OCTOBER 14, 1998
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, October 14, 1998 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police
Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director
of Community Development Napolitano. Absent: None.
Director of Parks and Recreation Merkel introduced newly-hired Athletic
Supervisor Michael Perkins. Council welcomed Mr. Perkins to the City of McHenry
Staff and extended their best wishes for a mutually beneficial association.
TEN MINUTE PUBLIC INPUT SESSION
Maynard Hirsch of Merlin Muffler and Brake Shop, located at 3920 West Elm
Street in McHenry, addressed Council, thanking the Mayor and City Council for their
past support of Merlin's Annual Snug Hugs for Kids Charity Clothing Drive. Mr. Hirsch
noted from November 2, through December 10, 1998, the McHenry Merlin Muffler
and Brake Shop will be requesting residents to donate new and like-new winter
clothing for the needy children and their families served by the Children's Home and
Aid Society of Illinois. Mayor Cuda noted the Consent Agenda included a
Proclamation declaring Snug Hugs for Kids Weeks in the City of McHenry from
November 2, 1998 through December 10, 1998.

APPROVAL OF ANNUAL CHRISTMAS PARADE
James Humbard of the McHenry Area Jaycees addressed Council requesting
approval of the Annual City of McHenry Christmas Parade route on Sunday, November
8, 1998, co-sponsored by the Riverside Area Business Association and the McHenry
Area Jaycees. The Parade Route begins at Edgebrook School on Kane Avenue,
proceeds east to Green Street, north on Green Street, crossing Route 120 to Pearl
Street, and east on Pearl to Riverside Drive. The Riverside Area Business Association
and McHenry Area Jaycees are not requesting a street closure for Riverside Drive. Mr.
Humbard requested instead the closure of parking spaces along Veteran's Memorial
Park on Park Street, between Pearl and Broad Street. He explained the parking spaces
would be reserved for motorcycle parking, U.S. Marine Corps vehicles display, and
Toys for Tots collection vehicles.
In response to Alderman McClatchey's inquiry, Mr. Humbard noted the Parade
will begin at 1 1 :30 a.m. The McHenry Area Jaycees are anticipating 100 motorcycle
participants this year.
Motion by Glab, seconded by Murgatroyd,to approve the Annual McHenry Area
Jaycees and Riverside Area Business Association Christmas Walk and Parade
scheduled for Sunday, November 8, 1998, beginning at 1 1 :30 a.m. with the following
route:
Beginning at Edgebrook School on Kane Avenue, proceeding east
to Green Street, north on Green Street, crossing Route 120 to
Pearl Street, and east on Pearl to Riverside Drive;
and to authorize the closure of the parking spaces located on Park Street along
Veteran's Memorial Park between Pearl and Broad Streets between the hours of 10:00
a.m. and 4:00 p.m.

CITY BANKING SERVICES - AUTHORIZATION TO REQUEST FOR PROPOSALS
City Treasurer David Welter was in attendance.
City Administrator Lobaito informed Council the Finance Committee at its
September 15, 1998 Committee Meeting voted to recommend to full Council the
authorization of Staff to solicit Requests for Proposal for City Banking Services
including, but not limited to, credit card usage, automatic account debiting and direct
deposit availability. City Administrator Lobaito stated with the recent influx of new
financial institutions locating within the corporate limits of the City of McHenry, an
opportunity to seek competitive proposals for banking services has been provided.
Currently, banking services are provided the City of McHenry by First Midwest Bank.
It is also the recommendation of Staff to request new bids every four years to coincide
with the Mayoral Election.
City Administrator Lobaito also noted the Request for Proposal document was
prepared with the assistance of City Treasurer David Welter. —
Motion by McClatchey, seconded by Murgatroyd, to authorize Staff to solicit
Requests for Proposal for city banking services, including, but not limited to, credit
card usage, automatic account debiting, and direct deposit availability.

