HomeMy WebLinkAboutMinutes - 06/04/2012 - City Council REGULAR MEETING June 4,2012 Mayor Low called the regularly scheduled June 4, 2012 meeting of the McHenry City Council to order at 7:30 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, and Condon. Absent: None. Also in attendance were City Administrator Morefield, Deputy Administrator Martin, City Clerk Jones, City Attorney McArdle, Construction and Neighborhood Services Director Schwalenberg, Public Works Director Schmitt, Parks and Recreation Director Merkel, Chief of Police Jones. Mayor Low introduced Montini Catholic School students Lilly and Maggie Sharp. Their grandfather was the high bidder at a recent school auction. Lilly and Maggie were awarded the opportunity to be "Mayor for the Day". Mayor Low visited their classroom in May. Mayor Sharp called the meeting to order and asked the City Clerk to call the roll. Mayor Sharp then led the assembly in the Pledge of Allegiance. Mayor Low thanked Mayors Lilly and Maggie Sharp for their attendance this evening. She informed them City Council meetings are televised on cable Friday nights at 7:30 p.m. PUBLIC INPUT SESSION There was no one who signed in to speak during the Ten Minutes of Public Input. Voting Nay: None. Absent: None. Motion carried. Mayor Low introduced Mary Napolitano and Pat Schaefer of the McHenry Garden Club. Mayor Low read a Proclamation naming the week of June 3 through 9, 2012 National Garden Week. Mary Napolitano thanked Mayor Low and City Council for all their support. REQUEST FROM ECKEUS MCHENRY FLEA MARKET, LOCATED AT 3705 WEST ELM STREET, FOR EXTENSION OF TEMPORARY USE PERMIT 12-04-028 ALLOWING OUTSIDE SALES AND DISPLAY OF MERCHANDISE Construction and Neighborhood Services Director Schwalenberg stated a request was made by Carl Eckel for an extension on the Temporary Use Permit approved by City Council at its April 2, 2012 meeting, for Eckel's McHenry Flea Market located at 3705 West Elm St. The temporary use permit is set to expire on June 9, 2012, and Mr. Eckel is requesting an extension be granted until July 3, 2012. Director Schwalenberg noted that Mr. Eckel is in attendance to answer any questions Council may have. The purpose of the Temporary Use Permit, when it was approved, was to include Monday evenings to supplement the Cruise Night events. Unfortunately, the temporary use Regular Meeting Page 4 June 4,2012 permit is set to expire prior to the first Cruise Night taking place. Mr. Eckel is also working with Staff on pursuing a conditional use permit to allow up to 15 vendors for the outside display and sales of merchandise on a permanent basis. Alderman Schaefer commented that he is okay with the temporary use but still would want to see uniformity if a conditional use is requested. Alderman Wimmer stated that in previous outdoor displays at this location there were no tents and there were items displayed hanging off of vehicles. Mr. Eckel responded he informed all vendors that was no longer allowed and vehicles needed to be parked away from the display area. Alderman Condon asked that this stipulation be noted in the motion for approval. Alderman Peterson stated he would like to see how this event works in conjunction with the Monday Cruise Nights. Alderman Santi asked the number of vendors that have displayed outside previously. Mr. Eckel responded there have been five so far. Alderman Santi reiterated he would like to see uniformity of color for all the tents in the outside display area. Alderman Santi asked if people attending the Cruise Nights and Flea Market would be walking across the Route 120 Bridge to travel back and forth. Mr. Eckel responded his parking lot is already being used by many people on Monday nights for parking for the Cruise Nights. Hours of the flea market would be coordinated with the hours of the Cruise Nights; approximately 3:00 p.m.to 9:00 p.m. Alderman Glab stated he has concerns with extending the temporary use permit as he has not been impressed with the outside displays he has seen so far. He also suggested the Community Development Department should look into regulating and licensing flea markets. Mr. Eckel stated he makes a concerted effort to address any concerns with any issues that come up immediately. Alderman Santi asked if the inside flea market will also be open at the same time on Monday nights. Mr. Eckel responded the interior will be closed; it will be outside display only. Motion by Schaefer, seconded by Glab, to approve the request from Eckel's McHenry Flea Market, located at 3705 West Elm St., for extension of Temporary Use Permit 12-04-028 allowing outside sales and display of merchandise with the following conditions, as presented: 1. Any additional requests for outdoor display of merchandise or outdoor vendors this year will require application for a conditional use permit; 2. The site and surrounding properties shall remain free from trash and debris at all times; 3. All tents shall be maintained and remain in good condition for the duration of the temporary use permit; '"1 Regular Meeting Page 5 June 4,2012 �. 