At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd. Alderman Baird arrived at 7:35 p.m. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Community Development Napolitano. Voting Nay: None. Absent: Baird. Motion carried. ORDINANCE DESIGNATING PETERSEN FARMSTEAD AS AN HISTORIC LANDMARK Landmark Commission representative Maria Arza was in attendance. Director of Community Development Napolitano informed Council, on the recommendation of the McHenry Landmark Commission, the Petersen Farmstead, located at 4112 McCullom Lake Road, is being presented for Council designation as the first Historic Landmark meeting the criteria of the recently adopted City of McHenry Historic Preservation Ordinance. The farmstead is an excellent example of a fourth generation working farm containing an 1850's Greek Revival style farm house, an 1870's horse barn and granary, and a milk house containing two wooden stave silos. Motion by Bolger, seconded by Glab, to pass and approve an ordinance designating the Petersen Farm Property, located at 4112 McCullom Lake Road, as the first Historic Landmark under the terms and criteria of the recently enacted City of McHenry Preservation Ordinance. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd. Voting Nay: None. Absent: Baird. Motion carried. Mayor Cuda informed Council the property will be plaqued on Sunday, September 20, 1998 at 1 :00 p.m. Alderman Baird arrived at 7:35 p.m. ANNEXATION OF PETERSEN FARM PROPERTY - 4112 MCCULLOM LAKE ROAD City Administrator Lobaito informed Council although Governor Edgar has approved the Annexation of FAP 420 right-of-way, located within the Petersen Farm Property, written approval has not yet been received by the City of McHenry. The Agenda Item was withdrawn from Council consideration during this evening's regularly scheduled Council Meeting. Mayor Cuda noted written approval was anticipated within the next two weeks. Therefore, Annexation of this property will be presented for Council consideration at that time. ANNEXATION OF HICKORY CREEK FARM PROPERTY - 4400 LAKESHORE DRIVE Director of Community Development Napolitano informed Council the City of McHenry purchased property in 1995 located outside its corporate limits in association with the acquisition of open park space. State of Illinois Statutes permit a municipality to annex uninhabited municipally-owned properties which are contiguous to its corporate boundaries by passing an ordinance. A portion of this city-owned property is located within the corporate boundaries of the Village of McCullom Lake. The City of McHenry has made attempts to de-annex this portion of the property from the Village of McCullom Lake, however, has been unsuccessful to date. An ordinance annexing the eight acres located on the south side of McCullom Lake Road within McHenry County has been prepared by Staff for Council consideration. Upon annexation, the eight acre property would be zoned E Estate District. As parks, playgrounds, forest preserves, wildlife sanctuaries, and other publicly-owned open spaces are permitted in the E Estate District, the property's current use as an equestrian facility is a permitted use in the E Estate District. September 16, 1998 Page 5 Motion by McClatchey, seconded by Murgatroyd, to pass and approve an ordinance Annexing approximately eight acres located on the south side of McCullom Lake Road approximately 1 ,500 feet north of Petersen Park Road in McHenry Township, to the City of McHenry. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird, Cuda. Voting Nay: None. Absent: None. Motion carried. LETTER OF AGREEMENT WITH SCHOOL DISTRICT 156 - POLICE LIAISON OFFICER PROGRAM City Administrator Lobaito informed Council the City of McHenry since 1996 has entered into an Annual Agreement with McHenry High School District 156 to provide a Police Liaison Officer for assignment to McHenry East and West High School Campuses. The cost of the officer is determined by averaging the salary and benefits of a first year officer and a fifth year officer, with High School District 156 paying 70% of this averaged cost. The average annual cost for the 1998-1999 school year is $46,904. McHenry High School District's 70% portion totals $32,833, which will be paid to the City of McHenry in equal installment payments over the next nine months, beginning September 30, 1998. Officer Daniel Kreassig, who served as the Police Liaison Officer in 1996-1997 and 1997-1998, is being replaced this year by Officer Gregory Hatter. City Administrator Lobaito noted the addition of a 30-day written termination clause citing the Police Department's current understaffed position. Motion by Murgatroyd, seconded by Glab, to authorize the Mayor and City Clerk's execution of the Police Liaison Program Agreement, between the City of McHenry and McHenry High School District 156 for the 1998-1999 school year effective immediately. