 2. The submission of covenants including wetland maintenance requirements and the prohibition of vehicles utilizing the public right-of-way; 3. The submission of written authorization from the McHenry Township Fire Protection District approving the length and radius of the Preliminary Plat cul-de- sacs. Attorney Saladin also summarized the significant provisions of the proposed Annexation Agreement including: 1 . Approval of the Adams Commercial Park Preliminary Plat; 2. Approval of the requested zoning reclassification for the existing Adams Property and granting of the zoning classifications for the 20-acre parcel being annexed to the City of McHenry; 3. Approval of a variance to the Subdivision Control Ordinance permitting cul-de- sacs in excess of 400 feet in length; 4. Approval of a variance to the Subdivision Control Ordinance permitting the development of the Adams Commercial Park Subdivision without a complete public water supply and distribution system; 5. The granting of all easements required for the Adams Commercial Park Subdivision by the owner, which may be necessary to extend utilities to adjoining properties, including the extension of any future water mains to Lincoln Road; 6. The construction of public sanitary sewer and water mains by the property July 29, 1998 Page 3 owner in conjunction with the development of the Adams Commercial Park Subdivision; and the provision that all water mains will be connected to a public water system, if and when a public water system is completed; 7. Payment`'of a $1500/residential unit as well as the currenf"tax lag fee of $1533/residential unit developed on the Estate portion of the 20-acre annexation parcel; 8. The conveyance of Outlot B, the well located on Outlot B, a pump, and a pitless adaptor to the City of McHenry by the property owner; 9. The construction by the City of McHenry of an elevated water storage tank on Outlot B within a reasonable time frame, subject to the condition that a water main connection is successfully constructed under the Fox River; 10. Improvement as per Illinois Environmental Protection Agency specifications of Outlot B by the City of McHenry to operate a safe public water supply system, subject to the successful construction of a water main connection under the Fox River; 11 . Construction of a 12-inch water main to the north and south boundaries of the Adams Commercial Park Subdivision by the property owner; 12. The extension of a 12-inch water main to the southerly right-of-way of Lincoln Road by the property owner which may also be subject to a Recapture Agreement; 13. The best efforts by the City of McHenry to cause a sewer connection to the south side of Lincoln Road; 14. Council approval to permit the Adams Commercial Park Subdivision be developed with private wells in the event no Fox River water main connection is developed. Some discussion followed. City Administrator Lobaito noted the City's consulting engineering firm, Baxter and Woodman, had submitted a letter stating the water production level of the new well recently constructed on the Adams Commercial Subdivision's Outlot B was approximately 500 gallons/minute. City Administrator Lobaito reported this production level was more than acceptable for supplying water. Water quality reports are anticipated sometime in September. Mayor Cuda commended both Staff and the Petitioner's efforts to draft and present a partial solution to the development of a viable water system East of the Fox River. City Administrator Lobaito reiterated if a water main connection across the Fox River was not forthcoming, the City of McHenry was not obligated to construct an elevated storage tank on and improve Outlot B of the Adams Commercial Park Subdivision, and the Adams Commercial Park Subdivision would be permitted to develop with private wells. The Adams Commercial Park Subdivision must, however, be developed with appropriately sized 12-inch water mains in the event a viable City operated water supply system is developed. Staff noted the difficulty of extending, constructing and connecting to a water supply system after the development of a subdivision. In response to Alderman Bolger's inquiry, Staff noted the Outlot B well is 90 feet deep with a 30-foot water table. Mr. Adams, in response to Council inquiry, stated his intent to begin the development of his commercial park immediately. Some discussion followed regarding a time frame for the potential water main connection river crossing. Mayor Cuda provided Council information regarding Donald and Roger Gerstad's proposal to annex to the City of McHenry their property located north of Lincoln Road and west of Chapel Hill Road, commonly known as the Diedrich Farm. Alderman Baird expressed his concern with the proposed Gerstad Annexation and residential development. In response to Alderman Baird's inquiry, City Administrator Lobaito stated the water main connection river crossing is needed to support and influence the existing west side water supply. Staff has also recently determined the river crossing is more economically feasible than other previously