DECEMBER 3, 1997
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, December 3, 1997 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd. Absent: Baird. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Director of Public
Works Batt, Chief of Police Joyce, Director of Parks and Recreation Merkel. Absent:
None.

ORDINANCE AMENDING THE MUNICIPAL CODE PERMITTING COST OF COLLECTING
UNPAID FEES AND CHARGES TO BE ADDED TO THE FEE
City Clerk Althoff informed Council in specified circumstances under the City
Administrator's and/or Council direction, the City of McHenry utilizes the City of
McHenry Attorney's services to redeem uncollectible fees and charges. These fees
and charges range from final water and sewer billings, revolving loan payments,
retained personnel costs, recording fees, and property damage claims. Currently the
City of McHenry bears the cost of these collection efforts. It is the recommendation
of Staff and the City Attorney to pass an ordinance amending the Municipal Code
permitting the cost of collecting unpaid fees and charges to be added to the fee and/or
charge. Some discussion followed.
Alderman Bolger recommended all alternative means of collection be exhausted
before utilizing the City Attorney. Staff concurred.
Motion by McClatchey, seconded by Murgatroyd, to pass an ordinance
amending the Municipal Code in Section 1-8, Sub-Section (b) permitting the cost of
collecting any fees and/or charges that are not paid to the City of McHenry, be added
to the original fees and/or charges.

CONSIDERATION OF ORDINANCE CREATING "NO PARKING ANYTIME" ON OAK
DRIVE BETWEEN ROUTE 120 AND PRAIRIE; AND "NO PARKING ANYTIME" ON
ORLEANS BETWEEN RAILROAD TRACKS AND OAK DRIVE
Director of Public Works Batt requested Council consider drafting an ordinance
prohibiting parking anytime on Oak Drive between Route 120 and Prairie, and on
Orleans between the railroad tracks and Oak Drive. Alderman Murgatroyd noted these
streets are major thoroughfares for commercial and industrial traffic and vehicular
parking should be prohibited.
Motion by McClatchey, seconded by Murgatroyd, to direct the City Clerk to
draft an ordinance prohibiting parking anytime on Oak Drive between Route 120 and
Prairie, and on Orleans between the railroad tracks and Oak Drive.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd.
Voting Nay: None.
Absent: Baird.

PROPOSAL FROM MELROSE PYROTECHNICS FOR MILLENNIUM FIREWORKS
DISPLAY
Mayor Cuda informed Council as per City Clerk Althoff's Agenda supplement,
the McHenry Area Jaycees, who have co-sponsored with the City of McHenry the
City's Annual Fourth of July Fireworks Display, has presented for Council review a
special millennium program from Melrose Pyrotechnics. Melrose Pyrotechnics has
been the selected fireworks producer for the City of McHenry and McHenry Area
Jaycees Fourth of July events for the past three years. The proposal offered by
Melrose Pyrotechnics Inc. is essentially a three-year display contract. A twenty
percent discount is offered by Melrose Pyrotechnics Inc. on the third and final
fireworks display if a contract is executed guaranteeing three displays prior to
December 31 ,2000. The McHenry Area Jaycees has contracted with Melrose
Pyrotechnics for the 1998 Fourth of July Display and the City of McHenry has

contracted with Melrose Pyrotechnics for a 1999 Millennium Celebration. The
McHenry Area Jaycees cannot commit to the 1999 Fourth of July Fireworks
performance as their service organization's bylaws do not permit allocation of monies
beyond the current fiscal year. Therefore, to take advantage of Melrose Pyrotechnics
Inc. Millennium Program, the Council must commit monies not yet budgeted for a
Fireworks Display in 1999 or 2000.
Motion by Bolger, seconded by Glab, to authorize the Mayor's execution of a
contract with Melrose Pyrotechnics Inc. for three fireworks performances prior to
December 31 , 2000 subject to the designation of the McHenry Area Jaycees 1998
Fourth of July Fireworks Display commitment and the City of McHenry's 1999
Millennium Celebration commitment as two of the three fireworks performances.

