HomeMy WebLinkAboutMinutes - 08/06/1997 - City Council (2) REGULAR MEETING AUGUST 6, 1997 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, August 6, 1997 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, City Planner Phil Maggio. Absent: Director of Public Works Batt, Director of Parks and Recreation Merkel. ROTARY CLUB PRESENTATION Representatives of the McHenry Rotary Club Harry Dean, Donald Weingart and Scott Siman presented the McHenry City Council and Mayor Cuda with a $4,000 check designated for the purchase of four new entrance signs to the City of McHenry. City Administrator Lobaito noted in 1996 Council had approved matching funds for the balance of the signs purchase. Mayor Cuda stated in recognition of the McHenry Rotary Club's numerous civic contributions a resolution acknowledging their service efforts had been drafted. Motion by Glab, seconded by Murgatroyd, to pass a resolution acknowledging the McHenry Rotary Club's civic efforts and contributions to the McHenry community. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. The resolution was presented to the McHenry Rotary Club representatives. PROPOSED TEXT AMENDMENT TO ZONING ORDINANCE - NOTIFICATION TO ADJOINING PROPERTY OWNERS City Planner Phil Maggio informed Council currently Public Notice requirements for hearings before the Zoning Board of Appeals for Zoning Map Amendments, Conditional Use Permits and most Variances require a newspaper publication, written notification to adjoining property owners, and the posting of a sign on the property. Minor Variances, which affect only single family attached or detached buildings or lots, require only the publication of notice of the Public Hearing in the newspaper. The proposed Text Amendment would create the additional requirement of written notification of the Public Hearing to all adjoining property owners. Written notification must be delivered in person or by certified mail and would create a marginal cost increase to the homeowner requesting the Minor Variance. It is the recommendation of staff to approve the Text Amendment to the Zoning Ordinance establishing the additional requirement of written notification for Minor Variance requests and Public Hearing be provided to adjoining property owners. The required notification would encourage potentially important input at the Public Hearing from affected neighboring homeowners. Motion by Baird, seconded by McClatchey, to accept the unanimous recommendation of the Zoning Board of Appeals and pass an ordinance amending the text of the City of McHenry Zoning Ordinance Chapter II, Paragraph (17)(2), deleting the words "except in the case of application for Minor Variances" from the first sentence. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. PROPOSED TEXT AMENDMENT TO ZONING ORDINANCE - REMOVAL OF REQUIREMENT FOR MAYOR TO BE INCLUDED IN DETERMINATION OF COUNCIL CONCURRENCE RELATING TO ZONING REQUESTS City Planner Phil Maggio informed Council the City of McHenry's Zoning Ordinance currently requires the concurrence of the majority all members holding office on the City Council, including the Mayor, for all zoning requests. This ordinance requires the Mayor vote in approving all Zoning Map Amendments, Conditional Use Permits, Variances or any other zoning requests that must be approved by ordinance. This requirement is in conflict with State Law which provides the majority of only the Aldermen, or three concurring votes, is required. The proposed Text Amendment would bring the Zoning Ordinance into conformance with State Law. Motion by McClatchey, seconded by Murgatroyd, to accept the unanimous recommendation of the Zoning Board of Appeals and pass an ordinance amending the _ text of the City of McHenry Zoning Ordinance Chapter II(C)(4) on page 32, deleting the following language from the last sentence in the second paragraph: "In all other cases, the concurrence of a majority of all members then holding office on the City Council, including the Mayor, shall be required". Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. PROPOSED TEXT AMENDMENT TO ZONING ORDINANCE - SIGN REGULATIONS City Administrator Lobaito reminded Council that in September 1996, the Building and Zoning Committee met to discuss several potential changes to the Sign August 6, 1997 Page 3 Code in response to an increasing number of requests for Sign Code variances. Changes were drafted and presented to the Zoning Board of Appeals for review and approval and/or recommendation. The proposed sign changes included: • Increasing the number of permitted wall signs from 1 to 2; • Reducing the maximum height of pole signs from 25 feet to 15 feet; • Including the area of canopy signs when calculating the total allowable sign area; • Clarifying the sections dealing with portable and temporary signs; • Establishing a regular setback of 5 feet for all ground signs; • Additional minor changes to Table 18 Standards for Non-Exempt Signs. Some discussion followed. City Administrator Lobaito noted the clarification on Portable and Temporary Sign restrictions as well as the increased maximum permitted area for Development Entrance Signs in the Business Park District were recommendations from the staff and Zoning Board of Appeals as opposed to the Building and Zoning Committee. These recommendations, however, were reviewed and approved by the full Zoning Board of Appeals. Alderman Baird clarified the increase of permitted Wall Signs for commercial properties and corner tenants in Shopping Centers from 1 to 2 is not increasing the permitted area of wall signage. The addition of a second sign would only be allowed if it conformed with the total permitted wall sign area. Motion by McClatchey, seconded by Murgatroyd, to accept the unanimous recommendation of the Zoning Board of Appeals and pass an Ordinance amending the City of McHenry Sign Ordinance as follows: • Table 18, Business Park Uses, Development Entrance Signs, to increase the maximum area from 100 square feet to 140 square feet, and to increase the height from a maximum of 6 feet to 15 feet; • Amend City of McHenry Zoning Ordinance, Chapter IX, Signs as follows: • Increasing the number of permitted Wall Signs from 1 to 2; • Reducing the maximum height of Pole Signs from 25 feet to 15 feet; • Including the area of Canopy Signs when calculating the total allowable sign area; _ • Clarifying the sections dealing with Portable and Temporary Signs as presented; • Establishing a regular setback of 5 feet for all Ground Signs, except for Shopping Centers which shall be 7 feet; • Other attendant changes as described in revised Table 18 as presented. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. MAYOR - STATEMENT AND REPORTS Mayor Cuda informed Council a verbal report had been received from Gary Rozwadowski of Smith Engineering stating approval from the Illinois Department of Transportation had been granted for a traffic signal at the Route 31 and Shamrock Lane intersection. Written verification is being sought. Gary Lang of Lang Auto Group will also be informed of the Illinois Department of Transportation's approval and reminded of his $50,000 contribution to the improvements of the traffic configuration and flow in this area. Mayor Cuda reported the Mass Barn Dedication will be scheduled for Saturday, September 13, 1997 at 1 1 :00 a.m. COMMITTEE REPORTS Chairman of the Parks and Recreation Committee Alderman Baird noted the minutes from the July 8, 1997 Parks and Recreation Committee Meeting had been included in the Friday Agenda Packet for Council review. He noted the Parks and Recreation Committee had discussed the Five-Year Capital Development Plan. A Parks and Recreation Committee Meeting was scheduled for Wednesday, August 27, 1997 at 7:00 p.m. Finance Committee Chairman Alderman Murgatroyd reminded Council of the August 19, 1997 Finance Committee Meeting at 7:00 p.m. In addition to preliminary discussion on water/sewer rates, Auditor John Eder of Eder, Reidel and Company will August 6, 1997 Page 4 be in attendance to present the 1996 Audit and Management Letter. STAFF REPORTS There were no Staff Reports. NEW BUSINESS Alderman Bolger requested the Pleasure Drive Ordinance be reviewed with regard to mini-van restrictions. Some discussion followed in response to Alderman McClatchey's request for clarification of the mini-van definition. Alderman Murgatroyd requested "Caution - Children at Play" signs be installed in the vicinity of 1618 Meadow Lane. City Administrator Lobaito acknowledged his request. Alderman Baird requested staff contact all members of the Landmark Commission regarding attendance. He noted he attended the August 5, 1997 meeting of the Landmark Commission and a quorum was not present. Mayor Cuda acknowledged Alderman Baird's request and stated letters would be sent prior to the next regularly scheduled Council meeting. Alderman Baird also noted the Landmark Commission's request to be included in the updating of the City of McHenry's Comprehensive Plan. The Commission would like to include some type of Historic Preservation language. City Administrator Lobaito informed Council the Historic Preservation Ordinance is scheduled for the September 15, 1997 Zoning Board of Appeals Hearing. After Zoning Board of Appeals review, comments will be sent back to the Building and Zoning Committee for further review and revision prior to being submitted for full Council approval.
