May 21, 2012
Mayor Low called the regularly scheduled May 21, 2012 meeting of the McHenry City
Council to order at 7:30 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer,
Blake, Wimmer, Peterson, and Condon. Absent: None. Also in attendance were City
Administrator Morefield, Executive Assistant Geraghty, City Attorney McArdle, Construction
and Neighborhood Services Director Schwalenberg, Public Works Director Schmitt.
PUBLIC INPUT SESSION
There was no one who signed in to speak during the Ten Minutes of Public Input.
CONSENT AGENDA
Alderman Glab requested Consent Agenda Item B, Temporary Use Permit for THR &
Associates collectibles event, to be located at 1555 South Route 31, and Consent Agenda Item
C, Special Use/Picnic Permits, be pulled for separate consideration.
Motion by Wimmer, seconded by Condon, to approve the Consent Agenda as amended:
A. Temporary Use Permit to host community dinners at the Church of Holy Apostles,5211 Bull Valley Road;

CONSENT AGENDA ITEM B: TEMPORARY USE PERMIT FOR THR & ASSOCIATES COLLECTIBLES
EVENT TO BE LOCATED AT 1555 SOUTH ROUTE 31 FROM JUNE 12-16 2012
Alderman Glab stated he just wished to vote separately on this item as it has come up
yearly.
Motion by Wimmer, seconded by Santi, to approve a Temporary Use Permit for THR &
Associates collectibles event located at 1555 South Route 31 from June 12 to June 16, 2012, as
presented.
Voting Aye: Santi, Schaefer, Blake, Wimmer, Peterson, Condon.
Voting Nay: Glab.
Absent: None.

CONSENT AGENDA ITEM C: REQUEST TO APPROVE SPECIAL USE AND PICNIC PERMITS
Motion by Wimmer, seconded by Blake, to approve Special Use and Picnic Permits as
submitted.

Voting Nay: Glab.

REQUEST FROM FOX RIVER FLEA MARKET TO APPROVE A TEMPORARY USE PERMIT
ALLOWING OUTSIDE SALES AND DISPLAY OF MERCHANDISE FOR THE PROPERTY LOCATED AT
3017 WEST ROUTE 120
Construction and Neighborhood Services Director Schwalenberg stated a request was
submitted by Patricia Gilley, owner of Fox River Flea Market at 3017 West Route 120, to
approve a temporary use permit allowing up to 30 vendors to display and sell merchandise
outside on the paved area on the east side of their building. If approved, up to 30 spaces will
be available for outside sales and displays two days a week, Saturdays and Sundays only,
beginning June 2, 2012 through August 5, 2012. The area will be accessible from the interior
of the building only and be separated from the parking lot by a snow fence. One properly
anchored pop-up tent will be allowed per vendor, with no electric, water or signage requested,
and all merchandise will be removed each night.

It is Staff's recommendation to approve a temporary use permit to allow Fox River Flea
Market to install up to 30 outdoor vendor spaces beginning June 2, 2012 through August 5,
2012, on the paved area on the east side of their building located at 3017 West Route 120, with
the following conditions:
1. Any additional requests for outdoor display of merchandise or outdoor vendors this
year will require application for a conditional use permit;
2. The site and surrounding properties shall remain free from trash and debris at all
times;
3. All tents shall be maintained and remain in good condition for the duration of the
temporary use permit; and
4. All merchandise shall be removed at the end of each business day; and
5. The customer parking area shall be striped in compliance with the requirements of
the City Zoning Ordinance.
Alderman Santi asked Patricia Gilley, owner of Fox River Flea Market, how many vendors
would be in the outdoor area and if vendors would be using standard tents. Patricia Gilley
responded there are 10 confirmed vendors but she would limit the amount of vendors to 30.
Ms. Gilley also stated that only white and tan canopies obtained from the same company will
be erected and no tents will be used. Alderman Santi stated he is comfortable with approving a
temporary use and would like to see uniformity in the color of the canopies. Alderman
Schaefer commented he has spoken with several people and concurs there needs to be
uniformity in the color of the canopies.
Alderman Glab stated he observed setup of a similar flea market in Lake in the Hills with
different colored tents; however they all were the same size and design so it was aesthetically
pleasing. He commented that uniformity is important. He also stated Fox River Flea Market
should be given the same chance as Eckels Flea Market for outdoor vending. Patricia Gilley
stated booths at her business will be set up in an organized fashion and will not be scattered.
Alderman Peterson inquired what would happen if there was a storm on a Saturday or
Sunday. Ms. Gilley responded if a storm is imminent, vendors and customers will be warned
with an intercom system. If it is storming prior to setup, the sale would be delayed or
cancelled.
Alderman Wimmer said he is not comfortable with granting this request, but the Council
should be fair and allow the Fox River Flea Market a chance to prove they can do a better job of
keeping the site looking uniform and organized. He asked if the vendors' vehicles would be
parked next to their outdoor booths. Ms. Gilley responded vehicles would only be allowed near
the booths during setup; no vehicles will be allowed in the sales area.

\.- Alderman Peterson noted that Woodstock's Fair Diddley event last weekend allowed 17
feet between each vendor booth, which seemed adequate. Patricia Gilley replied there would
be 20 feet between the vendor booths at her business. Alderman Santi stated there seemed to
be ample spacing of the canopies in the request by Fox River Flea Market and noted this flea
market has the available space for this use unlike the other flea market in town.
Motion by Santi, seconded by Condon, to approve a temporary use permit to allow Fox

Mayor Low stated the Veterans Memorial Day Ceremony is Monday, May 28 at 10:00
a.m. in Veterans Memorial Park.

City Administrator Morefield stated a list of future agenda items was provided to the
Council noting the list is tentative and items may be removed and added.