Mayor Cuda also noted the McHenry Area Jaycees has inquired whether a $1
Fireworks Donation Request could be added to the City of McHenry's Water and
Sewer Bills. Area residents could increase their water and sewer bill by $1 which
would be donated to the City of McHenry's Annual Fourth of July Fireworks Display.
In response to Council inquiry, City Clerk Althoff noted from a technical perspective
this request can be accommodated with minimal effort. Further discussion followed.
It was the consensus of Council to deny the McHenry Area Jaycees request to add
a $1 Fireworks Donation to the City's water and sewer bills, however, Council
suggested solicitation of funds could be addressed in the next City of McHenry
Newsletter.
Motion by Murgatroyd, seconded by Bolger, to authorize the solicitation of
monies for the City of McHenry/McHenry Area Jaycees Fourth of July Fireworks
Display in the next City of McHenry Newsletter.

CHANGE IN COMMONWEALTH EDISON STREET LIGHTING FIXTURES
City Administrator Lobaito stated the issue of street lights had been broached
at the regularly scheduled November 12, 1997 Council Meeting under Director of
Public Works Batt's staff report. The painted wooden pole required by City standards
for installation by developers is no longer available from Commonwealth Edison.
Commonwealth Edison's Lighting Engineer Dennis Hruby suggests using a fifteen foot
concrete pole with an Early American luminary on minor street corners combined with
a tall concrete pole at major intersections with streets such as Crystal Lake Road,
McCullom Lake Road, Route 31 , etc. This specific choice would balance
approximately overall street lighting costs with the present cost of wooden poles.
Director of Public Works Batt noted initial installation of street lighting is paid for by
the developer. The City then pays a monthly fee to Commonwealth Edison for
maintenance and power under their Rate 23. Currently, the developers' cost to place
a thirty or thirty-five foot wooden pole is $1 ,059 or $1 ,161 respectively. To place a
fifteen foot concrete pole with an Early American luminary is approximately $966. At
present, developers with subdivisions in progress are at a standstill without a decision
from the City Council on the street standard selection. Inland's Olde Mill Pond
Subdivision is currently using the fifteen foot pole with an Early American fixture. It
is the recommendation of Staff to approve the fifteen foot pole with an Early American
Fixture and utilize the same lighting scheme in all future residential subdivisions.
In response to Alderman Murgatroyd's inquiry, Director of Public Works Batt
noted the illumination pattern of the new fifteen foot street lights was, in effect, better
than the obsolete thirty or thirty-five foot painted wooden pole. Director of Public
Works Batt also noted a taller concrete pole would be installed at major intersections.
It was the consensus of Council to concur with Director Batt's recommendation and

adopt the fifteen foot concrete pole with an Early American luminary on minor street
corners combined with a tall concrete pole at major intersections as the City of
McHenry's new standard for subdivision street lights.
In response to Mayor Cuda's inquiry, City Administrator Lobaito stated the
revision of the City of McHenry's Subdivision Control Ordinance initiated three years
ago would be the number one top priority of the as-yet to be hired Community
Development Director.
PETITION TO DISCONNECT PROPERTY FROM VILLAGE OF MCCULLOM LAKE
City Administrator Lobaito reported the Council at its regularly scheduled July
30, 1997 authorized the Staff to transfer land between the City of McHenry and the
Village of McCullom Lake. The transfer has been completed and recorded. As part of
the Hickory Creek Farm annexation process, an additional portion of property must be
disconnected from the Village of McCullom Lake. The property in question includes
Lots 1 through 12 on the east side of Lakeshore Drive. The Mayor's execution of the
Petition to Disconnect is required.
Motion by Glab, seconded by Bolger, to authorize the Mayor's execution of the
Petition to Disconnect as presented for Lots 1 through 12 in Block 1 of McCullom Lake
Estates.

MAYOR - STATEMENT AND REPORTS
Mayor Cuda reported in response to Johnsburg Village President David
Dominguez's offer to meet with City of McHenry Council representatives to discuss
matters of concern to both municipalities, Alderman Bolger and Alderman Murgatroyd
had been selected to serve on that Ad hoc Committee, along with himself. He noted
both Aldermen had contacted him immediately expressing an interest in serving on the
Committee.
Motion by McClatchey, seconded by Glab, to approve the appointment
of Alderman Bolger and Alderman Murgatroyd to an Ad hoc Committee with Mayor
Cuda to meet with representatives from the Village of Johnsburg to discuss matters
of concern to both municipalities.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd.
Voting Nay: None.
Absent: Baird.