considered water supply system options. Alderman McClatchey inquired whether Staff and/or City engineering consultants Baxter and Woodman were investigating the availability of grant funding. City Administrator Lobaito stated the availability of grant funds was being investigated July 29, 1998 Page 4 and Council would be kept apprised of the situation. Mayor Cuda asked if there were any comments and/or questions from the audience with regard to: • the proposed Annexation and Zoning of the 20-acre parcel adjacent to the northernmost boundary of the existing Adams property extending north and including approximately 160 feet of frontage along Lincoln Road; • the reclassification of portion of the Adams Property located within the City of McHenry to C-5 Highway Commercial and Business Park; and • the proposed Preliminary Plat of the Adams Commercial Park Subdivision prepared by Charles Mionske dated February 9, 1998 with a revision date of May 7, 1998. There were none. In response to Mayor Cuda's inquiry, City Clerk Althoff reported no written and/or oral comments on the proposed Annexation, Zoning, Re-Classification and Adams Commercial Subdivision Park Preliminary Plat had been received by the Office of the City Clerk. There being no further discussion, Mayor Cuda requested a motion to close the Public Hearing. Motion by McClatchey, seconded by Baird, to close the Public Hearing at 7:58 p.m. Voting Aye: Bolger, Glab, McClatchey, Baird. Voting Nay: None. Absent: Murgatroyd. Motion carried. Alderman Baird, citing the Petitioner's statements regarding the limited --, residential development potential of the Estate zoned property because of its irregular shape and proximity to high quality wetlands, requested the Petitioner consider including language in the Annexation Agreement limiting the development of the area zoned Estate to one residential lot. The Petitioner concurred. In response to Alderman Baird's inquiry, Mr. Mionske, surveyor, stated the McHenry Township Fire Protection District letter regarding the length and radius of the cul-de-sacs on the proposed Adams Commercial Park Subdivision's Preliminary Plat will be submitted within the next few days. In response to Alderman Bolger's inquiry, Director of Community Development Napolitano noted the remaining two Plan Commission approval conditions have been met. Mayor Cuda directed Staff to prepare the appropriate ordinances to: • Annex and Zone the 20-acre parcel located adjacent to the northernmost boundary of the existing Adams Property, east of the Fox River, north of Illinois State Route 120, and south of Lincoln Road; • Reclassify Lots 18 and 19 and the northernmost portions of Lots 4,5, and 6 as depicted on the Adams Commercial Park Subdivision Preliminary Plat to C-5 Highway Commercial and to reclassify the easternmost half of Lot 7 as depicted on the Adams Commercial Park Subdivision Preliminary Plat to Business Park; • To amend the proposed Annexation Agreement with the revisions as agreed to by Council during this evening's Public Hearing. Formal action will occur at the August 5, 1998 regularly scheduled Council Meeting. TRANSFER OF CLASS A-7 LIQUOR LICENSE FROM DON AND ARLYS FOLZ TO GUILLERMO TELLO Mayor Cuda reported a liquor license transfer request was received this week from Mr. Guillermo Tello, who is purchasing Don's Submarine Sandwich Factory located at 1237 North Green Street from its current owners Don and Arlys Folz. Mayor Cuda conducted a satisfactory interview with Mr. Tello on Wednesday, July 22, 1998. Mr. Tello was fingerprinted at this time by the McHenry Police Department. The appropriate paperwork, in addition to the $250 transfer fee, has been submitted. Mayor Cuda requested Council confirm his recommendation to approve the transfer of the Class A-7 Liquor License from Don and Arlys Folz to Guillermo Tello d/b/a Tello's Mexican Restaurant at 1237 North Green Street, subject to the return of satisfactory results from the fingerprinting report. APPROVAL OF SITE PLAN FOR THE CHURCH OF HOLY APOSTLES ADDITION Father Robert Sherry, Pastor at Church of Holy Apostles, was in attendance. Director of Community Development Napolitano informed Council as per Section IX of the July 15, 1991 Church of Holy Apostles Annexation Agreement, the Site Plan for the proposed buildings and improvements on the Church of Holy Apostles property shall be subject to the review and approval of the City Council. Father Sherry informed Council the Church of Holy Apostles recently submitted plans for a 5,150 — square foot single story addition to be located at the south rear side of the existing Church building. The addition complies with all setback requirements and does not require construction of any additional parking spaces. The addition will house classrooms and additional office space. Father Sherry requested Council approve the 5,150 square foot single story addition Site Plan as presented. Motion by Baird, seconded by McClatchey, to approve the Church of Holy Apostles Site Plan for a 5,150 square foot single story addition prepared by Condon Consulting Engineers, P.C. and submitted