APRIL 24, 1996
The Annual Meeting of the McHenry City Council was called to order by Mayor
Steven Cuda on Wednesday, April 24, 1996 at 7:30 P.M. in the Council Chambers of
the Municipal Center. At roll call the following Aldermen were present: Bolger, Locke,
Bates, Lawson, Baird. Absent: None. City Staff in attendance were City Clerk
Althoff, City Administrator Jordan, Director of Building and Zoning Lobaito, Director
of Public Works Batt, Director of Parks and Recreation Merkel, Chief of Police Joyce,
City Attorney McArdle.
TEN MINUTE PUBLIC INPUT SESSION
Andy Glab of 5001 Oakwood Drive addressed Council on behalf of the
Oakwood Drive property owners, stating their concern with trespassers who are using
their properties as a cut-through to the park. He requested Council consider placing
signs on the park backstops reminding people to respect the rights of the private
property owners.

1996 FIREWORKS AND JAYCEES DAY SCHEDULE OF EVENTS AND PRESENTATION
Randy Christensen, Jaycees fireworks committee chairman, presented Council
with a $15,000 check for the 1996 City of McHenry fireworks display. Mr.
Christensen outlined the schedule of events for Jaycees Day on July 6, culminating
in the fireworks display at 9:00 P.M. by Melrose Pyrotechnics of Kingsbury, Indiana.
Mr. Christensen requested Council approval for the use of Petersen Park on July 6th,
citing July 7th as the rain date, support services from McHenry Police Department for
traffic control and beach and gate security and assistance from the McHenry Parks
and Recreation Department to provide the fencing and installation required, limiting
access to the fireworks firing area. Mr. Christensen noted at this time that the Mass
Barn roof will be hosed down prior to the fireworks display, and that Melrose
Pyrotechnics uses an electronic firing system as opposed to last year's manual firing.
Motion by Baird, seconded by Lawson, to approve the use of Petersen Park on
July 6th or July 7th for the Jaycees Day events, including the 1996 fireworks display
by Pyrotechnics of Kingsbury, Indiana, and to provide the appropriate City support
services, subject to the City being named as additionally insured.

ORDINANCE AMENDMENT INCREASING THE NUMBER OF LIQUOR LICENSE
CLASSIFICATIONS "1
Mayor Cuda noted that in conjunction with his recommendations for the
1996-97 liquor license renewals, the following businesses included in the East of the
Fox River annexation needed to be added to the liquor license classifications in the
Municipal Code:
Class A from 21 to 24, including:
Ed's Pizza & Pub
Monaco's
Vickie's Place
Class B from 5 to 6, including:
Clark Oil
Class D from 2 to 3, including:
VFW
Class F from 5 to 7, including
E & S Mini Mart '1
Sunrise Grocery
Motion by Lawson, seconded by Bolger, to pass an ordinance amending Section
4-6. 1 , 2, 3, and 4 of the McHenry Municipal Code to reflect the addition of
businesses included in the East of the River annexation: Section 1 , Class A from 21
to 24 to reflect the inclusion of Ed's Pizza & Pub, Monaco's and Vickie's Place;
Section 2, Class B from 5 to 6 to reflect the addition of Clark Oil; Section 3, Class D
from 2 to 3 to reflect the addition of VFW; and Section 4 from 5 to 7 to reflect the
addition of E & S Mini Mart and Sunrise Grocery.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.

1996-97 ANNUAL LIQUOR LICENSE RENEWALS
Mayor Cuda stated that liquor establishments located in the City limits must
annually renew their license with the City of McHenry by April 30th. A list of
establishments which have submitted their liquor license renewal applications was
included in the Aldermen's agenda packets for Council review. Cuda also noted that
some establishments had not yet scheduled fingerprinting appointments for their local
managers. These establishments have been notified by letter of the fingerprinting
requirement and informed if an appointment is not made prior to May 15, 1996, the
liquor license will be revoked.
Chief of Police Joyce stated he had reviewed the list of applicants and
recommended Council approval. Mayor Cuda concurred with Chief Joyce's
recommendation.

for renewal of their 1996-97 liquor license, subject to the receipt of fingerprinting
results for those establishments whose fingerprinting results are not currently on file

Alderman Bolger requested at this time Council consider prior to the renewal of
liquor licenses for the 1997-98 fiscal year, the possible inequity of one fee for each
classification type regardless of the size of the business.