4. There shall not be any vehicles permitted in the display area and all merchandise must be displayed under tents; and 5. All merchandise shall be removed and site cleaned at the end of each business day. Voting Aye: Schaefer, Peterson, Condon. Voting Nay: Santi, Glab, Blake, Wimmer. Absent: None. Motion denied. REQUEST FROM HABITAT FOR HUMANITY TO WAIVE FEES FOR NEW CONSTRUCTION FOR THE PROPERTY LOCATED AT 1605 HILLSIDE LANE Deputy City Administrator Martin stated a request was received from Mr. Jerry Monica, Executive Director for Habitat for Humanity of McHenry County, requesting reimbursement of all or a portion of the $14,379 in city fees required to construct a new 1304 square-foot single family home at 1605 Hillside Lane, in the Lincoln Hills Subdivision. In 1995 City Council waived fees in excess of$7,500 for a Habitat for Humanity home on Park Lane Avenue and in 2003 City Council waived fees in the amount of $7,296 for a Habitat for Humanity home on Clearview Drive. Habitat for Humanity does not profit from the construction of homes and relies heavily on donated materials and volunteers to construct the home. Mr. Monica is in the process of requesting fee waivers from the fire, library and school districts for 1605 Hillside Lane as well. Deputy Administrator Martin stated Staff recommends approval of a reimbursement of fees paid in the amount of $14,379 for the new construction of a Habitat for Humanity home located at 1605 Hillside Lane, as presented. Motion by Condon, seconded by Wimmer, to authorize reimbursement of fees in the amount of $14,379 for the new construction of a Habitat for Humanity home located at 1605 Hillside Lane, as presented. Discussion on the Motion Alderman Condon endorses this request as a whole and stated it is important as a community that we try to help those who are in need. Alderman Santi stated he would like to see this home constructed but has a concern in regard to costs the City must incur. He would like to see any fees waived in the form of a percentage. Alderman Santi also asked if requests for fee waivers were granted from the school, library and fire districts back in 1995 and 2003. Mr. Monica stated Habitat for Humanity did receive fee waivers from those districts as well, both in 1995 and 2003. Alderman Glab concurs with Alderman Santi regarding the City needing to collect some city fees associated with the construction, especially due to the economic times. He is especially concerned with fees that affect residents directly. Alderman Glab also suggested a foreclosed home be bought and renovated rather than building a new home. Regular Meeting Page 6 June 4,2012 Alderman Schaefer inquired what percentage of materials are donated, what the actual price of construction will be, and whether Habitat for Humanity has heard anything from the school districts yet. Mr. Monica responded less than half of the materials are donated; they do have corporate sponsors. The materials Habitat for Humanity must buy are also bought locally. They have a great number of volunteers and use local contractors as well. Mr. Monica also replied the price is actually$160,000 but then credit is given for volunteer labor from HUD. The sale price is based on the ability to pay and the mortgage is held by Habitat for Humanity at 0% interest. He also stated he has not heard anything back from the school districts yet. Alderman Peterson asked if the house will be built whether they get a fee waiver or not, and the completion time to build the house. Mr. Monica confirmed the foundation was already poured and the house will be built regardless. He also stated it will take about four to five months to build, work being done primarily on Saturdays. Mayor Low invited Joe Barabas, an audience member residing three blocks from the subject property, to address City Council briefly, at his request. Mr. Barabas stated he is addressing City Council as a representative of many of the homeowners in the development the Habitat for Humanity home is being built in. He stated they are concerned with any motion to waive fees for the home because they feel it will negatively affect values of other homes in the area. At the minimum, Mr. Barabas and other homeowners ask City Council to deny the fee waiver or possibly just reduce fees charged; or to postpone any decision and allow residents in the neighborhood to voice their concerns. Fees and taxes are the same thing from the neighboring homeowners' perspective and they are concerned a precedent will be set. Alderman Condon stated fee waivers will not affect property values and during these economic times it is imperative to lend assistance when we are able. City Council members are stewards of public funds and must be careful of how funds are used or waived and not collected, but as a Character Counts! Community, it is very important support is given within our community. Alderman Santi asked Mr. Monica why they chose now to build. Mr. Monica replied there is an overwhelming need in this county right now for housing for the homeless. Alderman Santi asked whether the development has a homeowner's association. He stated he is in favor of waiving some fees but not all of them. Assistant City Administrator Martin confirmed that there is no homeowner's association. Alderman Glab asked if any Habitat for Humanity homes have gone into foreclosure. Mr. Monica replied there are not any Habitat for Humanity homes in foreclosure. Alderman Glab stated he would like to help out but is not sure to what extent. He does not support waiving sewer and water fees. Regular Meeting Page 7 June 4,2012 Alderman Schaefer stated he does not want to waive all the fees and suggested postponing a vote to a later date in order to analyze the fee breakdown. Mayor Low invited City Administrator Morefield to comment on the fee waiver discussion. Mr. Morefield suggested waiving the fees associated with the parks, tap-on, annexation, building and plumbing, which would bring the fee waiver to about $7,511. He stated this amount would preserve the capital development, sewer and water, developer donation, and water meter fees, essentially reducing total fees charged by about half. Alderman Schaefer clarified the fee waiver amount is $7,511 and we were not reducing it by$7,511 and he is comfortable with that. Alderman Blake