HomeMy WebLinkAboutMinutes - 10/15/1997 - City Council (2) REGULAR MEETING OCTOBER 15, 1997 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, October 15, 1997 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd. Absent: Baird. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, Director of Public Works Batt, Director of Parks and Recreation Merkel. Absent: None. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minute Public Input Session. PUBLIC HEARING - ANNEXATION OF NORTH RICHMOND ROAD PROPERTIES Mayor Cuda opened the Public Hearing on the Annexation of North Richmond Road Properties at 7:33 P.M. Mayor Cuda reminded Council the six properties in question were part of the original group of Route 31 property owners petitioning the City for annexation in late 1994. As one property owner chose not to annex to the City of McHenry, the six properties in question tonight are currently not contiguous to the City of McHenry. The formal annexation and adoption of the zoning changes provided in the Annexation Agreements will occur only after each property becomes contiguous to the City of McHenry. City Administrator Lobaito noted the zoning and annexation procedure followed for these six properties was precisely the same procedure followed for the properties East of the Fox River along Route 120. The Annexation Agreement establishes a twenty year term for each of the properties. The zoning classification in all six agreements is C5 Highway Commercial, however, Conditional Uses are specific for each property. The Conditional Uses incorporated into each of the Annexation Agreements allow the continuation of the current existing uses on each of these — properties. The Zoning Board of Appeals, at meetings held in March of 1997, recommended approval of the requested zoning changes for each of the properties upon annexation to the City of McHenry. Mayor Cuda asked if there were any questions or comments from the Council or the audience. There were none. City Clerk Althoff then informed Council no written or verbal comments and/or questions had been received by the Clerk's office. Motion by Glab, seconded by Murgatroyd, to close the Public Hearing. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd. Voting Nay: None. Absent: Baird. Motion carried. The Public Hearing was closed at 7:40 p.m. Motion by McClatchey, seconded by Bolger,to pass an ordinance approving and authorizing the Mayor and City Clerk's execution of the Annexation Agreements which incorporate the Zoning Board of Appeal's recommendation regarding zoning and conditional use for the following properties: *John Duff, Palace Bowl, 3400 N Richmond Rd C5 with Conditional Use for Indoor Amusement Establishment(bowling alley);Restaurant with Bar and Live Entertainment and Dancing •Trust #2378 Nelson Auto, 3420 N. PARKING RESTRICTIONS - PEARL STREET City Administrator Lobaito reported Alderman McClatchey had been approached by numerous business owners in the Riverside Area Business District requesting the two hour parking restriction on Riverside Drive and Pearl Street be increased to four hours. A petition with thirty-five Riverside Drive and Pearl Street property owner and/or tenant signatures was submitted. Chief of Police Joyce arrived at 7:40 p.m. - lgr`ATZT�-:J October 15, 1997 Page 5 City Administrator Lobaito also informed Council the Riverside Area Business Association had been contacted and expressed their desire to maintain the two-hour limit. It should be noted not all the businesses in the area are members of the Riverside Area Business Association and many businesses located in this area are service entities requiring longer parking time. Currently, the area has 106 two-hour parking spaces and 53 four-hour parking spaces. The proposed compromise converting the present two-hour parking on Pearl Street to four-hour parking would result in 107 two-hour parking spaces and 105 four-hour parking spaces. Permit parking remains constant. Some discussion followed. Pat Fisher of 1402 Riverside Drive addressed Council. Mrs. Fisher requested Council consider increasing all the area parking to four hours. Alderman Bolger noted it was not the City's responsibility to provide parking and consideration should be given to area retailers requesting two-hour parking restrictions. Some discussion ensued. Motion by McClatchey, seconded by Murgatroyd, to draft an ordinance increasing the current parking restrictions on the north and south sides of Pearl Street from the Lincoln Avenue Bridge west to Park Street from two hours to four hours. Alderman Glab requested the motion be amended to include Council review of the parking situation after six months. Alderman McClatchey amended his motion to include the six month review. The motion was again seconded by Alderman Murgatroyd. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd. Voting Nay: None. Absent: Baird. Motion carried. Susan Miller, President of the Riverside Area Business Association, addressed •— Council stating the membership of the Riverside Area Business Association had enforcement concerns with the proposed four-hour parking restriction increase. She expressed gratitude for the six month review clause. INTERGOVERNMENTAL AGREEMENT BETWEEN CITY AND COUNTY FOR MAINTENANCE OF WETLANDS City Administrator Lobaito informed Council part of the Bull Valley Arterials Army Corps of Engineers' permitting process was the requirement of an intergovernmental agreement establishing wetland creation and maintenance responsibilities between the City of McHenry and McHenry County. McHenry County is responsible for the restoration and revegetative work for all the mitigated areas. Upon completion of the wetland restoration and revegetation by the County the City of McHenry shall accept and be responsible for the on-going wetland mitigation area. Maintenance responsibilities generally include annual burns, controlling of purple loosestrife and monitoring an inventory of plant and hydrologic conditions. In the event the City of McHenry fails to comply with the maintenance as set forth in the intergovernmental agreement, the County may perform the duties and invoice the City for said costs. City Administrator Lobaito noted no real maintenance cost figures exist at this time. Private firms will be contacted, however, to assist the City of McHenry in maintaining all of its wetland mitigation areas. Motion by Bolger, seconded by Glab, to authorize the Mayor's execution of the Intergovernmental Agreement between the City of McHenry and McHenry County for wetland mitigation and management associated with the Bull Valley Arterial. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd. Voting Nay: None. Absent: Baird. Motion carried. In response to Alderman Bolger's inquiry, Director of Parks and Recreation Merkel explained hydrologic conditions and noted the unique circumstances of October 15, 1997 Page 6 restoring and maintaining the perched fen and associated plant and wildlife ecosystem located within the Bull Valley Arterial wetland mitigation area. CONDITIONAL USE AND VARIANCE REQUESTS - PERRY MOY AND ANTHONY PARISI: DON'S DAIRY FROST Sam Diamond, Attorney for the Petitioners, and the Petitioners, Perry Moy and Anthony Parisi, were in attendance. Attorney Diamond stated Mr. Moy and Mr. Parisi, owners of Don's Dairy Frost, are requesting multiple zoning changes to allow for the _ expansion of Don's Dairy Frost onto the adjacent property at 3106 West Route 120. The existing building at this location would be demolished to allow for the planned expansion. The following zoning changes have been requested: • Zoning Map Amendment from C3 to C5 for 3106 West Route 120; • Conditional Use Permit for a drive-through establishment to permit the addition of a drive-through service window as part of the planned expansion; • Variance to the 30-foot front building setback required in the C5 Zoning District permitting the existing building to remain on the property located at 3102 West Route 120 with a front setback of 2.9 feet while allowing the planned addition a front setback of no less than 15.5 feet; • Variance to the required number of parking spaces for the restaurant to allow the provision of only 41 of the required 49 parking spaces. Mayor Cuda stated his support for the project noting the general overall improvement of the property site. He noted the proposed addition is mainly for the construction of the drive-through service area and the 15 additional seats would not increase substantially the parking demand. In response to Alderman McClatchey's inquiry, Mr. Moy stated the availability of a drive-through service lane decreases the need for parking by 30-40%. Alderman Glab stated he had several concerns he would like addressed. Mr. Moy, in response to Alderman Glab's inquiry regarding drive-through stacking and potential traffic backups, stated three waiting stations were planned and the drive- through driveway would be an exit only access. In response to Alderman Glab's concerns regarding the height differential between the proposed addition and the existing building and possible snow buildup because of drifting, City Administrator Lobaito stated current City of McHenry building codes address these structural issues. He also noted the entire building structure will be under review because of the proposed construction. City Administrator Lobaito also informed Council in response to Alderman Glab's inquiry regarding the proposed height of the parking lot lights, the height of the parking lots lights as well as the emission level will be reviewed as part of the building inspection. Mr. Moy responded to Alderman Glab's inquiry regarding fencing stating all fencing gaps along the north property line would be closed. A lengthy discussion followed regarding the property's ingress and egress to Route 120 as well as to Charles Street. Alderman