HomeMy WebLinkAboutMinutes - 05/21/1997 - City Council REGULAR MEETING MAY 21, 1997 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, May 21 , 1997 in the Council Chambers of the `- Municipal Center. At roll call the following Aldermen were present: Bolger, Glab, McClatchey. Baird arrived at 7:50 P.M. Murgatroyd arrived at 9:00 P.M.. Absent: None. City Staff in attendance were: City Clerk Althoff, City Attorney McArdle, Chief of Police Joyce, Director of Building and Zoning Lobaito, Director of Parks and Recreation Merkel. Absent: Director of Public Works Batt. Officer Thomas Jenkins was sworn in by Police Commissioner Father Robert Sherry to the position of Sergeant. Mayor Cuda, Council and Chief of Police Joyce congratulated Sergeant Jenkins and wished him well. TEN MINUTE PUBLIC INPUT SESSION No one signed in to speak during the Ten Minute Public Input Session. Alderman Bolger, referencing the Innovative Packaging invoice, cautioned staff when ordering supplies for the 1997-98 Fiscal Year, to order in a manner to ensure as accurately as possible the correct quantity. PRESENTATION BY BRIAN SHAHINIAN OF NORTHERN ILLINOIS SPECIAL RECREATION ASSOCIATION L Mayor Cuda introduced Northern Illinois Special Recreation Association Executive Director Brian Shahinian. Mr. Shahinian informed Council the Northern Illinois Special Recreation Association (NISRA) has provided recreation programs to people with disabilities since 1976. NISRA offers a variety of year-round programming including trips, sports, social and cultural programs for people of all ages with special needs. Partner member districts include Barrington, Cary, Crystal Lake, Dundee Township, Marengo and Wauconda Park Districts and the cities of Harvard, McHenry and Woodstock. McHenry has been a NISRA member since December, 1992. May 21, 1997 Page 4 Mr. Shahinian introduced McHenry's regional coordinator Dana Seehafer. Ms. Seehafer noted City of McHenry participants have increased from 96 residents in 1992 to 196 in 1996. Approximately 48% of the City of McHenry participants are adults with 21 % being children. Alderman Baird arrived at 7:50 P.M. Ms. Seehafer introduced City of McHenry resident Mary Piper whose family member is a participant of the NISRA programs. She thanked the McHenry City Council for approving the annual NISRA membership allowing City of McHenry residents to participate in these programs at a reduced cost. She noted the leisure services provided allow those individuals with special needs to improve social skills, physical fitness and independence. Alderman Bolger commended the NISRA staff, citing their tireless efforts and successful programs for those individuals with disabilities. REQUEST FROM ECO-TECH FOR CITY'S CONSENT TO SELL ASSETS Joe Sadlier, President of Ecological Concepts, Inc., was in attendance. Mayor ,..� Cuda informed Council Eco-Tech L.P. was awarded a CDAP revolving loan by the City of McHenry in 1993. The original loan was for $50,000.00, and the current balance is approximately $17,000.00. Due to the unexpected and untimely death of the Sadliers' German partner, Eco-Tech L.P. is currently in default on their 1993 CDAP loan, as only interest payments have been made since January, 1997. The Sadliers are requesting the City's consent to sell the assets in which the City has a security interest. As the business purchasers are Julie and Joseph Sadlier of Ecological Concepts, Inc., and the City of McHenry's priority position will not be altered, it is the recommendation of staff that Council authorize the Mayor's execution of an agreement approving the acquisition of Eco-Tech L.P. by Ecological Concepts, Inc. (Joseph and Julie Sadlier) and to consent to the sale of assets in which the City has a security interest, subject to the City of McHenry maintaining its current priority position. Mr. Sadlier also addressed Council requesting a modification of their payment obligations on the balance of the 1993 CDAP revolving loan. He noted the monthly payment of $920.83 will remain the same, however, the payment schedule has been extended two months. City Attorney McArdle noted CDAP administrator Jay Bales informed him by phone that CDAP will concur with the City's final action with regard to the payment schedule, however, official notification of the City's -� decision must be submitted to their offices in writing with the next semi-annual report form. Mayor Cuda suggested the legal fees incurred by the City of McHenry with regard to this loan be reimbursed by Ecological