HomeMy WebLinkAboutMinutes - 04/23/2012 - City Council ANNUAL MEETING April 23, 2012 Mayor Low called the April 23, 2012 annual meeting of the McHenry City Council to order at 7:30 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, and Condon. Absent: None. Also in attendance were City Administrator Morefield, Deputy Administrator Martin, Assistant City Administrator Hobson, City Clerk Jones, Construction and Neighborhood Services Director Schwalenberg, Public Works Director Schmitt, Parks and Recreation Director Merkel, City Attorney McArdle, Chief of Police Jones, City Engineer Pieper. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR CLASS H LIQUOR LICENSE FROM BIG ANG INC. D/B/A THE HICKORY PIT LOCATED AT 3012 WEST ROUTE 120; AND ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 4 GRANTING AN INCREASE IN THE NUMBER OF CLASS H LIQUOR LICENSES FROM ONE TO TWO Mayor Low stated a request was submitted by Demos and Alison Archos for a Class H liquor license to serve beer and wine at tables only in conjunction with a restaurant for the Hickory Pit, located at 3102 West Route 120. A conditional use permit to serve alcohol at this location was granted by the City Council on April 16, 2012. Mayor Low stated she met with the applicant, Alison Archos, and noted Ms. Archos was fingerprinted by the McHenry Police '1 Department. The applicants are co-owners of Bimbos Bar&Grill and are conversant with Annual Meeting April 23,2012 Page 3 State of Illinois liquor regulations. The applicants have paid all associated fees and Mayor Low has no concerns with the request. It is her recommendation to approve the liquor license and to approve an ordinance increasing the number of Class H Liquor Licenses from one to two. Motion by Santi, seconded by Blake, to accept the Mayor's recommendation to grant the request for a Class H Liquor License from BIG ANG, INC. d/b/a/ The Hickory Pit located at 3102 West Route 120 with the following conditions: 1. A satisfactory fingerprint report is received for Ms. Alison Archos; and 2. All employees involved in the service of alcohol obtain BASSETT certification; And to approve an ordinance increasing the number of Class H liquor licenses from one to two. Voting Aye: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR TRANSFER OF CLASS G1 LIQUOR LICENSE FROM RESTAURANT TOLUCA III INC D/B/A/ TOLUCA'S III, 929 N. FRONT ST., TO GUSTAVO TACO AND BURRITO EXPRESS D/B/A BLUE AGAVE Mayor Low stated Gustavo Briceno is purchasing Blue Agave restaurant (formerly Toluca's) at 929 N. Front St. and is requesting a transfer of the Class G1-3 liquor license from Restaurant Toluca III to Gustavo Taco and Burrito Express, Inc. d/b/a Blue Agave. Mayor Low stated she met with Mr. Briceno, who also owns Burrito Express restaurant in McHenry. He was fingerprinted, has paid all associated fees, is conversant with State of Illinois liquor license regulations and Mayor Low has no concerns with the request. It is her recommendation to approve the transfer of the Class G1-3 liquor license from Restaurant Toluca III to Gustavo Taco and Burrito Express, Inc. d/b/a Blue Agave conditioned upon a satisfactory fingerprint report and all employees involved in the service of alcohol obtaining BASSETT certification. Motion by Schaefer, seconded by Blake, to accept the Mayor's recommendation to approve the transfer of the Class G1-3 liquor license from Restaurant Toluca III to Gustavo Taco and Burrito Express, Inc. d/b/a Blue Agave with the following conditions: 1. Annual Meeting April 23,2012 Page 4 FISCAL YEAR 2012-2013 ANNUAL LIQUOR LICENSE RENEWALS AND ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 4, SECTION 4-6 DECREASING THE NUMBER OF CLASS A LIQUOR LICENSES FROM TWENTY-SIX TO TWENTY-FIVE, AND INCREASING THE NUMBER OF CLASS A2 LIQUOR LICENSES FROM ONE TO TWO (CHILI'S GRILL & BAR); AND DECREASING THE NUMBER OF CLASS G1 LIQUOR LICENSES FROM SEVEN TO SIX(TOUCH OF ITALY) City Administrator Black stated each year at the annual meeting, owners of establishments serving and/or selling alcoholic beverages located in the City limits must renew their liquor licenses by the end of the fiscal year. Applicants and managers have been fingerprinted and all license fees have been paid. Mayor Low noted three minor changes in the proposed award of licenses: 1. Reduction in the number of Class A licenses from twenty-six to twenty-five as Chili's Grill & Bar is reclassified to Caterer-Retailer (Class A2); 2. Increase in the number of Class A2 licenses from one to two as Chili's Grill & Bar is reclassified to Caterer-Retailer; and 3. Reduction in the number of Class G1 licenses from seven to six as Touch of Italy has relocated to Shamrock Lane. The owners will apply for a liquor license for the new location pending approval of their petition for a conditional use permit to sell alcohol in conjunction with a restaurant. Mayor Low responded the Class F3 licenses authorize the sale of alcohol by service stations.
