Home My WebLink AboutMinutes - 01/05/2015 - City Council (2) REGULAR MEETING January 5,2015 Mayor Low called the regularly scheduled January 5, 2015 meeting of the McHenry City Council to order at 7:00 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer, Blake, Wimmer, Peterson and Condon. Absent: None. Also in attendance were City Administrator Morefield, Director of Economic Development Martin, Deputy City Administrator Hobson, Director of Finance Lynch, Director of Public Works Schmitt, Chief of Police Jones, City Attorney McArdle and City Clerk Jones.Absent: None. READING OF THE MISSION STATEMENT BY MAYOR LOW Mayor Low read the Mission Statement of the City of McHenry. PUBLIC INPUT SESSION Mr. Scott Curry, 5802 Amherst, McHenry, addressed Council regarding the ordinance amending the public comment portion of public meetings. Mr. Curry expressed his concerns that amending the Ordinance of the McHenry Municipal Code regarding public input would limit individuals who wish to be heard before Council. He requested if Council does decide to amend the Ordinance that two revisions be considered to the Ordinance as currently presented: 1. At Section 2-41. Meeting to be Public, A.1.: Mr. Curry suggested that the word "shall" be inserted after the word heard, rather than the word "may;" and 2. At Section 2-41. Meeting to be Public, A.2.: Mr. Curry suggested that the amount of time that an individual may speak be extended from "3" minutes to "5" minutes. Ms. Geri Davis, 3202 Golfview, McHenry, addressed Council regarding amending the rule for public comment. Ms. Davis stated that she has misgivings regarding Council amending the Ordinance regarding the public comment portion of public meetings and is surprised the Ordinance would be considered. Ms. Davis suggested that the Ordinance should be removed immediately for consideration by Council. Mayor Low stated that it should be noted that while the proposed amendment specifically expands Section 2-41 of Article III, the rules apply for every public meeting of every public body of the municipality and are not restricted solely to Council meetings. Mayor Low stated that the Amendment actually expands the Open Meeting Act regarding public input as it adopts actual written rules to govern public comment. CONSENT AGENDA A. Alderman Santi requested that Item A be removed from the Consent Agenda and voted on as a separate item. Mayor Low inquired if Alderman Wimmer is willing to amend his motion. Alderman Wimmer agreed to amend the motion. Motion by Wimmer, seconded by Santi, to approve the Consent Agenda, as amended, Items B through E. Voting Aye: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. City Attorney McArdle stated that the Ordinance amendment was not initiated at the request of City administration. Recent decisions have been issued by the Public Access Counselor (PAC) regarding the Open Meetings Act and the Ordinance is being adopted in order to establish language to bring the City into compliance with decisions issued by PAC. The PAC decisions have determined that the simple custom or practice of a public body regarding public comment is not sufficient. Rather, PAC expects that each body adopt written rules to govern public comment. He noted that every individual who wishes to speak before Council is allowed to be heard. Regular Meeting Page 5 January 5,2015 Responding to an inquiry regarding placement on the Consent Agenda, City Attorney McArdle stated that in his experience the matter has been placed on the Consent Agenda as it does not, from a legal standpoint, stand out as a separate agenda item. Alderman Glab opined the policy at Council meetings has always been that anyone could speak to an issue that is not on the agenda. He expressed concern that public comment could be moved further down on the agenda. Mayor Low pointed out that on several occasions the agenda has been revised during a Council meeting to make an accommodation, if several persons wish to speak on a topic, so everyone would not have to wait. Alderman Glab stated that the policy should be written so it is always consistent. Alderman Condon stated she appreciates the concerns expressed regarding amending the Ordinance; however, it is her understanding that the Ordinance is merely a procedural issue and actually amending the Ordinance presents another opportunity for the conveyance of information. Alderman Condon stated she did not see any purpose in expanding the time restriction from three minutes to five minutes regarding the length of time an individual could speak since it is not a rule strictly adhered to by Council. City Attorney McArdle emphasized that the Ordinance is a procedural, compliance matter. The Public Input Session remains public input and provides the Mayor or Committee Chair an opportunity to expand a conversation, as necessary. `-' Motion by Santi, seconded by Condon, to approve Item A, an Ordinance amending Municipal Code Article III, Section 2-41, adopting rules for the public comment portion of public meetings, subject to the word "shall" replacing the word "may" at Section 2-41. MAYOR STATEMENT AND REPORT and APPROVAL OF APPOINTMENT OF SUZANNE KOTOMSKI TO MCHENRY LANDMARK COMMISSION Mayor Low acknowledged the passing of Marie Wilt, a longtime member of the Landmark Commission. She stated that Ms. Wilt's passing creates a vacancy on the Landmark Commission. Mayor Low requested that Council approve her appointment of Suzanne Kotomski to the Landmark Commission for the term expiring on April 30, 2017. COMMITTEE REPORTS Alderman Blake announced that a Public Works Committee meeting had taken place prior to the Council meeting tonight and minutes would be forthcoming. STAFF REPORTS There were no Staff Reports. FUTURE AGENDA ITEMS Alderman Glab suggested it might be helpful to residents if the entire agenda package was put on the website for Council meetings rather than only the Agenda. Mayor Low opined that this could likely be done. Deputy City Administrator Hobson stated that some of the agenda packets are large and cumbersome, however; he would check with the website host and determine if the entire packets could be accommodated on the website for each Council meeting. Alderman Peterson thanked Chief of Police Jones for the information he provided to him regarding the Motorola Starcom2l Mobile Radios and their necessity to patrolling officers.