Glab suggested Council consider restricting the drive- through exit as well as the Charles Street exit to right turns only. Staff noted the Zoning Board of Appeals investigated this option and felt the restriction might negatively impact the adjacent residential subdivision with cut-through traffic. Motion by Bolger, seconded by McClatchey, to accept the recommendation of the Zoning Board of Appeals and pass an ordinance granting property owners Perry Moy and Anthony Parisi the following multiple zoning changes allowing for the expansion of Don's Dairy Frost onto the adjacent property located at 3106 West Route 120: • Zoning Map Amendment from C3 to C5 for the property at 3106 West Route 120; • Conditional Use Permit for a drive-through establishment to permit the addition of a drive-through service window as part of the planned expansion; October 15, 1997 Page 7 • Variance to the 30-foot front building setback required in the C5 Zoning District permitting the existing building to remain on the property located at 3102 West Route 120 with a front setback of 2.9 feet while allowing the planned addition a front setback of no less than 15.5 feet; • Variance to the required number of parking spaces for the restaurant allowing 41 of the required 49 parking spaces. ORDINANCE ADDING STOP SIGNS ON MEADOW AT PRAIRIE Council directed City Clerk Althoff to draft an ordinance creating stop streets on Meadow at Prairie at the regularly scheduled Council Meeting of October 1 , 1997. City Administrator Lobaito stated after consulting with City Attorney McArdle and City Traffic Attorney McAndrews, it was staff's recommendation to install the stop signs as discussed on Meadow at Prairie as opposed to the original proposal of on Meadow at Willow. Motion by McClatchey, seconded by Murgatroyd, to pass an ordinance creating stop streets on Meadow at Prairie. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd. Voting Nay: None. Absent: Baird. Motion carried. TUITION REIMBURSEMENT POLICY REVISION City Administrator Lobaito reminded Council formal action was taken at the July 30, 1997 Regularly Scheduled Council Meeting to delete Section 22.2(a) of the City of McHenry's Personnel Policy Manual relating to tuition reimbursement. City of McHenry Police Officer's Association Representatives requested at the August 19, 1997 negotiation session a tuition reimbursement policy be included in their contract. City Administrator Lobaito, with the assistance of City Attorney McArdle, has drafted a revised Tuition Reimbursement Policy incorporating Council's concerns. The revised policy will be presented to City of McHenry Police Officer's Association Unit 2 negotiation Counsel James Harrison for incorporation into the Unit 2 contract after it has been formally adopted by Council. Motion by Glab, seconded by Murgatroyd, to approve the Tuition Reimbursement Policy revision as presented; to incorporate the language into the City of McHenry's Personnel Policy; and to present the revised language to the City of McHenry Police Officer's Association Unit 2 negotiation representative James Harrison for incorporation into the Unit 2 contract. ACTUARIAL SERVICES FOR POLICE PENSION FUND City Administrator Lobaito distributed a revised Agenda Supplement for this Agenda item. He explained the firm of Watson Wyatt has performed actuarial services annually for the City's Police Pension Fund. The State Department of Insurance provides the City of McHenry with its tax levy requirements in accordance with the Illinois Pension Code. However, assumptions used by the State Department of Insurance are subject to review by the City. The valuation of the appropriateness of the state's figures must be performed by a qualified actuarial firm. The actuarial provides information to the City of McHenry which affects the City's Police Pension Fund tax levy. For the plan year ending April 30, 1997, the Illinois Department of Insurance calculated the City's Pension Fund contribution at $281 ,083. The actuarial evaluation by Watson Wyatt showed the required contribution to be $246,350. This October 15, 1997 Page 8 year's proposal from Watson Wyatt is a not-to-exceed amount of $4,800. A $700 increase over last year's figure is reflective of the additional reporting requirements mandated by the Government Accounting Standards Board. The 1997-1998 Budget includes $5,600 for these services. Motion by McClatchey, seconded by Murgatroyd, to authorize the Mayor's execution of the 1997 Watson Wyatt proposal for Police Pension Fund Actuarial Services for the year ending April 30, 1998 at a cost not-to-exceed $4,800. PAYMENT OF SEMI-ANNUAL GENERAL OBLIGATION BONDS AND WATER/SEWER REVENUE BONDS Mayor Cuda noted as per the 1993 and 1997 bond agreements, the semi- annual interest payments are due November 1 , 1997. Motion by Bolger, seconded by Glab, to approve and authorize payment of semi- annual interest payments on Series 