HomeMy WebLinkAboutMinutes - 11/19/1997 - City Council (2) REGULAR MEETING NOVEMBER 19, 1997 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, November 19, 1997 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey, Murgatroyd. Absent: Baird. City Staff in attendance were: City Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Director of Public Works Batt, Chief of Police Joyce, Director of Parks and Recreation Merkel. Absent: None. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minute Public Input Session. Chief of Police Joyce introduced to full Council and Staff the following newly hired officers: Officer Paul Funk; Officer Brian McKeen; and Officer Tony Mucciante. Mayor Cuda welcomed the officers and wished them well. PUBLIC HEARING - 1997 PROPERTY TAX LEVY Mayor Cuda opened the Public Hearing on the 1997 Property Tax Levy at 7:35 p.m. Mayor Cuda asked if there were any questions or comments from the audience. There were none. City Clerk Althoff informed Council no written or verbal comments and /or questions had been received by the Clerk's office. City Administrator Lobaito informed Council as per State Statute, Council considered the proposed Tax Levy at their regularly scheduled November 5, 1997 meeting, and scheduled the date of November 19, 1997 for the required Public Hearing. Notice of this Public Hearing was published in the Northwest Herald on November 11, 1997. The proposed 1997 Tax Levy of $2,226,687 represents an increase of 1 1 .22% over the 1996 Tax Levy. The Levy amount represents a rate of .6279/$100 in Equalized Assessed Valuation. PRESENTATION BY SENATOR KLEMM Mayor Cuda reminded Council of Senator Klemm's previous offer to attend a City of McHenry Council meeting and address State Legislative issues which may impact McHenry County municipalities. Mayor Cuda introduced Senator Klemm. Senator Klemm informed Council the Illinois General Assembly concluded the 1997 Fall Veto Session on Saturday, November 15, 1997. Of notable interest was the passage of the Electric Deregulation Bill which revises a municipality's authority to impose a utility tax on electricity. More importantly, the proposed school funding bill to raise more than $500 million for schools, $12.2 million more for McHenry County, passed the Senate, but fell four votes short of passage in the House. Senator Klemm opined the bill would in all likelihood pass prior to the start of the 1998 Legislative Session, January 14, 1998. Regarding local matters, Senator Klemm noted the City of McHenry's Brookside Park Grant submission was being considered most favorably. He also stated his support of the Grant and complimented Council and Staff on the quality and composition of their Grant submission. Grant award announcements will be made by the Governor sometime next month. In response to Alderman Bolger's inquiry, Senator Klemm stated the McHenry Bypass Proposal was being studied and funds were not yet allocated for Phase II of the Bull Valley Arterial connecting Chapel Hill Road to the Bull Valley Bridge over the Fox River. Senator Klemm distributed a selection of bills from the Spring 1997 Session he felt were of interest to all municipalities, noting specifically the failure of the Tort Immunity Bill which would have imposed a huge liability on units of local government for willful and wanton failure to supervise public property in the case of an injury. Alderman Bolger requested assistance with the widening of Route 31 South from Bull Valley Road. Senator Klemm noted the $150 million shortfall facing the Illinois Department of Transportation due in large part to federal funding cutbacks. He did note the General Assembly would be investigating the feasibility of an increase in the Motor Fuel Tax designated for roadway projects. Mayor Cuda thanked Senator Klemm for his presentation and again noted any assistance he could supply with regard to State funding for the Shamrock-Route 31 intersection improvements would be appreciated. Mayor Cuda invited Senator Klemm to appear before the McHenry City Council again within the next six to nine months. November 19, 1997 Page 3 City Administrator Lobaito requested Mayor Cuda and Council permit a small deviation from this evening's Agenda. He explained in response to Council's concerns regarding the loose leaf pick-up program, Waste Management North Operations Manager Norm Lewis had been invited to this evening's meeting. Mayor Cuda and Council concurred with City Administrator Lobaito's request and invited Mr. Lewis to address Council. LOOSE LEAF PICK-UP PROGRAM - STATUS REPORT BY WASTE MANAGEMENT NORTH Mr. Lewis reported Waste Management North experienced pick-up problems after the eight to nine inch snowfall, Saturday, November 15, 1997. He stated several areas on the Thursday route have not yet received service, citing Green Valley, McHenry Shores, Country Club Estates, and Pebble Creek. Mr. Lewis opined by week's end Waste Management North would be back on schedule with the loose leaf pick-up program. Mayor Cuda noted his subdivision, Martin Woods, had not been serviced in several days, as well. In response to Council inquiry regarding the November 30th deadline, Mr. Lewis stated it was Waste Management North's intent to complete the City of McHenry's loose leaf pick-up program by the stated deadline of November 30th. A lengthy discussion followed. Mayor Cuda stated the City's commitment to providing the full scope of leaf pick-up services to its residents. He opined many areas of the City had not received eight full leaf pick-ups. He stated Waste Management North would be held accountable to their contractual obligations. City Administrator Lobaito suggested Waste Management North postpone the leaf pick-up program for one week, permitting an improvement in weather conditions. Alderman Glab stated his disappointment with Waste Management North's service. He noted even with verbal assurances by Waste Management North, in two areas within his ward, no visual evidence of their presence was discerned. Mayor Cuda noted again City of McHenry residents were paying for this service and deserved a full eight weeks of service. It was the consensus of Council to direct City Administrator Lobaito to meet with Waste Management North representatives to correct the problem. Mayor Cuda thanked Mr. Lewis for attending the meeting and requested City Administrator Lobaito keep Council informed as to the agreed upon solution. Motion carried. 