to the City of McHenry Community Development Department on June 16, 1998. AMENDMENTS TO MUNICIPAL CODE RELATING TO ANIMALS Mayor Cuda recognized City Prosecuting Attorney Patrick McAndrews and City Code Compliance Inspector Michael Albertini in the audience. He reminded Council Staff at the June 22, 1998 regularly scheduled Council Meeting had been directed to define "Domestic Household Pet" and review the current definition of "Kennel" as it — relates to the number of animals allowed on a residential site in Chapter 6 of the McHenry Municipal Code. Director of Community Development Napolitano presented the proposed definition for a "Domestic Household Pet" for Council consideration. The proposed definition states: Domestic Household Pets shall mean any animal trained and bred to live with humans, including, but not limited to cats, dogs, small caged birds, small aquatic and amphibian animals (except for snakes and other life-threatening reptiles), ferrets, gerbils, hamsters, rabbits, and Vietnamese potbellied pigs. July 29, 1998 Page 11 Director of Community Development Napolitano stated Staff was additionally recommending no change to the current Municipal Code definition of "Kennel". Previous Council discussion had suggested the definition of "Kennel" might be used as a way to address certain animal nuisance problems. Further consideration noted one animal could potentially create a nuisance, while five animals might cause none. City Prosecuting Attorney Patrick McAndrews, noting the numerous animal nuisance complaints currently being considered in the McHenry County Court System, concurred with the recommendations suggested by Staff. Director of Community Development Napolitano stated the proposed revisions to the current animal ordinance will clarify and expand the nuisance and enforcement language. Addressing Council, Attorney McAndrews explained the difficulty in prosecuting animal nuisance complaints was not the ordinance language per se, but the lack of complainants willing to testify in court. Some discussion followed. In response to Council concerns regarding the exception of snakes as domestic household pets, it was the consensus of Council to revise the proposed "Domestic Household Pet" definition to include snakes as permitted by the Illinois State Statutes, non-poisonous variety of no more than 15 feet in length. Mayor Cuda opened the floor to audience comments. Renee Holck addressed Council commending them for developing a solution which did not limit the number of pets one residential unit could contain. Judy Welter requested Council consider assisting in the development of a low-cost spay/neuter program. She suggested Staff investigate the availability of grants and federal funding for this type of program. In response to Joyce Crosbie's inquiry, City Administrator Lobaito clarified the City's procedure for responding to and processing nuisance complaints. Ms. Crosbie also requested Council consider developing a low-cost spay/neuter program. In addition, Ms. Crosbie requested Council authorize better record keeping of nuisance complaints for better documentation of repeat offenders. Director of Public Works Batt volunteered to work with local residents to develop a low-cost spay/neuter program. In response to Alderman Glab's inquiry, Code Compliance Inspector Albertini stated his support of the proposed ordinance amendments. He substantiated, however, Attorney McAndrews observations regarding the need for complainants to testify in court. Motion by Glab, seconded by Baird, to direct Staff to draft an ordinance including the proposed revisions to Chapter 6, Animals and Fowls, of the Municipal Code, as presented, subject to the inclusion of non-venomous snakes not to exceed 15 feet in length, within the "Domestic Household Pet" definition. AWARD OF BID - GREEN STREET REVITALIZATION PROJECT Project Architect Dennis Wonderlick of Cone, Kalb and Wonderlick Associates, was in attendance. Director of Public Works Batt reminded Council bids were originally sought for this project in April, 1998. No bids were submitted. Bid _ specifications were modified, with bids being sought for a July 21 , 1998 bid opening. Bid proposals for the Green Street Revitalization Project were received from two contractors: Alliance Contractors of Woodstock and Thelen Sand and Gravel of Antioch. The low bidder was Alliance Contractors in the amount of $1 17,400. Director of Public Works Batt informed Council the original project cost estimate was between $110,200 and $113,500. Architect Dennis Wonderlick explained the overage in this bidding process was attributable to the current market conditions which also was the most significant factor in not receiving competitive bids earlier this spring in April when the project was originally advertised for bid. Architect Wonderlick stated the overage of approximately 4-6% is not out of line in today's market place. It is the recommendation of Staff to award the Green Street July 29, 1998 Page 12 Revitalization Project to the low bidder Alliance Contractors of Woodstock in an amount not-to-exceed $1 