Concepts, Inc. Mr. Sadlier concurred and requested these legal fees be added to the total of the last loan payment due in November, 1997. Council concurred. Motion by Baird, seconded by Bolger, to authorize the Mayor and City Clerk's execution of a letter of agreement between the City of McHenry and Eco-Tech L.P. approving the acquisition of Eco-Tech L.P. by Ecological Concepts, Inc. and authorizing the sale of assets in which the City has a security interest, subject to the City of McHenry's maintaining its current priority position and to approve the revised payment schedule through November of 1997, subject to the addition of all legal fees incurred by the City of McHenry to the last loan payment due in November of 1997 by Ecological Concepts, Inc. May 21, 1997 Page 5 REQUEST FROM McHENRY SAVINGS BANK FOR LETTER OF CREDIT TO PROVIDE COLLATERAL FOR CITY FUNDS `.- Mayor Cuda introduced McHenry Savings and Loan Bank President Kathleen Marinangel, noting Council had requested at the regularly scheduled April 23, 1997 meeting this agenda item be postponed until more detailed information could be provided. Ms. Marinangel addressed Council requesting consideration to change the security for deposits of the City of McHenry at the McHenry Savings Bank in excess of $100,000.00. She proposed the City of McHenry receive a Letter of Credit issued by the Federal Home Loan Bank of Chicago as collateral for all deposits in excess of $100,000.00. She noted the average deposit the City of McHenry retains with McHenry Savings Bank is approximately $3 million. City Attorney McArdle stated the utilization of a Letter of Credit for collateral was not an issue with Council as the City of McHenry utilizes Letters of Credit to secure funds from developers for all public improvements. Council concern centered around the financial viability of the Federal Home Loan Bank. Mayor Cuda, concurring with City Attorney McArdle's assessment, introduced James Schmidt, investment advisor and registered broker/dealer of LPL Financial Investments, McHenry, Illinois. Mr. Schmidt informed Council the Federal Home Loan Bank is a top rated institution with the implied full faith and credit of the Federal Government. It maintains a Standard and Poors rating of AAA and in the 70+ years of business, the Federal Home Loan Bank has never posted a credit loss. Some discussion followed. Motion by McClatchey, seconded by Baird, to authorize the use of a Letter of Credit issued by the Federal Home Loan Bank as collateral to secure City of McHenry funds deposited in the McHenry Savings Bank in excess of $100,000.00. Voting Aye: Bolger, Glab, McClatchey, Baird. - Voting Nay; None. Absent: Murgatroyd. Motion carried. In response to Alderman Bolger's inquiry, Ms. Marinangel noted the Savings Bank was not subject to any form of borrowing cap or limit. If increased borrowing advances are required, McHenry Savings Bank must purchase additional Federal Home Loan Bank capital stock in an amount equal to the borrowed advance plus 5%. Mayor Cuda noted Attorney McArdle will develop the language and terms of the letter of `.. credit with McHenry Savings Bank. Noting the following inquiry might be out of order, Alderman Bolger asked Ms. Marinangel whether the McHenry Lions Club had also obtained permission from McHenry Savings Bank to house their annual carnival in the portion of the Green Street parking lot owned by McHenry Savings Bank. Ms. Marinangel informed Council McHenry Savings Bank was working closely with the McHenry Lions Club to prepare for their annual carnival. PURCHASE OF UTILITY VEHICLE FOR USE BY PARKS DEPARTMENT Director of Parks and Recreation Merkel reported the 1997-98 Budget includes -- $6,000.00 for the purchase of a utility vehicle for the Park Maintenance Department. As the purchase price was under $10,000.00, four quotes were obtained as opposed to bids. The vehicle will be used primarily at Petersen Park for a wide variety of light maintenance duties. The low quote was submitted by Town & Country Power Equipment in Wauconda, Illinois in an amount of $5,994.21 . In response to Alderman McClatchey's inquiry, Director Merkel noted as this utility vehicle was considered part of the manufacturer's commercial line, no local dealerships carried this specific model. May 21 , 1997 Page 6 Motion by Bolger, seconded by McClatchey, to approve the purchase of a John Deere utility vehicle from the low quote, Town & Country Power Equipment of Wauconda, Illinois in an amount not to exceed $5,994.21 . Voting Aye: Bolger, Glab, McClatchey, Baird. Voting Nay; None. Absent: Murgatroyd. Motion carried. MAYOR - STATEMENT AND REPORTS Mayor Cuda reported he and Director of Parks and Recreation Merkel had met with County Transportation Superintendent Michael Magnuson and Ken Fiske to discuss the status of the Bull Valley Arterial construction. Mr. Magnuson informed them the Soil and Conservation District has recommended an erosion control plan, and upon its acceptance by the McHenry County Board of its implementation,the permit application will be submitted to the Army Corps of Engineers for approval. Mr. Magnuson is still anticipating a September, 1997 date for the award of a construction bid. Mayor Cuda also reported a wetlands management plan must be agreed to prior to the Army Corps of Engineers granting of the permit. An intergovernmental agreement between the City of McHenry and McHenry County will be developed establishing the County's responsibility to establish and construct the wetland area and the City of McHenry's responsibility to maintain the wetlands area. Some discussion ensued. Mayor Cuda forewarned Council the Army Corps of Engineers would be reviewing and commenting on the City of McHenry's current wetlands maintenance programs at the South Wastewater Treatment Plant and South Riverfront Park areas. COMMITTEE REPORTS There were no Committee reports at this time. STAFF REPORTS Director of Building and Zoning Lobaito reported the remaining three project bids for the Mass Barn renovation were submitted and opened on Friday, May 9, 1997. -� Award recommendations will be presented for Council approval at the next regularly scheduled Council meeting. Director of Parks and Recreation Merkel reported bids for the bleacher and picnic table purchase were submitted and opened today, Wednesday, May 21 , 1997. Award recommendations will be presented for Council approval at the June 4, 1997 regularly scheduled Council meeting. Director Merkel also stated a copy of the 1993 Gold Medal Award NISRA video will be available in the City Clerk's office for Council review. NEW BUSINESS In response to Alderman Baird's inquiry, Director of Building and Zoning Lobaito reported the berm seeding along Irish Prairie's property line had not yet occurred due to inclement weather. Director Lobaito noted additional height had been added to the berm and the silt fence had been installed. Seeding will occur as soon as weather permits. Alderman Baird also recommended that if additional monies were left from the -� 1997 City of McHenry Streets Program, the existing Bull Valley Road be resurfaced. Alderman Baird also requested staff contact East of the River sanitary sewer construction firm Joel Kennedy Construction and request the correction of the construction area near the VFW baseball fields, citing safety concerns. Alderman Bolger stated he had placed the same request with Director of Public Works Batt previously. May 21 , 1997 Page 7 Alderman McClatchey informed staff he had received complaints from Mill Creek Subdivision residents regarding the start-up of construction machinery at 6:30 a.m. Mayor Cuda directed staff to investigate these complaints and respond appropriately. Alderman Bolger reported the removal of the platform on Anne Street apparently assisted in the correction in the drainage problem in this area, as demonstrated during the last heavy rainfall. He also requested City crews clean the stormwater ditches in the 3800 block of Anne Street, as the erosion in this area is severe. He also requested Council consider authorizing the correction of the drainage in the Anne Street area which empties into the City's sewer lines. Alderman Glab informed Council he had attended the Zoning Board of Appeals meeting held on Monday, May 19, 1997. He noted the issue of traffic and speeding violations were addressed extensively. He stated it should be the responsibility of all McHenry citizens to control their speed. Alderman Baird also requested staff develop and deliver to Mayor Cuda their problem scenarios for utilization during the City Administrator interviews. Mayor Cuda requested Council consider changing the May 28, 1997 Committee L„ Meeting of the Whole to a Special Meeting, as numerous issues needed resolution. Motion by McClatchey, seconded by Glab, to authorize the scheduling of a Special Meeting on Wednesday, May 28, 1997 at 7:30 P.M., as opposed to a Committee Meeting of the Whole previously scheduled. Voting Aye: Bolger, Glab, McClatchey, Baird. Voting Nay; None. Absent: Murgatroyd. Motion carried.