1997A in the amount of $90,625; Series 1997B in the amount of $40,025; and Series 1993 in the amount of $92, 900. FISCAL YEAR 1998-1999 NISRA DUES Director of Parks and Recreation Merkel informed Council the City of McHenry has been a participating member of the Northern Illinois Special Recreation Association (NISRA) since December of 1992. Each year the NISRA Board of Trustees recommends to its members the annual dues and budget for the next fiscal year. These dues are then forwarded to member districts and municipalities for ratification. The NISRA Board of Trustees approved the preliminarily proposed dues for the Fiscal Year 1998-1999 at their September 30, 1997 meeting. The City of McHenry's portion is estimated at $56,844. Member districts and municipalities must also vote on any changes to the Articles of Agreement that govern the operation of the multi- agency organization. An amendment to this Agreement was presented to the Trustees that clarifies how member dues are assessed to new districts wishing to join NISRA. In response to Council inquiry, Director Merkel noted NISRA dues are determined by each district's or municipality's equalized assessed valuation and the new projected growth percentage. Motion by Bolger, seconded by Glab, to approve the proposed 1998-1999 NISRA membership dues subject to an adjustment by the actual equalized assessed valuation in an amount not-to-exceed $56,844 and to approve the amendment to the Articles of Agreement which clarifies how member district/municipality dues are assessed for new districts. MAYOR - STATEMENT AND REPORTS Mayor Cuda informed Council he, Werner Ellmann, and Patricia Buhrman had finished the interview process for the Human Relations Commission. The Commission will consist of 15 members: 12 citizens at large; 2 high school students; and the Mayor as an Ex-Officio member. Mayor Cuda informed Council the first meeting is scheduled for Tuesday, October 28, 1997 at 7:30 p.m. in the Council Chambers of the Municipal Building where a swearing in ceremony will occur. Mayor Cuda also reported the proposed Intergovernmental Agreement between the City of McHenry and McHenry High School District 156 will be before Council for approval at the next regularly scheduled Council Meeting, October 29, 1997. COMMITTEE REPORTS Finance Committee Chairman Alderman Murgatroyd reported the Finance Committee unanimously approved a water/sewer rate increase as well as an increase in Capital Development Fees. Full Council approval will be sought at the November 5, 1997 regularly scheduled Council Meeting. He also requested Council approval to initiate review of the City of McHenry's Personnel Policy. Council concurred. A date for the next Finance Committee Meeting to begin review of the Personnel Policy will be set at the October 29, 1997 regularly scheduled Council Meeting. STAFF REPORTS Director of Public Works Batt reported the Lakeland Park Drainage Project contract manager mistakenly closed a street in this construction area. The street has since been re-opened and the incident will not be repeated. Director of Parks and Recreation Merkel reported a date for the next Parks and Recreation Committee Meeting to meet with the second architectural firm for the City of McHenry's proposed recreation center will be set for either the last week of October or the first Tuesday in November. Director Merkel also informed Council the Brookside Park Grant made the final selection's list and the City of McHenry will receive official notification sometime in January, 1998. Mayor Cuda recommended Staff solicit assistance from State Senator Klemm. City Administrator Lobaito referenced the October 15, 1997 Public Works Department Memorandum. He explained Staff had prioritized all the Public Works Department's projects. Project Number 2, the Irish Prairie Detention Pond, had an anticipated completion date for early next week, allowing Project Number 3, the Edgebrook/Anne Street Drainage Project, to have an initiation date within the next seven to ten days. October 15, 1997 Page 10 NEW BUSINESS Alderman Bolger requested Staff address the problem of skateboarder's loitering in the North Main Street Parking Lot. Alderman Bolger also noted parking on John Street west of Green Street during school hours was very dense and caused a visibility problem. He requested Staff investigate the plausibility of restricting parking in this area particularly near the intersection of Green and John Streets. Alderman McClatchey informed Staff he had received complaints that the metal slide at Petersen Park needed repair. City Administrator Lobaito directed Parks and Recreation Director Merkel to investigate this complaint, and, if required, initiate repairs. In response to Alderman McClatchey's complaint regarding an apparent home car repair shop on Pleasant Street, City Administrator Lobaito requested Alderman McClatchey provide him with the specific address.