The next item on the agenda, "Preliminary Approval of Thomas J. Rupp
Subdivision", was deferred at this time, as the attorney for the petitioners was not yet
in attendance.
MAYOR - STATEMENT AND REPORTS
Mayor Cuda noted he and staff continue to meet with the Busch/Knox family
in an effort to resolve outstanding issues pertaining to the Bull Valley Road extension.
The Army Corps of Engineers continues to state their concerns regarding the
preservation of wetlands in this area. Cuda informed Council the Busch/Knox
annexation agreement may need to be amended to address these concerns.
Mayor Cuda then presented his 1996-97 appointments. He requested Council
approval of these appointments.

PRELIMINARY PLAT APPROVAL - THOMAS J. RUPP SUBDIVISION
Attorney for the petitioners, Guy Youman, was now in attendance. Youman
addressed Council stating this agenda item had been tabled at the April 17, 1996 regular
Council meeting in order for the petitioners to collect and provide further information
regarding the impact the development of this project will have on current traffic flow. He
distributed copies of a traffic study conducted by Smith Engineering and stated the study's
results indicated an overall 10% increase in traffic flow from the development of this project.
He offered his clients' willingness to commit to the assumption of 10% of the total cost for
the installation of a traffic light at the intersection of Route 31 and Shamrock Lane, citing a
$15,000 ceiling. Youman noted this offer was only valid in exchange for the Council's
waiving of the Subdivision Control Ordinance's requirement for sidewalks. Youman also
noted the petitioners were agreeing to the installation of only two streetlights along
Shamrock Lane.
After a lengthy discussion regarding Council's desire to enforce the requirement for
additional streetlights and sidewalks, it was the consensus of Council to table this agenda
item once again.
Motion by Locke, seconded by Lawson, to table the approval of the Thomas J. Rupp
Subdivision preliminary plat.

Mayor Cuda directed the petitioners to meet with staff and attempt to work out all the
outstanding issues, including the Subdivision Control Ordinance requirements regarding
sidewalks and streetlights.
_. COMMITTEE REPORTS
There were no Committee Reports for this evening's meeting.
STAFF REPORTS
Director of Parks and Recreation Merkel noted that the end of the year dance recital,
swimming registration and the Fort McHenry volunteer work day were all scheduled for this
Saturday, April 27, 1996. Merkel also complimented the Jaycees for their extended efforts
in obtaining a reliable service oriented fireworks company.
Chief Joyce informed Council, in response to Mrs. Rhonda Clayton's letter regarding
safety issues and annoyances in the Martin Woods II area, noted his department was aware
of the problems and as stated in Mrs. Clayton's letter, were responding. No other complaints
from this area have been received within the last six months.
City Clerk Althoff requested formal Council approval for use of the Municipal Center
on June 26, 1996 by the McHenry Women In Action.
Motion by Bolger, seconded by Baird, to approve the request by Dorothy A. McKenna,
President of the McHenry Women In Action, for use of the Municipal Center on Wednesday,
June 26, 1996 from 2:00 pm to 8:00 pm in relation to a garden walk, providing the function
does not interfere with City business taking place at the same time.

NEW BUSINESS
Alderman Bates reminded Council of his meeting with Lakeland Park residents
scheduled for Friday, April 26, 1996 at 8:00 P.M. in the Aldermen's Conference Room.

Alderman Bolger requested Council pursue development of the West McHenry Bypass.
Individual Council members expressed their commitment to this project, however, they noted
affected property owners would need to present, at a minimum, a conceptual plan of their
properties' development. .-1\
In response to Alderman Locke's inquiry, City Attorney McArdle informed Counci.
municipalities cannot enter into recapture agreements for the reimbursement of expenses
associated with City improvements.
