HomeMy WebLinkAboutMinutes - 11/04/1998 - City Council REGULAR MEETING NOVEMBER 4, 1998 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, November 4, 1998 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Baird. Absent: Murgatroyd. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Community Development Napolitano. Absent: None. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minutes of Public Input. PUBLIC HEARING -ANNEXATION, ZONING AND PRELIMINARY PLAT- KRESSWOOD TRAILS Mayor Cuda opened the Public Hearing on the Kresswood Trails Annexation, Zoning and Preliminary Plat of Subdivision at 7:31 p.m. Noting the Petitioners had requested the Public Hearing be rescheduled, Mayor Cuda, with Council concurrence, continued the Kresswood Trails Annexation, Zoning, and Preliminary Plat Approval to the next regularly scheduled Council Meeting, Wednesday, November 11 , 1998 at 7:30 p.m. PRESENTATION : MCHENRY POLICE DEPARTMENT "DO THE RIGHT THING" PROGRAM RECIPIENTS Sergeant William J. Brogan of the McHenry Police Department addressed Council explaining a new program called "Do The Right Thing" had been launched by the City of McHenry Police Department. The Program rewards people of all ages for doing a good deed. Each month four recipients will be acknowledged and rewarded. Recipients are selected from applications submitted by persons affected by or noticing the good deed. Applications are reviewed by the "Do The Right Thing" Board of Directors. Sergeant Brogan introduced the "Do The Right Thing" Board of Directors: Carol Chrisman, David Maire, William Clow, William Busse an Pat Sciluffo. Each recipient received a $100 savings bond, dinner for four at McDonald's and a "Do The Right Thing" certificate. Sergeant Brogan noted all items have been donated and are of no cost to the City. Sergeant Brogan and Mayor Cuda acknowledged the following four "Do The Right Thing" recipients and their nominating entity: • Kim Capps, of Wonder Lake, Illinois, nominated by Mary Rossi of McHenry; • Joe Bellino, of McHenry, Illinois, nominated by his sister, Josie Gluesing, of McHenry, Illinois; 0 Chris Dixon, of McHenry, Illinois, nominated by Sergeant Kenneth Prazak of the McHenry Police Department; • Henry Kenyon, of McHenry, Illinois, nominated by his wife. Mayor Cuda presented each recipient with their certificate and savings bond. He expressed his and the Council's congratulations to each of the recipients. In addition, he acknowledged the Police Department's efforts to honor acts of kindness to members of the McHenry Community. CONSENT AGENDA Alderman Glab requested Item No. 3, the Conditional Use Ordinance permitting an Open Sales Lot for the Sale of Motor Vehicles on the property located at 3925 West Elm Street and 1 109 North Front Street be withdrawn from the Consent Agenda for individual consideration. Motion by Baird, seconded by McClatchey, to pass an ordinance providing for the granting of a Conditional Use Permit to allow an Open Sales Lot for the Sale of _ Motor Vehicles on the property located at 3925 West Elm Street and 1109 North Front Street, conditioned upon the following: • Developer to install a privacy fence along the south property line of 1 109 North Front Street within the next twenty four months; • Developer to consult with the Main Street Downtown Revitalization Committee regarding the type and height of fence to be installed. Voting Aye: Bolger, McClatchey, Baird. Voting Nay: Glab. Absent: Murgatroyd. Motion carried. APPROVAL OF ORDINANCE ANNEXING 0.427 ACRES WEST OF ADAMS OUTDOOR POWER EQUIPMENT City Administrator Lobaito reminded Council Adams Outdoor Power Equipment, located at 2103 West Route 120 was annexed to the City of McHenry in 1995 as part of the East of the River annexation process. The property was rezoned to C5-Highway Commercial with a Conditional Use Permit for Outdoor Sales, Display and Storage. In conjunction with Phase II of the East McHenry Bypass, McHenry County recently acquired the eastern 75 feet of Adams Outdoor Power Equipment property for right-of-way. In exchange for the eastern 75 feet, McHenry County gave Adams Outdoor Power Equipment property owners a similar piece located adjacent to the property's western boundary. This parcel is currently located in unincorporated McHenry County and must be annexed to the City of McHenry and rezoned to C5 Highway Commercial with a Conditional Use Permit for Outdoor Sales, Display and Storage. Staff is recommending Council pass an ordinance annexing the property and direct Staff to prepare the necessary Zoning Board of Appeals application materials and schedule a Public Hearing to rezone the property C5 Highway Commercial with a Conditional Use Permit for Outdoor Sales, Display and Storage to match the existing November 4, 1998 Page 4 zoning of Adams Outdoor Power Equipment. In addition, Staff is requesting all fees associated with the annexation, rezoning and conditional use permit be waived as the land swap facilitates the Phase II East McHenry Bypass project. Motion by Baird, seconded by Bolger, • To pass an ordinance annexing approximately 0.427 