WATSON WYATT PROPOSAL - POLICE PENSION FUND ACTUARIAL SERVICES
City Administrator Lobaito informed Council as of 1991, the City of McHenry
has retained the actuarial firm of Watson Wyatt, to evaluate the assumptions and
appropriateness of the Illinois Department of Insurance figures. The Illinois
Department of Insurance annually provides municipalities with tax levy requirements
for Police Pension Funds in accordance with the Illinois Pension Code. This year,
however, the Illinois Department of Insurance, figures are not yet available, and will
not likely be available until November of 1998, due to the upgrading of their computer
system. In the past, the actuarial study of Watson Wyatt has always proven their
calculated Pension Fund contribution to be lower than the calculated contributions of
the Illinois Department of Insurance. It is therefore Staff's recommendation to
authorize the City Administrator's execution of the Watson Wyatt Proposal in an
amount not-to-exceed $4,900.
In response to Council inquiry, the scope of services provided by Watson Wyatt
in the proposed actuarial study include:
• Discussions with City Staff to determine specifications for valuation of funds
and projection of benefits, liabilities, and assets.
• Determination of validity of State assumptions and, if either too conservative
or too liberal, determination of appropriate assumptions for actuarial valuation
purposes.
• Computation of funding and cost requirements utilizing both entry-age-normal
cost and projected unity credit funding methods.
• Formal reportto satisfy State and local requirements (including GASB Statement
No. 25 and No. 27 requirements) and to elaborate on the results of the Study.
• Presentation to the City on the results of the Study.
In response to Alderman Murgatroyd's inquiry, City Administrator Lobaito noted
Watson Wyatt is an independent consulting firm. City Administrator Lobaito also
assured Council, if the calculated contributions of the Illinois Department of Insurance
are lower than the calculated contributions by Watson Wyatt, the lower figures will
be utilized by the City of McHenry for calculation and reporting purposes.
Motion by Murgatroyd, seconded by Baird, to authorize the City Administrator's
execution of the Watson Wyatt Proposal as presented in an amount not-to-exceed
$4,900.

REQUEST FOR PROPOSALS - PAVEMENT MANAGEMENT
Director of Public Works Batt informed Council the 1998-1999 Budget reflects
monies for a pavement program. Council has discussed the development of such a
program in 1995 and again in 1996. Each year, City Engineering consulting firm,
Baxter and Woodman, presented a program proposal on a not-to-exceed $50,000
basis. Director Batt reported he and City Inspector Dan Marcinko recently visited the
Village of Mount Prospect which has a Pavement Management Program in place
developed by Infrastructure Management Services (IMS) of Arlington Heights, Illinois.
Mount Prospect has utilized IMS Services for 15 years and expresses complete
satisfaction. Requests for Proposals were therefore sought from City Engineering
_ consulting firm, Baxter and Woodman, Infrastructure Management Services of
Arlington Heights, Illinois, as well as, a second engineering firm, Hampton, Lenzini and
Renwick, whose project services the City of McHenry has utilized in the past.
Hampton, Lenzini and Renwick declined to submit a proposal. The Baxter and
Woodman Proposal was substantially more expensive than Infrastructure Management
Services. However, that is to be expected as pavement management is an ancillary
service for engineering firm, Baxter and Woodman; whereas, pavement management
is the primary function of Infrastructure Management Services, Inc. Infrastructure
Management Services Inc.'s Pavement Program Proposal offers the following services:

• Project initiation and section reviewing;
• Service condition surveys;
• Deflection testing;
• Pavement Management Reports;
• Video logging of street network;
• Presentation of results and project reporting.
The street surface condition survey will help delineate streets and/or roadways whose
useful life might be extended with resurfacing.
Mayor Cuda expressed reservations regarding potential hidden costs. He
requested further clarification regarding optional services and future services and
suggested equipment purchases, as delineated in the Infrastructure Management
Services Inc. Proposal. Further discussion followed.
Motion by Glab, seconded by Baird, to authorize the Mayor's execution of the
Engineering Agreement as presented with Infrastructure Management Services Inc. of
Arlington Heights, Illinois, at a cost not-to-exceed $41 ,925.
Alderman Bolger requested an opportunity to continue the discussion. He
opined the current City of McHenry Public Works Staff was more than capable of
designating those streets and roadways in need of repair. Some discussion followed
regarding the need for a formal Pavement Management Program.
In response to Alderman McClatchey's inquiry, neither Council nor Staff were
aware of any association between Infrastructure Management Services Inc. and the
IMS firm under investigation for alleged political campaign misconduct associated with
Governor Edgar's office. A lengthy discussion followed.
Motion by McClatchey, seconded by Glab, to withdraw the previous motion and
to table the consideration and approval of the Engineering Agreement with
Infrastructure Maintenance Services Inc., of Arlington Heights, Illinois, until the next
regularly scheduled Council Meeting, October 21 , 1998.

