AUGUST 20, 1997
`• The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda at 7:30 P.M. on Wednesday, August 20, 1997 in the Council Chambers of the
Municipal Center. At roll call the following Aldermen were present: Bolger, Glab,
McClatchey, Murgatroyd, Baird. Absent: None. City Staff in attendance were: City
Administrator Lobaito, City Clerk Althoff, City Attorney McArdle, Director of Public
Works Batt. Absent: Chief of Police Joyce, Director of Parks and Recreation Merkel.
TEN MINUTE PUBLIC INPUT SESSION
No one signed in to speak during the Ten Minute Public Input Session.
REQUEST FROM MCHENRY JAYCEES FOR USE OF CITY PROPERTY FOR HAUNTED
HOUSE
Sonny Matthews, McHenry Area Jaycees Haunted House Chairman, and
Annette Maldanado, McHenry Area .Jaycees Chapter Representative, were in
attendance. Mr. Matthews addressed Council requesting Council approval for the use
of Knox Park and the Knox Park Barn to host the Annual McHenry Area Jaycees
Haunted House events on October 10th, 11 th, 16th, 17th, 18th, 23rd, 24th, 25th,
`- 26th, 29th, 30th, 31 st and November 1 st. Mr. Matthews noted the event has been
expanded to include three food vendors each night. The vendors will be limited to Mr.
Funnel Cake, Mr. Funshine, and the McHenry Area D.A.R.E. Parents Organization.
Council was reminded the proceeds from this event underwrite the City's Fourth of
July Fireworks Display.
Motion by Bolger, seconded by McClatchey, to approve the use of City
Property, Knox Park and the Knox Park Barn, to host the McHenry Area Jaycees
Annual Haunted House event on October 10th, 11 th, 16th, 17th, 18th, 23rd, 24th,
25th, 26th, 29th, 30th, 31 st and November 1 st; and to permit three food vendors
each evening subject to staff verification of Health Department permits and receipt of
insurance certificates.

In response to Alderman Baird's request to include the Block Party request from
Kevin Kutz to close Pearl Avenue from Stillhill Drive to Beach Road on August 31 ,
1997 from 11 a.m. to 8 p.m., this item was added to the Consent Agenda.

STOP SIGN REQUEST AT CHESTNUT AND BIRCH - THE OAKS OF MCHENRY
City Administrator Lobaito reminded Council at the regularly July 30, 1997 Meeting staff
was directed to review the second phase of the Oaks of McHenry Subdivision to determine
appropriate traffic control at the intersection of Chestnut Drive and Birch Lane. A request had
been presented by Joanne Knox of the Oaks of McHenry for a four-way stop at Chestnut Drive
and Birch Lane. At this time it was the recommendation of staff to install stop signs on the
street with the lower volume of traffic. Review of the Oaks of McHenry Phase II Subdivision's
street layout would appear to demonstrate that Birch Lane will potentially be the street with a
lower volume of traffic. Therefore, it is the recommendation of staff to install a two-way stop
sign on Birch Lane. Some discussion followed.
Staff is also recommending the current Subdivision Control Ordinance be amended to
require developers to submit a traffic control plan based on a traffic study for Council review
and approval during the Final Platting Process.
City Administrator Lobaito stated the implementation of this policy would eliminate for
the most part future isolated requests for traffic signs. Mayor Cuda recognized Ms. Knox of
3316 Chestnut Drive. Mrs. Knox addressed Council stating her original request for a four-way
stop sign at the Birch Lane and Chestnut Drive intersection was based on an apparent increase
in traffic and the large number of small children playing in the area. A short discussion ensued
regarding the need to reduce the speed of area traffic. Director of Public Works Batt suggested
the installation of speed limit signs. Council concurred and directed Director Batt to install
appropriate speed limit signs in this area. Alderman Baird also requested similar signage along
Winding Creek Drive in Winding Creek Unit 4 Subdivision.
Motion by Baird, seconded by Bolger, to authorize staff to prepare an Ordinance adding
stop signs on Birch Lane, northbound and southbound, at its intersection with Chestnut Drive,
and to authorize staff to draft an ordinance modifying the Subdivision Control Ordinance and
thereby creating a policy to require developers to submit a traffic control plan based on a traffic
study for Council review and approval during the Final Platting Process.