acres of property owned by Richard and Rita Adams, located on the south side of State Route 120 at Chapel Hill Road, and west of Adams Outdoor Power Equipment; • To direct Staff to prepare the necessary Zoning Board of Appeals Petition and Application materials; • To direct Staff to schedule a Public Hearing to rezone the recently annexed property to C5 Highway Commercial with a Conditional Use Permit for Outdoor Sales, Display, and Storage; and • To waive all associated fees with the annexation, rezoning, and conditional use permit application. Voting Aye: Bolger, Glab, McClatchey, Baird, Cuda. Voting Nay: None. Absent: Murgatroyd. Motion carried. In response to Alderman McClatchey's inquiry, City Administrator Lobaito noted Phase II of the East McHenry Bypass is scheduled to begin immediately and be completed in the summer of 1999. MAYOR - STATEMENT AND REPORTS Mayor Cuda informed Council a Liquor Hearing was currently being conducted by the City of McHenry Liquor Commission. A local establishment violated not only local ordinances, but state statutes as well. The Commission can revoke and/or —� suspend the establishment's liquor license. The Hearing will conclude sometime next week. Mayor Cuda also reported written comments had been received form both Elementary School District 15 and High School District 156 regarding the proposed Diedrich Farm Annexation. These comments will be forwarded to Roger and Donald Gerstad and Council, along with the latest draft of the proposed Annexation Agreement. Mayor Cuda noted the Gerstads have recently expressed an interest in researching the feasibility of annexing to the municipality directly east of the City of McHenry. In addition, this municipality is investigating extending their wastewater and water infrastructure to their westernmost boundary at Chapel Hill Road. Some discussion followed. In response to Alderman Glab's inquiry, Mayor Cuda acknowledged, although the Diedrich Farm property is currently located within the City of McHenry's Facility Planning Area, it appears a tentative compromise has been reached regarding the abolishment of Facility Planning Areas. Current Facility Planning Areas will remain in place for approximately 3-5 years. Thereafter, all Facility Planning Areas will be abolished. Mayor Cuda also noted if McHenry High School District 156 is successful in establishing the northwest corner of Chapel Hill Road and Lincoln Road as a school site, both water and sewer services will be required. The proposed Gerstad's Diedrich Farm annexation will appear before Council for final consideration sometime later this month. COMMITTEE REPORTS Parks and Recreation Committee Chairman Alderman Baird reported the Parks and Recreation Committee Meeting Minutes from the October 15, 1998 meeting will be provided for Council review in Friday's Agenda Packet. The next Parks and Recreation Committee Meeting was scheduled for November 17, 1998 at 7:00 p.m. in the Aldermen's Conference Room. A joint meeting of the Parks and Recreation November 4, 1998 Page 5 Committee and the Finance Committee was tentatively scheduled for November 24, 1998 at 7:00 p.m. in the Aldermen's Conference Room. The Agenda of the Joint Committee Meeting will include consideration of returning the mowing responsibilities of municipal property to the Parks Department. Public Works Committee Chairman Alderman Bolger clarified the Public Works Committee had unanimously agreed not to recommend acceptance of the Shamrock Lane Circle from the Cunat Brothers unless the required public improvements are made, or a significant cash contribution is made, from the Cunat Brothers to offset the construction costs of these improvements. STAFF REPORTS There were no Staff Reports. NEW BUSINESS In response to Alderman Baird's inquiry, City Administrator Lobaito reported no City of McHenry Police Department Officers were hurt in conjunction with the liquor hearing violations. Alderman Baird requested Council to direct Staff to further investigate the feasibility of correcting the drainage problem on Loch Glen Lane. He noted a potential solution in conjunction with the development of the adjacent 6-acre parcel was discussed. Alderman Bolger reported local business entity Medela Corp. conducted their formal ground-breaking ceremonies this morning in preparation of their 134,000 square foot new building. City Administrator Lobaito then provided Council with an update regarding the McHenry Corporate Center build-out. He noted Brake Parts Inc. proposed expansion of approximately 350,000 square feet will exhaust the remaining property with the exception of two small 6-acre parcels. The proposed expansion will require a McHenry Corporate Center Concept Plan revision. These revisions are tentatively scheduled for review at the regularly scheduled November 23, 1998 Council Meeting. In response to Alderman Glab's inquiry, Mayor Cuda directed Staff to review and summarize Council action with regard to acceptance, maintenance. and status of Devonshire Court. This information shall be provided to Council in the November 6, 1998 Agenda Packet.
