AUGUST 21, 1996
The Regular Meeting of the McHenry City Council was called to order by Mayor
Steven Cuda on Wednesday, August 21 , 1996 at 7:30 P.M. in the Council Chambers
of the Municipal Center. At roll call the following Aldermen were present: Bolger,
Locke, Bates, Lawson. Absent: Baird. City Staff in attendance were: City Clerk
`-' Althoff, City Administrator Jordan, City Attorney McArdle, Director of Public Works
Batt, Director of Building and Zoning Lobaito, Director of Parks and Recreation Merkel,
and Chief of Police Joyce. Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
Susan Poulos of 5816 Radcliff Court addressed Council informing them of an
ongoing drainage problem on her property. She requested Council correct the problem
to her satisfaction with an underground pipe. Mayor Cuda noted he had just received
a proposal from Director of Public Works Batt this afternoon for having this work
completed. This matter will come before Council at the regularly scheduled September
4, 1996 meeting.

Mayor Cuda introduced Kelly Wengerter, Executive Director of the McHenry
Area Jaycees. Ms. Wengerter presented Chief of Police Joyce and Carol Chrisman,
Vice President of the McHenry Area D.A.R.E. Organization, with a check in the
amount of $700.00 to be used for the D.A.R.E. program. This check represents
proceeds from the Jaycees annual "Wee King and Wee Queen" contest. Carol
Chrisman took this opportunity to address Council requesting a temporary use permit
and waiver of the $60.00 fee for the first annual D.A.R.E./McHenry Jeep Eagle Back
to School fundraiser to be held on August 22-24 in the southwest corner of McHenry
Commons parking lot.
Motion by Lawson, seconded by Bolger, to grant Carol Chrisman a temporary
use permit and waive the $60.00 fee for the first annual McHenry D.A.R.E./McHenry
Jeep Eagle fundraiser to be held on August 22-24 at the southwest corner of the
McHenry Commons parking lot.
Voting Aye: Bolger, Locke, Bates, Lawson.
Voting Nay: None.
Absent: Baird.
Motion carried.
Alderman Bolger complimented Ms. Chrisman on her efforts with the D.A.R.E.
program.
LANDMARK COMMISSION PRESENTATION OF RESOLUTIONS
Mayor Cuda presented resolutions to the following long-term Landmark
Commission members who have retired from the Commission: Marya Dixon, Adele
Froehlich, Barb Gilpin, Larry Huck and Debbie Lane. Mayor Cuda expressed his
appreciation for their commitment and dedication.
PROPOSAL FROM EDER RIEDEL & CO. FOR ADDITIONAL ACCOUNTING SERVICES
Finance Committee Chairman, Alderman Lawson, reminded Council that the
proposal from City auditor Eder, Riedel & Co. had been discussed at the August 7,
1996 Finance Committee meeting. The proposal is for additional accounting services
required throughout the fiscal year in an amount not to exceed $1 ,500.00. It was the
recommendation of the Finance Committee to approve these additional services.

Motion by Lawson, seconded by Locke, to approve the Eder, Riedel & Co.
proposal for additional accounting services throughout the 1996-97 Fiscal Year, in an
amount not to exceed $1 ,500 and to authorize the City Clerk and Mayor to execute
the agreement.

ORDINANCE AMENDING MUNICIPAL CODE - INCREASE IN NSF CHARGES
City Clerk Althoff informed Council that as the City of McHenry's bank
depository has increased their NSF charges, staff has in turn amended the City of
McHenry's ordinance accordingly.
Motion by Lawson, seconded by Bates, to pass an ordinance increasing the
Non-Sufficient Fund fee for returned checks from $10.00 to $15.00.
Voting Aye: Bolger, Locke, Bates, Lawson.
Voting Nay: None.
Absent: Baird.

LIQUOR LICENSE APPLICATION - DV8 d/b/a DIVERSIONS. 2314 W. ROUTE 120
Mayor Cuda presented the liquor license application of Candice Jarczyk,
President of DV8, Inc. d/b/a Diversions, who is now leasing the building formerly
known as "No Bull" and the "Golden Eagle Saloon", located at 2314 W. Route 120.
He noted this agenda item had been removed from the July 31 , 1996 regular City
Council agenda due to a discrepancy in the application. Ms. Jarczyk has resubmitted
a corrected application, the required paperwork and background information, paid the
$1,400 fee and has been fingerprinted. Mayor Cuda stated his recommendation to
approve the liquor license for Diversions to be located at 2314 W. Route 120, and to
pass an ordinance increasing the number of Class "A" liquor license from 24 to 25.
Some discussion followed regarding the original application's discrepancy.
Motion by Bolger, seconded by Lawson, to pass an ordinance increasing the
number of Class "A" liquor licenses from 24 to 25.

Motion by Lawson, seconded by Bolger, to approve Mayor Cuda's
recommendation and grant a Class "A" liquor license to Ms. Candice Jarcyzk,
President of DV8, Inc. d/b/a Diversions for the building located at 2314 W. Route 120.
Voting Aye: Bolger, Locke, Bates, Lawson.
Voting Nay: None.
Absent: Baird.