1998 FIESTA DAYS TENTATIVE SCHEDULE OF EVENTS McHenry Area Chamber of Commerce Executive Director Deborah Harr and the 1998 Fiesta Days Committee Members were in attendance. Ms. Harr noted Fiesta Days 1998 is scheduled for July 10th through July 19th. Chief of Police Joyce has met with Ms. Harr and the Committee, reviewed the schedule, and concurs with the schedule as presented. Alderman Glab inquired whether an activity could be scheduled in McHenry on Friday, July 17th in addition to the event scheduled for Johnsburg. Alderman McClatchey requested the Committee consider reversing the Parade route to begin at Main Street and end at Veteran's Memorial Park. Ms. Harr informed Alderman McClatchey the Parade route currently remains the same as last year, however, the Committee would take his suggestions under consideration. In response to Council inquiry, Director of Parks and Recreation Merkel noted Fiesta Days would pose no conflict with the Twin City/Chicago AIDS ride scheduled for the weekend of July 1 1 th. Motion by Bolger, seconded by Murgatroyd, to approve the McHenry Area Chamber of Commerce 1998 Fiesta Days Schedule as presented subject to the prohibition of beer and wine ticket sales thirty minutes prior to the closing of all specified beer and wine service events. LIQUOR LICENSE APPLICATION AND AMENDMENT TO LIQUOR LICENSE ORDINANCE Mayor Cuda informed Council he had received a liquor license application from Lloyd Smith and Thomas Low for a Class B, Retail Sales of Packaged Beer and Wine, Liquor License. Their corporation Wine Express plans to sell by mail order catalogue in addition to walk-in retail sales, gift packages of wine and beer. Their corporate location is 1249 North Green Street where Mr. Smith owns and operates his catering business, Partymakers. Mr. Smith has met with Mayor Cuda, submitted all the November 19, 1997 Page 6 required paperwork and background information, paid the license fee of $700, and scheduled an appointment for fingerprinting. Mayor Cuda informed Council, if Mr. Smith and Mr. Low's liquor license application is approved, an amendment to the City of McHenry's Municipal Code must also occur. The appropriate ordinance draft is attached for Council action. Motion by Glab, seconded by Bolger, to approve the Mayor's recommendation and issue a Class B Liquor License to Wine Express, Inc. subject to the fingerprinting report. Motion carried AMENDMENT TO CITY OF MCHENRY'S VEHICLE STICKER FEE SCHEDULE FOR NOT- FOR-PROFIT VEHICLES City Clerk Althoff informed Council for the past three years Not-for-Profit Pioneer Center has sought and been granted a reduction for vehicle sticker fees. Pioneer Center has nine Type B mini buses and eleven Type V residence vans. The sticker fee for the mini bus is $40.50 and for the residence van is $34.50. Citing its Not-for-Profit status and funding by federal, state and county monies, as well as private contributions, Pioneer Center has felt the total sticker fee cost of $744 to be prohibitive. Pioneer Center has, however, always offered and paid the school bus rate of $15 per vehicle. A recent audit by the City Clerk's office has revealed Pioneer Center to be the only Not-for-Profit organization affected by the Type B and Type V vehicle sticker fee. It is the recommendation of Staff to amend the City of McHenry's vehicle sticker fee schedule to reflect the inclusion of Not-for-Profit vans used to transport clients into the Type S, school bus category, for a fee of $15. Alderman Glab suggested consideration during budget time should be given to a reduction in vehicle sticker fees for handicapped persons. Motion by Murgatroyd, seconded by Bolger, to amend the City of McHenry's vehicle sticker fee schedule to reflect the inclusion of Not-for-Profit vans used to transport clients into the Type S, School Bus category, for a fee of $15.00. MAYOR - STATEMENT AND REPORTS Mayor Cuda informed Council he had received a letter from Johnsburg Village President David Dominguez offering to meet with City of McHenry Council representatives to discuss matters of concern to both municipalities. Mayor Cuda noted a copy of said letter will be enclosed in Friday Agenda packets for further Council review. He requested any Aldermen interested in serving on this committee contact him or City Administrator Lobaito directly. Mayor Cuda then reported he and City Administrator Lobaito had met with a representative from Amli Realty. Amli Realty is the owner of property located on North Route 120 West of Martin Woods Subdivision. The discussion was preliminary November 19, 1997 Page 7 with formalized long-range development plans forthcoming. COMMITTEE REPORTS Building and Zoning Committee Chairman Alderman McClatchey reported the Building and Zoning Committee in conjunction with Plan commission Chairperson Vicki Sheppard and City Administrator Lobaito were interviewing four planning firms. One of these firms will be recommended to full Council to assist the City of McHenry in its Comprehensive Plan Update. STAFF REPORTS City Administrator Lobaito reported with regard to the City's ongoing land purchase negotiations a copy of the proposed contract and a letter draft will be enclosed in the Aldermen's Friday Agenda Packets for review and comments. All comments should be directed to City Administrator Lobaito prior to Wednesday, November 26, 1997. He informed Council the Executive Session item submitted has been withdrawn and an Executive Session was no longer required for this evening's meeting. City Administrator Lobaito requested Council designate the regularly scheduled December 15th Council Meeting as a workshop session to begin initial discussions for the 1998-1999 Budget. He requested Staff and Council to project Capital Project needs over the next three fiscal years. Council concurred with City Administrator Lobaito's request. NEW BUSINESS Alderman McClatchey requested Staff investigate the feasibility of installing a stop sign on Washington at Green Street.
