JANUARY 17, 1996
The Regular Meeting of the McHenry City Council was called to order by Mayor
Steven Cuda on Wednesday, January 17, 1996 at 7:30 PM in the Council Chambers
of the Municipal Center. At roll call the following Aldermen were present: Bolger,
Locke, Lawson, Baird. Bates arrived at 7:40 PM. Absent: None. City Staff in
attendance were City Clerk Althoff, Director of Building and Zoning Lobaito, Director
of Public Works Batt, Director of Parks and Recreation Merkel, City Attorney McArdle.
Absent: Chief of Police Joyce.
TEN MINUTE PUBLIC INPUT SESSION
Wayne LaRock of 5013 Sandburg presented a petition with 400 signatures
objecting to the construction of a bridge over Boone Creek at Dartmoor Drive, citing
environmental and wildlife concerns. Mr. LaRock requested Council consider
scheduling a special meeting or adding as an agenda item their request to amend the
annexation agreement excluding the construction of the Dartmoor Drive bridge over
Boone Creek.
Alderman Bates arrived at 7:40 PM.
Mayor Cuda informed Mr. LaRock and other residents in attendance that the
next time the extension of Dartmoor Drive would be addressed by Council would be
when the developers presented their final plat. A special meeting could be scheduled
only at Council's request.
Motion by Locke to place on the agenda further discussion of the extension of
Dartmoor Drive and the construction of a bridge over Boone Creek.
Motion died for lack of a second.
Anton Rebel of 4009 Maple Avenue requested Council provide full information
regarding the ordinance violation complaint and subsequent closing of Chuck's Towing
owned by local businessman Chuck Fernstrom. Mr. Fernstrom was also in
attendance.
Mayor Cuda stated that as the case was still pending, it would not be
appropriate for Council to respond at this time, however, he suggested Mr. Rebel
contact Director of Building and Zoning Lobaito for further information.

FINAL DRAFT - FOURTH AMENDMENT TO McHENRY CORPORATE CENTER
ANNEXATION AGREEMENT
Mayor Cuda reported that on August 30, 1995 Council had authorized the
Mayor and City Clerk's execution of the proposed fourth amendment to the McHenry
Corporate Center's Annexation Agreement. Paragraph 5 of the fourth amendment
outlined Gary Lang's responsibility to improve a portion of Dayton Street. During
finalization Gary Lang's attorney requested that paragraph 5 be revised to reflect the
obligation of Dayton Street's construction to the property owners, Cooper Brothers
(Midwest Properties Limited and Cosmopolitan Bank and Trust). Cooper Brothers and
Gary Lang have now agreed to the revised language and request Council accept and
ratify the Fourth Amendment to the McHenry Corporate Center's Annexation
Agreement as presented.
Motion by Locke, seconded by Bolger, to accept and ratify the final draft of the '1
Fourth Amendment to the McHenry Corporate Center Annexation Agreement dated
July 19, 1989 conditionally approved on August 30, 1995, reflecting the change in
Paragraph 5 obligating property owners Cooper Brothers to the construction of Dayton
Street.

SEMI-ANNUAL DISTRIBUTION OF DEVELOPER DONATION FUNDS TO TAXING
DISTRICTS
Mayor Cuda drew Council's attention to the accounting of developer donation
fees collected from July 1 , 1995 through December 31, 1995. He stated that as per
the City's Subdivision Control Ordinance, Council must direct the City Clerk to
disperse these funds to the appropriate taxing bodies.
Motion by Lawson, seconded by Bolger, to approve the distribution of semi-
annual developer donation fees for the period July 1 , 1995 through December 31 ,
1995 to the School Districts, Library District and Fire Protection District by the City
Clerk as follows:
School District 156 $ 59,697.75
School District 15 $110,867.25
McHenry Public Library District $ 15,052.00
McHenry Fire Protection District $ 15,052.00
TOTAL $200,669.00

AWARD OF BID - BACKHOE FOR PUBLIC WORKS DEPARTMENT
Director of Public Works Batt reported that bids were sought and submitted for
a current model year wheel loader/backhoe. The low bidder, Lewis Equipment of
Crystal Lake, was deficient in several areas, and did not, in fact, meet specifications.
In light of this information, it is the recommendation of staff to award the bid to the
next lowest bidder, George Freund of McHenry, in the amount of $51 ,200.00.
Motion by Locke, seconded by Bolger, to award the wheel loader/backhoe bid
to the second lowest bidder, George Freund of McHenry in the amount of
$51 ,200.00, as the lowest bidder did not meet specifications.

Some discussion followed regarding the procedure for dealing with bids not
`— meeting specifications.
FINAL PLAT - McCULLOM PLACE II
Director of Public Works Batt stated that G & H Development Corporation is
seeking final plat approval for McCullom Place II subdivision. David Mangurten,
architect for Kaplan, Mangurten Architects, was also in attendance. Batt noted all 11
conditions for preliminary plat approval had been met, and developers had agreed to
raise the east wall of the detention basin six feet to accommodate both Gerstad's
development and McCullom Place II. Director of Public Works Batt also reported that
this subdivision will provide for a right-hand turn lane on Route 31 , but will not create
additional egress and ingress onto Route 31 .
Motion by Lawson, seconded by Locke, to approve the final plat of subdivision
for McCullom Place II, subject to the receipt of a letter of credit for $102,900.00 to
guarantee construction of public improvements.