Mayor Cuda also informed Council, representatives from the Village of
Johnsburg had requested inclusion in the cable negotiations between TCI Cable Inc.
and the City of McHenry and the City of Woodstock.
Motion by Bolger, seconded by McClatchey, to approve the inclusion of the
Village of Johnsburg in the cable negotiation consortium including the City of McHenry
and City of Woodstock with TCI Cable, subject to the proportionate share of legal
expenditures.

In conclusion, Mayor Cuda reported the Human Relations Commission had met
on Tuesday, November 25th. The bylaws are near completion and will be considered
for formal approval at the next regularly scheduled Human Relations Commission
meeting. Mayor Cuda noted that because of the Christmas holiday, the next Human

Relations Commission meeting will be scheduled for Tuesday, December 16th at 7:30
p.m. in the Council Chambers of the Municipal Building. He noted the election of a
Chairperson will also occur and invited any interested Council member to attend.
COMMITTEE REPORTS
Building and Zoning Committee Chairman Alderman McClatchey reported the
Building and Zoning Committee had met just prior to this evening's Council meeting
to make a recommendation to full Council of one of the interviewed land planning
firms with reference to the update of the City of McHenry's Comprehensive Plan. A
unanimous recommendation to select Planning Resources Inc. of Wheaton , Illinois in
a not-to-exceed amount of $57,428 was made. This recommendation will formally
appear before full Council at the next regularly scheduled Council Meeting on
December 10, 1997. The Committee will also be recommending consideration of
budgeting for the 1998-1999 Fiscal Year additional monies for transportation
conceptual planning over and above the original scope of the Comprehensive Plan
Update Project.
Building and Zoning Committee Chairman Alderman McClatchey also noted
community input will be sought prior to amending the Comprehensive Plan.
STAFF REPORTS
Director of Public Works Batt reported the NICOR boring for the installation of
new street lights on Green Street in conjunction with the Downtown Revitalization
efforts is complete. Work will resume after the holidays. The installation of street
lights on North Riverside Drive will be completed early next week.
Director of Parks and Recreation Merkel reminded Council of the McHenry Area
Chamber of Commerce and City of McHenry Christmas Tree Lighting on Sunday,
December 7th at 4 p.m. Refreshments and choir performances will be provided at the
Zion Lutheran Church located on the North side of Route 120 directly across from the
Whispering Oaks Park. Director Merkel also noted the Winter/Spring Parks and
Recreation Brochure has been mailed today, Wednesday, December 3, 1997.
Chief of Police Joyce informed Council negotiations with the Dispatchers and
Records Clerk had been concluded. The final contract draft will be presented for
Council review and approval at the December 15, 1997 regularly scheduled Council
Meeting.
City Administrator Lobaito noted inclement weather was prohibiting the
conclusion of the City of McHenry's loose leaf pick-up program. He provided Council
with a status report noting Waste Management North had assured Staff the entire City
would receive one last pick-up. City Administrator Lobaito requested Council consider
extending the Knox Park Drop-off Site for two additional weekends, Saturday,
December 6, 1997 and Saturday, December 13, 1997, in an effort to accommodate
residents' efforts to dispose of their leaves. City Administrator Lobaito also suggested
extending leaf burning two additional weekends, December 6th and 7th, as well as
December 13th and 14th. Some discussion followed.
Motion by Glab, seconded by Bolger, to extend the Knox Park Drop-Off Site for
two additional Saturdays, December 6th and December 13th.

NEW BUSINESS
Alderman Glab requested Staff investigate the feasibility of installing an
additional street light on Pyndale. Staff concurred.

Alderman McClatchey noted he had received complaints regarding Clearview
drainage problems. He requested Staff investigate the feasibility of installing
additional gravel at this site to alleviate standing water. Staff concurred and noted
this phase of the drainage project will completed in the Spring of 1998.

Motion by Bolger, seconded by Glab, to go into Executive Session to discuss
the Acquisition of Property and Personnel.

Petersen to fill the Street Position Maintenance Worker Position vacancy at a starting
at Grade 6, Step 1, with a starting salary of $25,005.