1995 SIDEWALK PROGRAM
Director of Public Works Batt reported Colella Concrete, was awarded the City
of McHenry's 1995 Sidewalk Program contract on April 4, 1995. Subsequently,
additional work became part of this contract for approximately $50,000. Batt reported
Colella Concrete has now completed the work, including the landscaping which was
a stated concern of Council. He requested the release of the $9,220.91 retainage
balance to Colella. He also noted a one-year maintenance warranty bond from
September 1 , 1996 through September 1 , 1997 will need to be approved prior to the
release of any funds. Alderman Locke expressed concerns with the landscape
renovation on Crystal Lake Road.

Motion by Lawson, seconded by Bates, to approve the release and final
payment to Colella Concrete in the amount of $9,220.91 , subject to the correction of
landscaping on Crystal Lake Road referenced by Alderman Locke and a one-year
maintenance warranty bond being posted.
Voting Aye: Bolger, Locke, Bates, Lawson.
Voting Nay: None.
Absent: Baird.
Motion carried.
Mayor Cuda, noting the remainder of the meeting would be devoted to the
continuation of City Administrator Jordan's workshop regarding roles of staff and City
Council, requested Council approval to excuse City Attorney McArdle. Alderman
Locke noted he had an issue which required City Attorney McArdle's presence.
Council agreed to discuss this "New Business" item before continuing City
Administrator Jordan's workshop on roles of staff and City Council.
NEW BUSINESS
Alderman Locke recommended Council consider and approve an ordinance
limiting the ability of Council to vote on any and all non-agenda items. He cited the
public's need to be informed of all issues to be voted upon. Some discussion
followed. City Attorney McArdle noted passage of this type of an ordinance would
be binding and severely limit Council actions. He suggested Council consider a motion
stating acceptable Council policy and procedures. Further discussion resulted in no
action.
Attorney McArdle was excused from the meeting at 8:15 P.M. Mayor Cuda
called for a recess at 8:15 P.M. The meeting was reconvened at 8:24 P.M. with
everyone still in attendance, except City Attorney McArdle.
ROLES OF STAFF AND CITY COUNCIL - DIRECTION AND GOALS FOR THE CITY,
WORKSHOP DISCUSSION BY CITY ADMINISTRATOR JORDAN
City Administrator Jordan noted that this evening's workshop was a
continuation from the June 12, 1996 workshop regarding roles of staff and City
Council, as well as a discussion of direction and goals for the City of McHenry. He
noted an open and honest relationship between staff and Council should be strived for
at every opportunity. Some discussion followed.
Department Heads informed Council of their possible staffing requirements over
the next five to seven years. Further discourse between Council and staff included ..,
Council's stated concern with project management. City Administrator Jordan
requested individual staff members and Council create a list of their top five goals for
the City of McHenry. Tabulation of each of the groups (i.e. staff and Council) resulted
in the following:
TOP THREE GOAL PRIORITIES
COUNCIL: Transportation, Infrastructure, Development of and services for recently annexed East of
the River properties;
STAFF: Transportation, Infrastructure, and Better Employee Relations/Vision Statement.
City Administrator Jordan noted he would provide at a future date a written
summary of this evening's workshop results.
MAYOR - STATEMENT AND REPORTS
Mayor Cuda informed Council that he had met with Louis Pacini, who informed
him that development plans for his property at Route 31 and Bull Valley Road would
be submitted within the next few weeks.
Mayor Cuda also reported there will be an Executive Session agenda item at the
regularly scheduled September 4, 1996 Council meeting for purchase of property
concerning the Bull Valley Road extension.

STAFF REPORTS
Director of Building and Zoning Lobaito informed Council that the Building and
Zoning Committee meeting scheduled for Monday, September 9, 1996 has been
rescheduled to Monday, September 16, 1996 at 7:30 P.M.
Director of Parks and Recreation Merkel stated registration for Fall programs had
begun this week. He also stated he had been meeting with the Soccer Federation in
order to develop the 1996 Fall schedule.
Chief of Police Joyce reported Officers Jenkins and Laycock had been working
on a grant to improve relations between the City of McHenry's Hispanic population
and the Police Department. Monies provided would equip the City's motor home. The
newly outfitted motor home can then be used as an emergency field office for the
D.A.R.E. program, as well as a liaison office for the Hispanic community. Council
directed Chief of Police Joyce to submit the grant application.
City Administrator Jordan reported he had met with County Highway
Superintendent Mike Magnuson. Bids for the Ridgeview Drive extension project will
be opened September 16, 1996 and awarded on September 17, 1996. The County
has also notified the City of McHenry that monitoring wells are no longer required on
the Busch-Knox property. The Bull Valley Road project is still scheduled to begin in
the Fall of 1996.
City Clerk Althoff reported the Boards of Education of District 15 and District
156 have accepte the amended Main Street purchase agreement. Official notification
will be forthcoming. District 156 Board of Education has also accepted the City's
police liaison proposal. A final contract will be presented for Council approval.
NEW BUSINESS
Alderman Lawson inquired as to whether the Planner position will be posted
internally. City Administrator Jordan and Director of Building and Zoning Lobaito
responded affirmatively. Director of Building and Zoning Lobaito also noted the
position will be advertised in the Northwest Herald as well as the Illinois Municipal
Review.
Alderman Locke proposed a compromise to his original recommendation
regarding the creation of an ordinance limiting Council action to only printed agenda
items. He suggested the ordinance include language permitting Council action on non-
agenda items with a 2/3 majority vote. All non-agenda items would also then require
a 2/3 majority vote to carry. Alderman Locke also requested discussion be placed on
a future Council agenda on creating an ordinance whereby police can obtain
permission to be on private property in an effort to prevent problem situations from
arising.