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. Alderman Glab expressed the hope the City of McHenry would one day be able to provide a Liaison Officer to staff each high school building. INTERGOVERNMENTAL AGREEMENT WITH SCHOOL DISTRICT 15 City Administrator Lobaito reported in 1993 the former Council began negotiations with Elementary School District 15 for an Intergovernmental Agreement to transfer ownership of a six-acre parcel of property for the purpose of constructing a school and related facilities. The six acres in question were originally deeded to the City of McHenry in 1992 as part of the Backhaus Brackmann Annexation Agreement. In the event McHenry Elementary School District 15 fails to construct and occupy the school improvements on the subject property on or before December 31 , 2011 , title to the subject property shall automatically revert back to the City of McHenry. In addition, the City of McHenry may also utilize the property for temporary parking lots, playgrounds, and/or athletic fields prior to any construction of school improvements. Any temporary improvement by the City of McHenry on the subject property shall expire 180 days after written notice to the City of McHenry by elementary School District 15. The City of McHenry and Elementary School District 15 have non- exclusive access easements over each other's property and improvements. The general public will have use of the parking facilities when utilizing the playground areas and athletic fields. City Administrator Lobaito apologized for the lengthy delay, citing survey difficulties due to the realignment of the Dartmoor Road extension. The six acre subject parcel is adjacent to the Dartmoor Extension. September 16, 1998 Page 6 In response to Alderman Glab's inquiry, City Administrator Lobaito stated the Intergovernmental Agreement does not commit the City of McHenry to any maintenance obligations. Motion by Glab, seconded by Bolger, to authorize the Mayor and City Clerk's execution of the Intergovernmental Agreement and any associated documents, between the City of McHenry and McHenry Elementary School District 15 transferring six acres of property located on the south side of Dartmoor Drive for the purpose of i constructing a school and school improvements. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. SALE OF SURPLUS PROPERTY - 1115 NORTH RIVER ROAD City Administrator Lobaito reported the 1115 North River Road property was purchased in 1996 to facilitate the construction of a lift station for the sanitary sewer extension east of the Fox River. It was the stated intent of Council the sell the property upon the completion of the lift station construction. All proceeds would be credited back to the Water Sewer Capital Development Fund. Bids were sought for a September 1 , 1998 opening. Twenty-seven packets were mailed to potential bidders, with only one bid submitted by Rusty DeBuck of McHenry in the amount of $154,800. State Statutes require a minimum bid of 80% of the appraised value for municipal property. The subject property's appraised value was $191 ,000. Mr. DeBuck's offer of $154,800 exceeds the 80% minimum acceptable bid requirement. In accordance with the bid specifications, Mr. DeBuck submitted an earnest money deposit of $10,000 within ten days of the September 1 , 1998 bid opening. In response to Council inquiry, Staff noted the original purchase price of the 1115 North River Road property was $205,000. AWARD OF BID - 1998 STREET PROGRAM Director of Public Works Batt informed Council bids were sought and received for the 1998 Street Program on Tuesday, September 8, 1998 at 1 1 :00 a.m. Four bids were received with Curran Contracting Company of Crystal Lake, Illinois, the low bidder in the amount of $87,449.80. Director of Public Works Batt noted the submitted bid was approximately $7,000 under the project's estimated cost. In response to Council inquiry, Director Batt noted the 1998 Street Program consisted of repaving and milling the Municipal Building Parking Lot and resurfacing Riverside Drive, south of Illinois Route 120. PURCHASE OF DIVING STAND FOR KNOX PARK POOL Director of Parks and Recreation Merkel reported the 1998-1999 Budget allocated $10,000 for the purchase of a three-meter diving stand for Knox Park Pool. Council at its August 19, 1998 regularly scheduled meeting, authorized Staff to solicit price quotations for the purchase of the three-meter diving stand. Proposals were sought and submitted on September 8, 1998. Five quotations were received, with the low quotation Recreonics Aquatic Pool Supply Company of Louisville, Kentucky, in the amount of $8,392.08. Director Merkel noted the diving stand will be installed on the south side of the deep end diving well, which is the same location as the original three-meter