17,400. Some discussion followed regarding budget figures and the actual higher cost amount. Motion by McClatchey, seconded by Baird, to award the Green Street Revitalization Project to the low bidder Alliance Contractors of Woodstock in an amount not-to-exceed $117,400. ADVERTISEMENT FOR BIDS - RE-ROOFING OF PETERSEN FARM BARN City Administrator Lobaito informed Council a condition of the Petersen Farm Purchase was the installation of a new roof on the Petersen Farm dairy barn. Bid specifications have been developed and are presented for Council review. Bid specifications require a base bid utilizing standard asphalt shingles. In addition, an alternate bid of dimensional shingles emulating the barn's original shake roof has been included. The alternate bid is included due to the historic nature of the farm. City Administrator Lobaito stated the farm's previous owner and current life tenant, Robert Petersen, will participate in the selection of the roofing shingle with regard to color, etc. Motion by Bolger, seconded by Baird, to authorize Staff to advertise for bids on the installation of a new roof for the Petersen Farm dairy barn. Motion carried. — RESOLUTION AUTHORIZING STAFF TO ADVERTISE FOR SALE OF SURPLUS PROPERTY City Administrator Lobaito reminded Council at the May 13, 1998 regularly scheduled meeting Council authorized through a sealed bid procedure the Sale of Surplus City Property located at 1115 North River Road. Council must pass a resolution declaring the site Surplus Municipal Real Estate and direct the City Administrator to sell by competitive bid the subject property. The sale of this property will be advertised in the local newspaper once a week for three consecutive weeks. In addition, "For Sale" signs will be prominently placed on both the river and street sides of the property. Interested bidders will be afforded the opportunity to view the property on two separate occasions as specified in the Bid Packet. City Administrator Lobaito also noted as per Council direction, state certified land appraiser Frank Harrison had been contacted to update the December 31 , 1996 appraisal of the property. Mr. Harrison submitted a written opinion that the December 31 , 1996 appraised value of $191 ,000 remained accurate and valid. In response to Alderman Glab's inquiry, City Administrator Lobaito clarified the property being sold and the property being retained to operate and maintain the recently constructed City of McHenry lift station. Reservation of an exclusive perpetual easement for the purpose of installation, maintenance, operation, — reconstruction and repair of the City's sanitary sewer lift station and associated appurtenances is also being sought. Alderman Glab inquired if the reduction in lot size due to the City's retention of that portion of the property housing the sanitary sewer lift station creates a non-conforming use. City Administrator Lobaito stated Council reserves the discretionary right to permit a non-conforming use under these circumstances. Alderman Glab initiated discussion regarding the desirability of selling the property immediately, in light of preliminary conversations with the McHenry Economic Development Commission and City Planners regarding a Riverwalk Development. It was the consensus of Council to direct City Clerk Althoff to inform the Economic Development Commission Board Members of the City of McHenry's intent to sell the river front property located at 1115 North River Road. July 29, 1998 Page 13 Motion by Bolger, seconded by Baird, to pass a resolution declaring City property located at 1115 North River Road, McHenry, Illinois, Surplus Municipal Real Estate, and to direct the City Administrator to sell the subject property by competitive bid. LEASE AGREEMENT - HICKORY CREEK BARN City Administrator Lobaito reported as per Council direction at the July 1 , 1998 regularly scheduled meeting, the following revisions have been incorporated into the lease between the City of McHenry and Hickory Creek Barn tenant, Michael Sikula, Jr.. • Term of the Lease to be one year (paragraph 2). • Monthly lease payment of $1 ,866.00 (paragraph 3). • Requirement of lessee to provide City with Certificate of Insurance (paragraph 8). • A provision has been added to allow for a maximum of two guided tours of the facility annually (paragraph 11). • Provision for public access to the pond and McCullom Lake through the premises (paragraph 11). Alderman McClatchey also recommended Staff investigate the feasibility of housing a petting zoo at this facility. Director of Parks and Recreation Merkel noted in addition to the two guided tours of the Hickory Creek Barn facility, the Parks Department will be conducting hay rides on and through this property. In response to Council inquiry City Administrator Lobaito noted the Hickory Creek Barn property has not yet been annexed to the City of McHenry. City Administrator Lobaito suggested a Special Meeting be scheduled to discuss the proposed Annexation of the Diedrich Farm Property and terms of the Agreement. A tentative date of Monday, August 24, 1998 was scheduled. In