AGREEMENT BETWEEN THE CITY OF MCHENRY AND CUNAT BROTHERS, INC.
FOR PARKING LOT CONTROL -�
City Administrator Lobaito informed Council the agreements with property owners Cunat
Brothers, Inc. for parking lot control at:
• The Greens of Irish Prairie;
• Lillian/Kane Street Apartments;
• Fawn Ridge Trails; and
• West Side Crest Apartments;
are identical to the agreement previously approved by Council with Mid-America Management
for the Garden Quarter Complex. The City of McHenry Police Officers, under the Agreement,
are empowered to enter the parking lots of the privately-owned residential communities and
regulate the parking of automobiles and the traffic at such parking areas as well as enforce its
restrictions for disorderly conduct as defined in City of McHenry's Municipal Code, Section 14-
3(13).
Alderman Glab stated a similar agreement may be drafted for the Whispering Oaks
Community Center's Parking Lot.
Motion by Murgatroyd, seconded by Bolger, to approve and authorize the Mayor and
City Clerk's execution of the agreements between the City of McHenry and Cunat Brothers, Inc.
permitting the City of McHenry Police Department's regulation of parking of automobiles and
the traffic at such parking areas, as well as enforcement of the disorderly conduct ordinance as
defined in the City of McHenry's Municipal Code, Section 14-3(13) for the following four
properties:
• The Greens of Irish Prairie;
• Lillian/Kane Street Apartments;
• Fawn Ridge Trails; and
• West Side Crest Apartments.
Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird.
Voting Nay: None.
Absent: None.

MAYOR - STATEMENT AND REPORTS
Mayor Cuda informed Council notification from the Army Corps of Engineers had been
received by the City of McHenry stating the public comment period would be concluded on
September 8, 1997. No comments had been received thus far. Mayor Cuda stated he would
continue to keep Council informed. Bid letting for this project was still anticipated for early
Fall, 1997.
Mayor Cuda, referencing his memo regarding the City Administrator contract, requested
Council approval and authorization to execute. He noted the contract encompasses all previously
agreed upon provisions.
Motion by Glab, seconded by McClatchey to approve the City Administrator contract as
presented at the August 20, 1997 regularly scheduled Council meeting and authorized the
Mayor's execution of same.

COMMITTEE REPORTS
Chairman of the Parks and Recreation Committee Alderman Baird reminded Council of
the Parks and Recreation Committee meeting scheduled for Wednesday, August 27, 1997 at 7:00
p.m. in the Aldermen's Conference Room. Discussion will occur regarding the need to obtain
public input and how to form a possible Ad Hoc Committee for the Feasibility Study of
Constructing a Recreational Center. Alderman McClatchey suggested information be placed in
the next City Newsletter.

Chairman of the Finance Committee Alderman Murgatroyd informed Council the Finance
'�-- Committee had met last evening, August 19, 1997 at 7:00 p.m. The meeting minutes would be
forthcoming in the Friday, August 29, 1997 Agenda packet. The 1996-1997 Audit was reviewed
and preliminary discussion with regard to an increase in water/sewer rates and Capital
Development Fees was initiated. The Finance Committee then scheduled a continuation meeting
for Monday, September 29, 1997 at 7:00 p.m. in the Aldermen's Conference Room.
STAFF REPORTS
Director of Public Works Batt reported the Main Street Parking Lot was now open.
Currently the parking lot is non-regulated with no parking restrictions. The type of parking
restrictions appropriate for this particular parking lot will be addressed as an Agenda item at the
next regularly scheduled Council Meeting. Director Batt requested Aldermen contact him prior
to this time with any recommendations they might have regarding potential parking restrictions
for this lot.
City Administrator Lobaito reported three Public Works bids had been solicited and
opened during the past week: the Catch Basin and Sewer Jet purchase; the Lakeland Park
Drainage Ditch Project; and the South Wastewater Treatment Plant Expansion Project. Award
�-- of purchase and contract will come before Council at the next regularly scheduled Council
Meeting, September 3, 1997. In response to Alderman Baird's inquiry, City Administrator
Lobaito noted the South Wastewater Treatment Plant Project had come in slightly higher than
anticipated.
City Clerk Althoff informed Council requests for designated Halloween Trick or Treat
Hours had been received from District 15 representatives. She requested Council consider the
matter and set appropriate hours. Some discussion followed.
Motion by McClatchey, seconded by Baird, to authorize the hours from 3:00 p.m. to
7:30 p.m. on Friday, October 31, 1997 as the official 1997 Halloween Trick or Treat Hours.

NEW BUSINESS
-- Alderman Bolger informed Council donations were being received by the City in memory
of Liz Nolan. Staff had suggested a memorial garden including a dedication plaque be created
at Neumann Park. Some discussion followed.
Motion by Baird, seconded by Bolger, to authorize staff to proceed with the creation of
a Liz Nolan Memorial Garden in Neumann Park with the purchase of a dedication plaque.

Absent: None.

Alderman Bolger also recommended Council consider restricting the Main Street Parking
Lot to a maximum of 4 hours.

Personnel and Collective Bargaining.