stand. The equipment will be delivered within thirty days of receipt of the City of McHenry's purchase order. Installation will not require extensive deck renovation, as the new stand uses an eight point deck anchoring system. MAYOR - STATEMENT AND REPORTS Mayor Cuda reported he attended the Tuesday, September 15, 1998 Village of Johnsburg Council Meeting. The proposed Border Agreement between the City of McHenry and the Village of Johnsburg was generally discussed. It was stated some revisions have been made to the document and require further review by the City of McHenry. In response to Mayor Cuda's request, an Ad Hoc Committee Meeting was scheduled for Thursday, September 24, 1998 at 6:30 p.m. in the Aldermen's Conference Room of the Municipal Building. A copy of the proposed revisions will be provided the Ad Hoc Committee prior to Thursday's 6:30 p.m. meeting. Mayor Cuda also informed Council he, City Administrator Lobaito, and City Attorney McArdle, had met with Donald and Roger Gerstad regarding the proposed Annexation of the Diedrich Farm, east of the Fox River. Concerns raised by Council at the August 24, 1998 Special Meeting were addressed and agreed upon. Increases in Developer Donation and Tax Lag Fees, requested by High School District 156 and Elementary School District 15, were made. The original concept plan presented to Council for consideration has been amended and includes the depiction of detention areas. Mayor Cuda requested Council consider devoting most of the regularly scheduled September 30, 1998 Council Meeting to further discussion regarding the proposed Diedrich Farm Annexation. Some discussion followed. In response to Council inquiry, City Administrator Lobaito noted a response from the Illinois Department of Transportation regarding future plans for FAP 420 right-of- way should be received prior to the September 30, 1998 regularly scheduled Council Meeting. Some discussion followed with regard to High School District 156 negotiations with the Gerstads for the purchase of a school site. It was the consensus of Council to devote most of the regularly scheduled September 30, 1998 Council Meeting to the proposed Diedrich Farm Annexation by Donald and Roger Gerstad. September 16, 1998 Page 8 Mayor Cuda concluded his report informing Council he and City Administrator Lobaito had met with representatives from Eagle Home Development regarding the proposed Annexation of 330 acres of property for a 1,400 unit residential development. The property is located south of Bull Valley Road on Barreville Road and is commonly known as the Budreck Property. COMMITTEE REPORTS _ Finance Committee Chairman Alderman Murgatroyd reported the Finance Committee had met on Tuesday, September 15, 1998 to review the 1997-1998 Audit, the City of McHenry's current bonding status, and review a Banking Services Request for Proposal. The Revolving Loan Committee had met this evening, Wednesday, September 16, 1998 at 6:30 p.m. prior to this evening's regularly scheduled council Meeting to review a loan application from Joseph Rubino of D & J Automotive Inc. The minutes of this meeting will be forthcoming. In addition, it will be the recommendation of the Revolving Loan Committee to approve a $50,000 revolving loan to Joseph Rubino of D & J Automotive, Inc. STAFF REPORTS Director of Public Works Batt reported, although Green Street at Bull Valley Road has been reopened, Bull Valley Road east of Route 31 will be closed effective Tuesday, September 29, 1998. The road closures are required as part of the Green Street Phase III and Bull Valley Arterial Road projects. City Attorney McArdle reported the Illinois Commerce Commission Hearings scheduled for December 8, 9, and 10, 1998 at the Municipal Building, may permit audience comment at the end of the entire proceeding, during the final day of testimony. Under normal circumstances, public input is not permitted. In addition, arrangements have been made with McHenry High School District 156 East Campus, to host the Wednesday, December 9, 1998 ICC Hearing procedures, as McHenry County Circuit Court utilizes the Municipal Building's Courtroom Facilities. Alderman Baird requested Council direct Staff to send a letter to all McHenry Shores Water Company clients regarding the scheduled hearings. Some discussion followed. It was the consensus of Council to direct Staff to send an informative letter to all McHenry Shores Water Company clients located within the corporate limits of the City of McHenry regarding the Illinois Commerce Commission Hearings at the McHenry Municipal Building scheduled for December 8, 9, and 10, 1998. City Administrator Lobaito requested Council approve his request to attend the Annual Illinois City Managers Association Conference in Florida form October 22, 1998 through October 27, 1998. A brief discussion followed.
