HomeMy WebLinkAboutMinutes - 07/09/1997 - City Council (2) REGULAR MEETING JULY 9, 1997 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, July 9, 1997 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Baird. Alderman Murgatroyd arrived at 7:40 P.M. Absent: None. City Staff in attendance were: City Clerk Althoff, City Attorney McArdle, Director of Building and Zoning Lobaito, Director of Public Works Batt, Director of Parks and Recreation Merkel. Absent: Chief of Police Joyce. TEN MINUTE PUBLIC INPUT SESSION Judith Gertz of 1718 Leonard Avenue, McHenry, addressed Council requesting Council return the permanently parked dump truck to Leonard Avenue prohibiting Olde Mill Ponds cut-through traffic. She noted with the onset of Fiesta Days activities at Petersen Park, traffic through the as yet unoccupied subdivision will increase. After some discussion, Council instructed Director of Public Works Batt to return the dump truck to Leonard Avenue for the duration of Fiesta Days. CONSENT AGENDA Motion by Baird, seconded by Bolger, to approve the Consent Agenda as follows: (1) June 25, 1997 Special City Council Meeting Minutes; (2) June 25, 1997 Regular City Council Meeting Minutes; (3) Request from Jill McCarthy to block off North Drive for party on 7/20/97; (4) Final Payment to Moody's Investors Service in the amount of $8,275 associated with issuance of 1997 $5.2 million G.O. PRESENTATION BY BOB KIRSCHNER OF NORTHEASTERN ILLINOIS PLANNING COMMISSION ON THE McCULLOM LAKE RESTORATION AND PROTECTION PROGRAM Robert Kirschner, Northeastern Illinois Planning Commission Environmental Planner, was in attendance. Mr. Kirschner informed Council he was seeking approval for the implementation of a cooperative partnership under the Clean Lakes McCullom Lakes Phase II Project among the City, the Northeastern Illinois Planning Commission and the McHenry County Defenders. Funding in the amount of $6,500 will be provided via the Clean Lakes Program Grant. Alderman Murgatroyd arrived at 7:40 p.m. July 9, 1997 Page 2 As presented at the June 11, 1997 regularly scheduled Council meeting, the USEPA and the IEPA wished to extend the Clean Lakes Grant with the City of McHenry until June, 1998, to augment activities in the approved McCullom Lake Restoration and Protection Program. One of the important components would be the creation and implementation of a public education program on lake quality protection, specifically for lake front and water shed residents. A McHenry County Defenders summer intern would be assembling documents, brochures and additional information on septic system maintenance for distribution and inclusion in a homeowners kit. The homeowners kit would also include septic system-friendly fixtures. Mr. Kirschner stated the proposed public education program would utilize approximately $2,500 in grant funds for distribution/copying of the informational brochures and another $4,000 would be utilized for a cost share assistance to lake front property owners for design and installation of ecologically-sensitive bio-engineering approaches for lake shoreline erosion protection. Mr. Kirschner noted there is no additional cost to the City of McHenry. Motion by Glab, seconded by McClatchey, to approve the allocation of $6,500 from the Clean Lakes Grant monies for the creation and implementation of a lake quality protection educational program under the cooperative partnership among the City of McHenry, the Northeastern Illinois Planning Commission and the McHenry County Defenders. SEMI-ANNUAL DISTRIBUTION OF DEVELOPER DONATION FUNDS TO TAXING DISTRICTS Arlene Kaspik, Executive Director of the McHenry Public Library District, was in attendance. Ms. Kaspik thanked the Council and Mayor for all of their assistance in implementing and collecting the Developer Donation fees for all of the taxing -- districts. She reminded Council the Library had been the recipient of a $150,000 State grant to furnish and equip the Library. She invited all of those in attendance to visit the newly refurnished Library at their earliest convenience. Mayor Cuda then reported the following Developer Donation Fees had been collected for the first half of the 1997 year: • McHenry Community School District 156 $ 66, 594.85 • McHenry Community School District 15 $123,676.15 • McHenry Township Fire Protection District $ 16, 086.00 • McHenry Public Library District $ 16, 086.00. Motion by McClatchey, seconded by Baird, to approve the disbursement of Semi-Annual Developer Donation Funds for the first half of 1997 totaling $222,443.00 as follows: • McHenry Community School District 156 $ 66,594.85 • McHenry Community School District 15 $123,676.15 • McHenry Township Fire Protection District $ 16,086.00 • McHenry Public Library District $ 16, 086.00. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. -- Motion carried. Alderman Baird noted an additional $79,387.50 in City of McHenry Park Fees had also been collected. MAYOR - STATEMENT AND REPORTS Referencing his memo which had been distributed to Council that afternoon, Mayor Cuda inquired if there were any corrections or concerns requiring further discussion. There being none, Mayor Cuda requested Council formally approve his appointment of John Lobaito, current City of McHenry Director of Building and Zoning as City Administrator pursuant to the terms and provisions stated in his memo of July 9, 1997. July 9, 1997 Page 3 Motion by Bolger, seconded by Baird, to approve the appointment of current City of McHenry Director of Building and Zoning John Lobaito, City of McHenry Administrator, effective immediately, under the following terms and provisions: • An annual salary of $67,000 to be reviewed in six months; • Six months severance pay if the City terminates employment; • Four weeks vacation with an option to be paid for any vacation time not taken up to a maximum of two weeks; • Three personal days; • $250 per month car allowance; • Continuing education reimbursement as mutually agreed upon; • Residency requirement within one year after an acceptable one year review; • City payment of all professional dues, subscriptions and participation in national, state and local municipal conferences and organizations as mutually agreed upon. Voting Aye: Bolger, Glab, Murgatroyd, Baird. Voting Nay: McClatchey. Absent: None. Motion carried. COMMITTEE REPORTS Chairman of the Parks and Recreation Committee, Alderman Baird, informed full Council the Parks and Recreation Committee had met on Tuesday, July 8, 1997 and the minutes would be forthcoming. Preliminary discussion included review of budgeted Capital Development projects and a Recreation Center. The next meeting will be scheduled for late August or early September. STAFF REPORTS Director of Parks and Recreation Merkel provided Council with an update on city Fiesta Days activities as well as accommodate plans for the Twin Cities Aids Riders at Knox Park. Director Merkel also reported bids for the Green Street Park Landscaping had been submitted and opened on Tuesday, July 8, 1997 at 1 1 :00 a.m. All bids were under budget and will be presented for Council review and award at the regularly scheduled July 30, 1997 meeting. He also noted the park site had been graded and cleaned up for the Fiesta Days Parade, Sunday, July 20, 1997. Director of Public Works Batt informed Council the East of the River Sanitary Sewer Extension project will be substantially completed Wednesday, July 16, 1997. Only the lift station construction will remain incomplete. As a separate work crew will be undertaking the lift station construction, Director Batt requested any outstanding work and/or concerns in connection with the sewer line extension be brought to his attention prior to July 16, 1997. Director Batt also reported he and City contracted Engineers Hampton, Lenzini, and Renwick met with IDOT representatives regarding the Green Street Phase III project. Extreme efforts will be made to coordinate the Green Street Phase III project with the Bull Valley arterial road project. Biological resource clearance is still pending. Director of Building and Zoning John Lobaito thanked Council for their support and approval in appointing him City Administrator. He stated his enthusiasm and anticipation in accepting the challenge. NEW BUSINESS In response to his inquiry, Director of Public Works Batt provided preliminary information to Alderman Baird regarding the garbage bag and yard waste sticker buy- back program. He noted further information will be disseminated to all City residents within the next few weeks prior to the new contract's initiation, August 2, 1997. Alderman Baird also requested the discussion and direction regarding the Irish Prairie storm water drainage correction be addressed as an Agenda item at the regularly scheduled July 30, 1997 Council meeting. Council concurred. July 9, 1997 Page 4 Alderman McClatchey requested staff remove the garbage left behind in the McHenry Market Place Parking lot by a temporary fireworks stand. In response to Alderman McClatchey's inquiry, Director of Parks and Recreation Merkel explained the tennis court nets at Freund Field were temporarily removed in order for the Parks Department to conduct their in-line hockey program. The nets will be replaced upon the conclusion of the instruction. Alderman Glab acknowledged the Department Heads contributions and efforts in the absence of a City Administrator.