response to Alderman Baird's inquiry, City Administrator Lobaito stated the Annexation Agreement will be presented for preliminary Council review with a Concept Plan. It was the consensus of Council no formal action will occur without the presentation of a Preliminary Plat for the Gerstad Annexation of the Diedrich Farm Property. Alderman Baird suggested Council consider July 29, 1998 Page 14 implementing the Village of Algonquin's Annexation Fee Schedule. COMMITTEE REPORTS Community Development Committee Chairman Alderman McClatchey reminded Council of the Community Development Committee Meeting on August 5, 1998 at 7:00 p.m. in the Aldermen's Conference Room. As Director Batt will not be in attendance at this meeting, he requested Council forward any comments or questions regarding this item to his attention prior to the meeting. Director Batt informed Council Green Street will be closed effective Wednesday, August 5, 1998 from Bull Valley Road north to Knox Park Pool. The closure will facilitate the construction of the Bull Valley Arterial and Green Street intersection. The closure will be in effect for approximately 90 days. Director Batt also informed Council he and City Inspector Marcinko visited the Village of Mount Prospect to research and compile information about their highly successful streets program. Information obtained will be summarized and presented to Council for review. Director of Parks and Recreation Merkel informed Council the local McHenry Scuba Club will be coordinating a clean-up on Sunday, August 30, 1998 of the Petersen Park Beach area. Displaying the first place trophy, Director Merkel congratulated the Marlins Swim Club on their performance at the Rockford Invitational Conference Meet. City Administrator Lobaito noted letters were placed in the Council Agenda Packets from McHenry Community High School District 156 Superintendent Robert Swartzloff and McHenry Elementary School District 15 Superintendent William Dodds regarding both school districts interest in working with the City of McHenry to develop and construct a recreational facility for the City of McHenry. In response to Alderman McClatchey's inquiry regarding the status of the recreational facility project, City Administrator Lobaito informed Council the Parks Department Staff was compiling class enrollment numbers. He opined this information will better assist Council in determining specific space requirements of a recreational facility. Alderman Glab suggested representatives from both school districts, McHenry Elementary School District 15 and McHenry High School District 156, be invited to the next Parks and Recreation Committee Meeting. City Clerk Althoff reminded Council of the invitation extended to the Mayor and City Council to participate in the "For the Children" fundraiser to be held at Petersen Park on August 23, 1998. Council members intending to particpate were advised to contact City Clerk Althoff by August 10, 1998. NEW BUSINESS Alderman Bolger suggested Council consider sending a letter of support to the Northeastern Illinois Planning Commission and Illinois Environmental Protection Agency — regarding the elimination of Facility Planning Area reviews by the Northeastern Illinois Planning Commission. Mayor Cuda informed Council he had sent a letter to Deborah Washington of the Northeastern Illinois Planning Commission stating his support of the continuation of the Northeastern Illinois Planning Commission review of Municipal Facility Planning Areas. City Administrator Lobaito informed Council correspondence had been received from the City engineering consultants Baxter and Woodman expressing their concerns with the elimination of the Northeastern Illinois Planning Commission's review of Facility Planning Area amendments. Some discussion followed regarding the lack of barricade placement on the north side of Bull Valley Road in front of the detention pond's deep and sudden drop- off. City Administrator Lobaito, noting this was a County project, informed Council July 29, 1998 Page 15 McHenry County Highway Superintendent Michael Magnuson stated the project contractors and manager were following appropriate standards. Council requested Staff investigate construction standards, and, if appropriate, place City of McHenry barricades at the location. In response to Alderman Bolger's inquiry, Mayor Cuda requested any individuals interested in serving on a Special Committee for the Miller Memorial should contact him at the earliest opportunity. Alderman McClatchey commended all City employees for their participation in the highly successful 50th Anniversary Celebration of Fiesta Days. Alderman Glab, referencing Fox Ridge resident Jinny Henson's request, asked Council if there was any interest in reconsidering her request. There was none. Alderman Baird requested Staff notify Irish Prairie Homeowners Association Officers of any future meetings including an Agenda Item addressing the Cunat Brothers request for the City to accept the current Shamrock Lane as a public street and the future Shamrock Lane/U.S. Route 31 traffic signal installation.
