AUGUST 19, 1998
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, August 19, 1998 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police
Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel,
Director of Community Development Napolitano. Absent: None.
Mayor Cuda informed Council Alderman Baird would be participating in this
evening's regularly scheduled Council Meeting through teleconferencing by
speakerphone.
TEN MINUTE PUBLIC INPUT SESSION
Bob Kirschner of the Lakewood Subdivision Homeowners Association addressed
Council noting the homeowners' enjoyment of the Annual Firework's Display, he
presented a check for $100 to the City of McHenry. He requested the $100 be used
to off-set any expenses incurred for the 1999 Fireworks Display. Mayor Cuda and
Council thanked Mr. Kirschner and the Lakewood Subdivision Homeowners
Association for their generous contribution.

AWARD OF BID-WILLIAM H.ALTHOFF PARK WASHROOM/CONCESSION/STORAGE
BUILDING
Director of Parks and Recreation Merkel informed council bids were sought for
the construction of the William H. Althoff Washroom/Concession/Storage Building.
Five bids were submitted and opened on Tuesday, August 4, 1998. The City of
McHenry's 1998-1999 Budget reflects $65,000 for this project. However, the
architect's estimate was $105,196. The low bidder was Carmichael Construction Inc.
of Marengo, Illinois for $98,990. A brief discussion followed regarding the disparity
between the budgeted amount and the submitted low bid amount.

Motion by McClatchey, seconded by Bolger, to award the construction contract
for the William H. Althoff Park Washroom/Concession/Storage Building to Carmichael
Construction Inc. of Marengo, Illinois, in an amount not-to-exceed $98,990.

Mayor Cuda recognized Mr. and Mrs. James L. Althoff in the audience. Mr.
Althoff had donated the property for the William H. Althoff Park in 1991 . Learning of
the project's $23,000 shortfall, Mr. and Mrs. Althoff offered to donate $23,000 to the
City of McHenry to facilitate the completion of this project. A $23,000 check was
then presented to the City of McHenry by Mr. and Mrs. Althoff. Mr. Althoff, noting
his father was once a City of McHenry Alderman, stated his pleasure in being able to
again contribute to his City, which has been good to his family and himself.
ILLINOIS ROUTE 120 IMPROVEMENTS
Mayor Cuda, reminding Council of the Illinois Department of Transportation's
ODOT) notification regarding the imminent Route 120 road improvement project slated
to run through the City of McHenry from Illinois Route 31 west to Charles Road,
introduced Ed Wilson of IDOT. Mr. Wilson, an area programmer, had graciously
agreed to attend this evening's regularly scheduled Council meeting in response to
City Administrator Lobaito's invitation as per Council direction. Mr. Wilson informed
Council the State of Illinois allocated $1 1 .5 million for road improvement projects, of
Those funds, $6 million will directly impact the City of McHenry. In addition to the
Illinois Route 120 improvements, Illinois Route 31 improvements from Route 120
south to High Street, are also scheduled. Mr. Wilson stated these projects are
scheduled in an orderly methodical manner. Regarding the lighting scope and cost
responsibility outlined by IDOT in their August 6, 1998 letter to the City of McHenry,
Mr. Wilson referenced page 12, Section 11 , number 3, paragraphs A and B of the
State Municipal Agreement Policy. Paragraph A states "the total cost of lighting and
energy costs for operation shall be borne by the municipality when the municipality
determines street lighting is to be included in the improvement." Paragraph B states
"the municipality shall be responsible for the cost of modernization and betterment of
street lighting systems it installed or caused to be installed." Sidewalk needs are
shared equally between the municipality and State, except for the removal, not
replacement, of deteriorating sidewalks.
Mr. Wilson also noted the replacement of lost on-street parking spaces may be
shared equally between the State and municipality. Maintenance costs, however, are
fully the responsibility of the municipality. In response to Alderman McClatchey's
inquiry, Mr. Wilson stated he had no explanation as to the tardiness of the Illinois
Department of Transportation's notification regarding the Illinois Route 120 project's
inception and significant associated costs. A lengthy discussion followed.
Mayor Cuda noted again his quarterly attendance at Council of Mayors meetings
where all State and federally funded road projects are discussed. He was notified in
May of this year of the possibility of the Illinois Route 120 road improvement project's
rescheduling for the Spring 1999 construction season. At this time, he was not
informed of any associated costs for this project.
Although the Illinois Department of Transportation is estimating a $750,000
cost to the City of McHenry for lighting replacements as part of the Illinois Route 120
road improvement project, matching funds for traffic signal modernization and
determined sidewalk installation, inflates the total cost to the City of McHenry to
approximately $1 ,000,000. Further discussion followed with Mr. Wilson suggesting
the City of McHenry compose and forward a letter to District 1 Engineer John P. Kos,
P.E., citing the City of McHenry's financial hardship and requesting a meeting to
discuss available alternatives and/or options. In addition, Mr. Wilson will be making
a verbal report of this evening's meeting to his superiors at IDOT.