Some discussion ensued regarding the placement of a fence around the
detention area. Director Batt explained that additional improvements by Gerstad
Builders were yet outstanding, making the placement of a fence impractical at this
time.

REPLACEMENT OF 1987 PLYMOUTH ARIES - PARKS AND RECREATION
DEPARTMENT
Director of Parks and Recreation Merkel reported that the 1995-96 Budget
contains funds for the replacement of a mid-sized station wagon in the Parks and
Recreation Department. The Illinois State bid for a mid-sized station wagon was
awarded to Crown Oldsmobile Toyota, Decatur, Illinois in the amount of $13,699.00.
A letter was sent to the five local car dealerships inviting the submission of bids on
this vehicle or a comparable vehicle. No bids were received. Therefore, it was the
recommendation of staff to authorize the purchase of a 1996 mid-sized station wagon
through the State Bid program contract in the amount of $13,699.00. Some
discussion followed regarding potential problems with parts and service of a vehicle
purchased from a dealership located in Decatur. Additional discussion yielded the
consensus that the purchase of a mini van might be more practical. Council also
stated their desire to meet with local car dealers to discuss the bidding process for
vehicle purchases.
Motion by Bolger, seconded by Baird, to direct the City Clerk to schedule a
meeting with the City of McHenry car dealerships one-half hour to 45 minutes before
a regularly scheduled Council meeting to discuss the bidding process for vehicle
purchases, and to instruct Director of Parks and Recreation Merkel to develop
specifications for Council review for the purchase of a 1996 mini van.

ZONING ORDINANCES FOR CERTAIN RECENTLY ANNEXED PROPERTIES EAST OF
THE FOX RIVER
Director of Building and Zoning Lobaito stated that the eighteen zoning
ordinances currently before Council are the first of three groups to be presented
relating to the recently annexed properties east of the Fox River. Lobaito explained
the first 15 properties are requesting comparable City zoning from their current County
classification. Staff considered the existing County zoning on the properties and the
present land use to arrive at a City zoning designation. The remaining three properties
requested higher City zoning than their current County zoning classification, however,
all these requests were compatible with the City's Comprehensive Plan. The Zoning
Board of Appeals recommended approval of all 18 zoning petitions.
Motion by Baird, seconded by Bolger, to accept the Zoning Board of Appeals'

MAYOR - STATEMENTS AND REPORTS
Mayor Cuda reported the County Board had concurred with the Community
Development Block Grant Commission and formally approved their recommendation
to award a Community Development Block Grant to the City of McHenry in an amount
of $185,000 for the force main project. Director of Public Works Batt has scheduled
a meeting with John Labaj, the community development manager, for next week to
fill out the appropriate paperwork.
COMMITTEE REPORTS
Alderman Bates reminded Council of the Parks and Recreation Committee meeting
scheduled for January 24, 1996 at 7:30 PM at the Municipal building. Bates also
reminded the Parks and Recreation Committee members that a meeting has been
scheduled for February 5, 1996 with the Soccer Federation and all baseball league
representatives.
Alderman Lawson, Chairman of the Finance Committee, rescheduled the
January 22, 1996 meeting to February 12, 1996 at 7:30 PM.
STAFF REPORTS
City Clerk Althoff, referencing her memo, requested Council consider Habitat for
Humanities' request that all zoning fees be waived in connection with their zoning
petition. Habitat for Humanity is seeking a zoning variance so that the organization
may rent office space from the McHenry Public Library located at 809 N. Front Street.
The associated zoning fees amount to $750.00.
Motion by Baird, seconded by Lawson, to approve the request of Habitat for
Humanity and waive all the zoning fees associated with their zoning petition request
for a use variance to allow the use of office space at McHenry Public Library, located
at 809 N. Front Street, excepting those costs actually incurred under retained
personnel, and to direct the City Clerk to respectfully request the Zoning Board of
Appeals members to consider waiving their compensation for this zoning petition.

Attorney McArdle stated his intent to waive his legal fees associated with this
petition as well.
City Clerk Althoff also requested Council respond to Kit Carstens' invitation to visit
the Corporate Center for a brief overview of the Corporate Center's current plans. It
was the consensus of Council to schedule a Committee Meeting of the Whole for
Monday, January 22, 1996 at the McHenry Corporate Center in Prime Commercial's
offices located at 4500 Prime Parkway to review the current plans for the McHenry
Corporate Center.
City Clerk Althoff also drew Council's attention to the Tax Objections (Assessed
valuation) included in the Aldermen's agenda packets. She noted these requests are
always provided to Council for review, and if appropriate, action.
Mayor Cuda then informed Council that attorney Sam Diamond was requesting a
public hearing be set to consider the refunding of the West Side variable rate multi-
housing revenue bonds originally issued by the City in 1987. The letter and further
information will be provided in Friday's agenda packets.