Council directed Staff to investigate any potential association and inform
Council of their discovery.
MAYOR - STATEMENT AND REPORTS
There was no Mayor's Statement or Report.
COMMITTEE REPORTS
Finance Committee Chairman Alderman Murgatroyd reported the Finance and
Personnel Committee voted to recommend to full Council the approval of the Job
Description as presented for a new Administrative position. Although approval would
normally be sought at the next regularly scheduled Council Meeting, advertising copy
schedules require immediate consideration and approval by Council. Alderman Baird
noted the Finance Committee had unanimously recommended this approval. Alderman
Glab requested Council review and approve the job ad prior to its general release.
City Administrator Lobaito noted the ad can be submitted and withdrawn prior
to publication if Council disapproves of the ad as presented.
Finance Committee Chairman Alderman Murgatroyd summarized the
Committee's discussion regarding the position's title, Administrative Services Director
and/or Assistant Administrator. He noted the position's responsibilities and duties
would be a combination of finance, personnel, and backup administration.

Motion by Baird, seconded by McClatchey, to approve the job description of the
Administrative position as recommended by the Finance Committee at its October 14,
1998 Meeting.

Some discussion followed regarding the job title for this specific job description.
City Administrator Lobaito cautioned Council the title "Assistant Administrator" may
not solicit the appropriate candidates having the desired background in finance and
personnel.
Motion by Bolger, seconded by Glab, to entitle the previously approved job
description "Assistant Administrator".

Parks and Recreation Committee Chairman Alderman Baird reminded Council a
Parks and Recreation Committee Meeting was scheduled for tomorrow, October 15,
1998 at 7:00 p.m. in the Aldermen's Conference Room.
STAFF REPORTS
Director of Community Development Napolitano reported twenty applications
had been submitted for the Code Compliance Officer vacancy created by the
resignation of Michael Albertini. A replacement recommendation will be forthcoming.
Director of Parks and Recreation Merkel reported the application deadline for the
Recreation Supervisor vacancy was September 30, 1998. Interviews are being
conducted and a recommendation will appear before Council sometime in November.
Director Merkel also reported the Althoff Park improvements have begun in earnest.
Chief of Police Joyce reported the newly-hired dispatcher started Monday
October 12, 1998. The City of McHenry's newest police officer will complete
instruction at the Police Academy and be brought before Council for introduction,
sometime within the month of November.
City Administrator Lobaito reported an informational meeting for affected
property owners regarding the Route 31/Shamrock Lane Special Service Area will be
scheduled for early November. A formal Meeting Notice will be posted in the event
Council chooses to attend. In addition, Mayor Cuda, City Attorney McArdle, and he
attended a McHenry County Planning and Development Committee Meeting. The
County's permission is needed in order to establish the Special Service Area as several
properties proposed for the Special Service Area fall outside the City of McHenry
Corporate Limits and within the corporate limits of McHenry County. The matter will
be considered by the County Board at its next regularly scheduled meeting, October
20, 1998. The Board has requested an Agreement between the City of McHenry and
McHenry County be executed guaranteeing the County's reimbursement for any
expenses the County may incur in regard to the establishment of the Special Service
Area. City Administrator Lobaito requested Council approve the Mayor's execution of
this agreement. Some discussion followed.

Motion by Murgatroyd, seconded by McClatchey, to authorize the Mayor's
execution of an Intergovernmental Agreement between the City of McHenry and
McHenry County, holding McHenry County harmless for any expenditures incurred
with regard to the Shamrock Lane/Route 31 intersection Special Service Area.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.

NEW BUSINESS
Alderman Glab expressed concern regarding the speed limit discrepancy on Bull
Valley Road between Crystal Lake Road and Route 31 , noting in some areas the speed
limit varies from 35 mph to 55 mph He opined the limit should be a consistent 45
mph. He requested a letter be sent to the County requesting same. Staff indicated
their compliance and stated a letter will be sent.
In response to Alderman Glab's inquiry regarding Council's further consideration
of the Diedrich Farm/Gerstad Annexation, Staff noted a Committee of the Whole
Meeting has been scheduled for Wednesday, October 21 , 1998, directly after the
regularly scheduled Council Meeting. Alderman Glab inquired whether two concept
plans will be presented: one including the high school piece, and one excluding the
high school piece. City Attorney McArdle stated only one concept plan, the one
presented originally, will be considered.
Alderman Murgatroyd noted density will be addressed via the Annexation
Agreement requiring a specified number of lots per acre. In response to Alderman
Baird's request, City Administrator Lobaito noted the developers will be invited to
attend the Committee Meeting, however, will not participate unless requested by
Council.
In response to Alderman Baird's request, Staff will provide him with a full
accounting of the water problem on Loch Glen.
Alderman Murgatroyd requested a Finance Committee Meeting be scheduled for
October 29, 1998 to discuss a Personnel Issue. Council concurred.