Mayor Cuda expressed Council's support for the project, however, the financial
burden to be borne by the City of McHenry was unacceptable. Alderman Bolger
supported Mayor Cuda's statement and expressed the City of McHenry's need for
more financial support from IDOT.
Mr. Wilson, referencing the State of Illinois's five year transportation program,
explained, after the five year expenditure by the State of Illinois, totalling millions of
dollars, 3,000 miles of roadway and 800 bridges will still be deficient. Monies
allocated for transportation improvements need also be spent on public transportation
improvements, including Metra, RTA and Pace services. Some discussion followed
`— regarding other local municipalities involved in State roadway improvement projects.
Mr. Wilson suggested Council investigate how the street lights along Route 120 within
the corporate limits of the City of McHenry were installed originally. If IDOT installed
the street lights originally, the total cost for their reinstallation would be borne by
IDOT.
In response to City Attorney McArdle's inquiry, Mr. Wilson stated no process
and/or procedure existed to request a waiver from the State of Illinois. Mr. Wilson
concurred with City Attorney McArdle's suggestion to cite the City's financial hardship
if this project were let in September and scheduled construction for the Spring of
1999. In response to Alderman Murgatroyd's inquiry, Mr. Wilson informed Council
the letters "MYP" stood for "Multi Year Program". Mr. Wilson also recommended the
City of McHenry request this phase of the project beginning at Illinois Route 31 west
to Charles Road be postponed and absorbed as a portion of the proposed later project
phases.
Additional discussion occurred regarding the City of McHenry's plan to improve
the Shamrock Lane and Illinois Route 31 intersection with a traffic signal installation
and lane improvements. Mr. Wilson stated although monies have been allocated for
the project, the project may not in fact be funded. Mr. Wilson noted IDOT's policy to
prohibit the installation of traffic signals which benefit a private thoroughfare. A
lengthy discussion ensued.
Mayor Cuda informed Mr. Wilson the City of McHenry was in receipt of a letter
from IDOT agreeing to the installation of a traffic signal at the intersection of Illinois
Route 31 and Shamrock Lane to the City of McHenry's construction of lane
improvements from Bull Valley Road south to the Shamrock Lane and Illinois Route 31
intersection. Mr. Wilson suggested the City of McHenry rectify the situation and
convert the private street to a public thoroughfare.
Mayor Cuda and Council thanked Mr. Wilson for his attendance and time.
AWARD OF BID - WILLIAM J. ALTHOFF PARK PARKING LOT/UTILITY EXTENSION
Director of Parks and Recreation Merkel informed Council bids were sought for
the parking lot improvements and utility extension for the William H. Althoff Park.
Two bids were submitted and opened on Tuesday, August 4, 1998. The low bidder
was G. Rabine and Sons, Inc. of Spring Grove, Illinois. The bids were tabulated and
reviewed by project engineers, Smith Engineering. Bid costs have slightly exceeded
Smith Engineering's project estimates in three areas:
• Utilities;
• Industrial Drive resurfacing;
• Parking lot alternatives.
City Administrator Lobaito noted, in light of the increased costs, Staff has
elected to exclude the parking lot alternatives, reducing the project's total cost to
$184,475. Some discussion followed regarding the significant difference between the
project's budgeted amount and the bid quotation. Finance Committee Chairman
Alderman Murgatroyd suggested the Parks and Recreation Committee review the Parks
Capital Expenditure Budget and determine what project and/or projects be deferred to
the 1999-2000 Fiscal Year to remain within budget.

Lot Improvements and Utility Extensions for the William H. Althoff Park to the low
bidder, G. Rabine and Sons, Inc. of Spring Grove, Illinois, in an amount not-to-exceed
$184,475.