concurred. Alderman Condon amended her motion to approve a waiver of fees in the amount of $7,511 total, for new construction of a Habitat for Humanity home located at 1605 Hillside Lane as amended per the recommendation of City Administrator Morefield. Alderman Wimmer seconded the motion, as amended. Discussion was held regarding correcting wording in the motion to reflect approval of a fee waiver of some other taxing body district fees being subject to their own approval. Motion by Condon, seconded by Wimmer, to approve a waiver of fees in the amount of $7,511 total, for new construction of a Habitat for Humanity home located at 1605 Hillside Lane, excluding fees, subject to approval from School Districts 15 and 156, and the McHenry Library District and Fire District, as amended. Voting Aye: Glab, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: Santi. Absent: None. Motion carried. Mayor Low introduced Mary Donner from Pace. Mary stated McHenry County is partnering with Pace in a single contract for the City of McHenry, the City of Crystal Lake, and the City of Woodstock for consistent rates, consistent hours, consistent, longer and cheaper service and better routes in McHenry County. Pace hopes to provide information via the internet as well. REQUEST FROM THE SUBURBAN BUS DIVISION OF THE RTA(PACE) FOR: 1. APPROVAL OF AN ORDINANCE AUTHORIZING THE MAYOR'S EXECUTION OF THE ADVERTISING TRANSIT SHELTER AGREEMENT BETWEEN THE CITY OF MCHENRY, SUBURBAN BUS DIVISION OF THE RTA (PACE). TITAN OUTDOOR, AND PIONEER CENTER FOR HUMAN SERVICES:AND 2. APPROVAL OF A VARIANCE FROM THE SIGN ORDINANCE TO PERMIT OFF-SITE ADVERTISING ON THE PACE BUS SHELTER AT 4001 DAYTON STREET. Regular Meeting Page 8 June 4,2012 Assistant City Administrator Martin stated that last year, Pace implemented an advertising transit shelter replacement program in the City, whereby the property owner receives one-half or 31.25% of Pace's share of gross advertising billings. Advertising transit shelters are located on Green Street adjacent to the former City Hall, at 4100 Veterans Parkway, and at the northeast corner of Ridgeview Drive and Prime Parkway. An additional shelter will be constructed at 5330 West Elm Street, the location of Transitional Living Services for Veterans. To date the City has received $1,963 from the ad shelter on Green Street and the shelter at the NE corner of Ridgeview Drive and Prime Parkway. Pace is also proposing to remove two non-ad shelters and install one ad shelter on property owned by Pioneer Center, located at 4001 Dayton Street. The City will not receive any monetary compensation as the shelter will be installed on private property; however, it is within the city's corporate limits. The City will not be liable or responsible for the shelter in any way but Council approval of a variance is required to allow off-site advertising on the shelter. Alderman Schaefer asked City Attorney McArdle if the City has any liability by agreeing to this partnership agreement. City Attorney McArdle would like to review the agreement more thoroughly and suggests a motion is made subject to attorney review. Alderman Santi suggested a cigarette butt disposal unit be added to the shelters, especially the shelter located in front of the old City Hall on Green Street. Mary Donner responded that Titan Outdoor is supposed to clean up the shelters once a week and she will look into making sure they are maintained better. Alderman Glab stated he has issues with the request due to the fact that the City does not collect revenue but still has liability. He has concerns with the financial liability. Motion by Schaefer, seconded by Condon, to approve a request from the Suburban Bus Division of the RTA(Pace)for: 1. Approval of an Ordinance authorizing the Mayor's execution of the Advertising Transit Shelter Agreement between the City of McHenry, Suburban Bus Division of the RTA (Pace),Titan Outdoor, and Pioneer Center for Human Services; and 2. Approval of a variance from the sign ordinance to permit off-site advertising on the Pace bus shelter at 4001 Dayton Street, subject to City Attorney's review, as amended. Voting Aye: Santi, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. Regular Meeting Page 9 June 4,2012 MAYOR STATEMENT AND REPORT Mayor Low introduced Ben Spengel, a resident in the audience. Ben has been responsible for bringing the Run & Roll Track Meet to our community. This year it will be held Wednesday evening,June 6 at 5:00 p.m. at McCracken Field. It is the 5th year of the event. The first City band concert will be held this Thursday, June 7 at Veterans Park, and the Kiwanis Soap Box Derby will be held this Saturday,June 9. COMMITTEE REPORTS Alderman Condon stated the Community Development Committee meeting scheduled for Tuesday, June 19 at 7:00 p.m. needs to be rescheduled to Tuesday June 26. Committee members are asked to contact either her or Assistant City Administrator Martin. Alderman Wimmer stated the Finance and Personnel Committee meeting is scheduled for Monday,June 18, at 6:30 p.m.,just prior to the City Council meeting. Alderman Blake stated the Public Works Committee meeting will be held on Monday, July 2, at 6:00 p.m.,just prior to the City Council meeting. STAFF REPORTS There were no Staff reports. FUTURE AGENDA ITEMS City Administrator Morefield stated a list of tentative future agenda items for the June 11 and June 18 City Council meetings was provided to the Council noting the list is tentative and items may be removed and added. Alderman Glab asked if Community Development Committee could look into developing restrictions for dumpsters regarding requiring permits and limiting the amount of time they can be left out.