Mayor Cuda noted the July Treasurer's Report reflected a revenue reserve of
$3.6 million.
AWARD OF QUOTE - WILLIAM H. ALTHOFF PARK FIELD DRAINAGE
Director of Parks and Recreation Merkel informed Council proposals were sent
to nine landscape contractors and excavation companies in July, requesting price
quotations for specified drainage improvements at the William H. Althoff Park. As
only one contractor responded, a revised proposal with a scaled-down version of the
drainage tile system, was again sent to landscape contractors and excavation
companies. Again, only one contractor, Custom Landscaping of McHenry, Illinois,
responded, in an amount of $7,584.50. It is the recommendation of Staff to award
the quote for field drainage improvements at William H. Althoff Park to the contractor
who submitted the lowest proposal, Custom Landscaping of McHenry, Illinois in an
amount not-to-exceed $7,584.50.
Motion by Glab, seconded by Bolger, to award the Field Drainage Improvements
for the William H. Althoff Park to Custom Landscaping of McHenry, Illinois, the lowest
submitted proposal, in an amount not-to-exceed $7,584,50.

In response to Alderman Baird's inquiry, City Administrator Lobaito reassured
Council this drainage work will correct the standing water problem in the William H.
Althoff Park's westernmost corner.
AUTHORIZATION TO SOLICIT QUOTATIONS ON DIVING STAND FOR KNOX PARK
POOL
Director of Parks and Recreation Merkel reported the 1998-1999 Budget
includes $10,000 for the purchase and installation of a three-meter diving stand at
Knox Park Swimming Pool. Staff has selected a unit that can be installed without
extensive renovation to the pool deck prior to the next summer season. Eight different
pool supply companies will be sent price quotation forms on this unit which has an
estimated price of approximately $8,400 to $8,700. Director Merkel requested
Council consider the additional purchase of two diving boards if monies were yet
available after the purchase of the diving stand.
City Administrator Lobaito stated a total cost for the purchase of the diving
stand and boards will be submitted for Council approval.

quotations for the purchase of a three-meter diving stand to be installed at Knox Park
Pool.

MAIN STREET STORM SEWER INVESTIGATION
Director of Public Works Batt reported as per Council direction during
Downtown Revitalization discussions, an engineering proposal from the City's
engineering firm, Baxter & Woodman, was sought, to investigate Main Street drainage
problems. This information is needed prior to further discussion and decision
regarding Main Street Revitalization. Director Batt noted if Council authorized this
work by Baxter & Woodman, and further engineering is required for this project, the
City would be committed to continuing the association with Baxter & Woodman. The
1998-1999 Budget reflects $25,000 for this project.
Motion by Glab, seconded by Murgatroyd, to authorize the employment of City
engineering firm, Baxter & Woodman, to conduct a field investigation of the existing
storm sewers along Main Street east of Illinois Route 31 in an amount not-to-exceed
$4,500.

MAYOR - STATEMENT AND REPORTS
Mayor Cuda reported he and City Administrator Lobaito would be meeting with
the McHenry County Board's Planning and Development Committee to present the
Shamrock Lane and Illinois Route 31 intersection Special Service Area requesting
inclusion of properties located outside the corporate limits of the City of McHenry and
within McHenry County.
COMMITTEE REPORTS
Community Development Committee Chairman Alderman McClatchey reported
the Community Development Committee had met this evening regarding the Gerstad
Builder's advertising sign located at the intersection of Illinois Route 120 and Crystal
Lake Road. A resolution had been presented and agreed upon. Mr. Gerstad will
remove the existing sign at Illinois Route 120 and Crystal Lake Road prior to October
1, 1998 in exchange for the following conditions:
• Installation of two 8' X 8' double-sided advertising signs:
• One to be located at the Crystal Lake Road and Bull Valley Road
intersection;
• The other to be located at the intersection of Draper Road and Bull Valley
Road;
• Each sign will advertise American Heritage Builders and Gerstad Builders homes
with no mention of vehicular entrance via Crystal Lake Road or Dartmoor Drive;
• Permit for placement of these signs shall be renewed on an annual basis;
• To permit the temporary installation of a 4' X 8' sign at the intersection of
Crystal Lake Road and Bull Valley Road advertising American Heritage Homes
to be removed prior to October 1 , 1998;
• A minimum one-time notification of any sign maintenance violations.
A brief discussion followed.
Motion by McClatchey, seconded by Bolger, to recommend the approval of a
sign request permitting two 8' X 8' double-sided signs advertising both Gerstad
Builders and American Heritage Boone Creek Subdivision homes to be renewed on an
annual basis; one to be located at the intersection of Crystal Lake Road and Bull Valley
Road; the other to be located at the intersection of Draper Road and Illinois Route 120
subject to:
• No reference to either Dartmoor Drive or Crystal Lake Road as a vehicular
entrance to the subdivision;
• The removal of the advertising sign at Illinois Route 120 and Crystal Lake Road
no later than October 1 , 1998;
• The installation of a 4' X 8' American Heritage temporary advertising sign at the
intersection of Bull Valley road and Crystal Lake Road to be removed no later

STAFF REPORTS
Director of Community Development Napolitano reminded Council the next
Comprehensive Plan Steering Committee Meeting was scheduled for next Thursday,
August 27, 1998 at 7:30 p.m. here at the Municipal Building. A building permit was
issued this week for Midwest Bank of McHenry County, which is constructing a new
facility on the south side of Bull Valley Road approximately 1/2 mile west of the Bull
Valley Road and Crystal Lake Road intersection. Referencing his memo of August 12,
1998, Director Napolitano noted John Smith is requesting permission to have a
Preliminary and Final Plat of Subdivision reviewed simultaneously by the City. The
City's current Subdivision Control Ordinance requires the approval of a Preliminary Plat
by the Plan Commission and City Council prior to the submittal of a Final Plat and
Engineering Plans. Staff explained the simultaneous review of the Preliminary and
Final Plat of the proposed 11-acre, 13 single family lot subdivision, would permit the
construction and coordination of proposed Green Street improvements in conjunction
with the ongoing Phase 3 Green Street project. In response to Council inquiry, City
Administrator Lobaito stated Staff had no objection to the request. Some discussion
followed with regard to the request to the variance for the proposed cul-de-sac length.
Alderman Baird expressed concern with too rapid a review of the proposed
subdivision, citing the proximity of this development to high quality wetlands. City
Administrator Lobaito stated the Preliminary and Final Plat Review would be as
thorough simultaneously as the review of the Preliminary and Final Plat individually.

review process for the proposed 1 1-acre, 13 single family lot Knox Farm Subdivision,
to John Smith, of Smith Engineering Consultants Inc.

Director of Public Works Batt, noting the imminent start of the Illinois Route 120
project, suggested Council schedule a meeting to discuss the proposed improvements
and the City's position. Public Works Committee Chairman Alderman Bolger
scheduled a Public Works Committee meeting for September 9, 1998 at 7:00 p.m.
Director Batt reported Peter Baker and Sons Company will begin to asphalt the new
Bull Valley arterial tomorrow, Thursday, August 20, 1998.

Director of Parks and Recreation Merkel reported non-resident registration
begins tomorrow, Thursday, August 20, 1998. Director Merkel reported the McHenry
Conservation Bike Path construction is progressing. Preliminary road clearing and
grading will be noticeable throughout McHenry. The Soccer Federation in recent
discussions with Parks and Recreation representatives, has expressed their desire to
donate funds to be used for the purchase of soccer equipment, specifically goals.
Director Merkel stated this donation may reduce the $5,600 expenditure budgeted by
Staff for William H. Althoff Park soccer equipment. The application/resume
submission deadline for the Athletic supervisor deadline was July 15, 1998. Five
candidates have been scheduled for interviews. A recommendation will appear before
Council for formal action sometime during the month of September. Director Merkel
also requested Parks and Recreation Committee Chairman Alderman Baird schedule
a Parks and Recreation Committee Meeting to discuss a variety of issues, specifically
the results and recommendations of Senti & Rubel's Recreational Facility Concept Plan
Analysis. Director Merkel also reminded Council of the invitation from Union Pacific
representatives for the "For the Children" fund raiser to be held at Petersen Park on
Sunday, August 23, 1998 at 9:00 a.m. The Annual Petersen Park Custom Car show
is also scheduled for Sunday, August 23, 1998.
City Administrator Lobaito stated, as per Council direction, a letter had been
sent to McHenry County Highway Transportation Superintendent Michael Magnuson,
requesting barricades on the north side of Bull Valley Road guarding against the steep
detention pond embankment.
City Clerk Althoff requested Council consider establishing Halloween Trick or
Treat Hours. She noted Halloween falls on a Saturday this calendar year. Some
discussion followed.
Motion by McClatchey, to establish official Halloween Trick or Treat hours from
2:30 p.m. to 7:30 p.m. on Saturday, October 31 , 1998.

Alderman Bolger reported he, Northeastern Illinois Planning Commission (NIPC)
representative Bob Kirschner, and City of McHenry Engineering Inspector Dan
Marcinko, inspected the Anne Street drainage ditch area and the Whispering Oaks silt
pond. A previously unknown 24- inch pipe running from Nunda Township was
discovered. Engineering Inspector Marcinko will investigate its source further. NIPC
representative Bob Kirschner will be investigating grant possibilities for additional
monies.
Alderman Glab also noted the increased sediment buildup in Boone Creek near
Oakwood Drive. He requested Staff investigate possible corrections to the buildup.
