McHenry High School West Campus, 4724 W. Crystal Lake Road, during the
Homecoming Dance on October 14th from 7:00 PM to 11:00 PM;
D. Request to advertise for bids for installation of Holiday Lighting in Veterans Memorial
Park;
E. Parks Facilities/Special Use Picnic Permits; and
F. Issuance of Checks in the amount of $282,823.44; and
G. Payment of Bills in the amount of $1,304,462.90.
8. Individual Action Item Agenda:
A. Motion to approve an application for a Class A Liquor License from DC Cobbs, Inc. d/b/a
DC Cobbs McHenry located at 1204 N. Green Street and Ordinance increasing the number
of Class A Liquor Licenses in effect from twenty-nine (29) to thirty (30).

AGENDA SUPPLEMENT SUMMARY:
The City Council is being asked to consider the vacation of an approximately .14 aces of an
unimproved alley the City currently maintains which will be included and utilized as part of the
Full Circle Project.
BACKGROUND:
The City maintains an approximately 25' X 240' (.14 acre) right-of-way located immediately north
Athe property located at the northeast corner of Pearl Street and Richmond Road (Illinois Route
31). Full Circle Communities has incorporated the right-of-way area as part of their site plan
design for the property.
ANALYSIS:
Currently residents at 1408 N Richmond Road and 3513 Broad Street utilize the right-of-way in
question for access to their properties. Conditions staff required on the final plat of subdivision
which are included in the proposed right-of-way vacation ordinance are:
• A perpetual ingress/egress access and maintenance easement be reserved and recorded
against the vacated right-of-way property for the benefit of the properties located at 1408 N
Richmond Road and 3513 Broad Street by the Owner within 60 days of City Council approval
of this Ordinance.

• Cr vacated right of way shall be paved by the Owner to a 24-foot width residential driveway
standard as outlined in the City's Subdivision Control and Development Ordinance.
• The vacated right of way shall be improved in substantial conformance with the Site and
Landscape Plans approved for the development of the property immediately to the south of
the vacated property bythe Owner priorto the Owner, user and/or any subsequent owner(s),
successor(s) and/or assign(s) or users or any user of Lot 1 or Lot 2 on the Final Plat of
Subdivision receiving a final Certificate of Occupancy.
• The vacated right of way shall only be utilized by the Owner and/or any subsequent owner(s),
successor(s) and/or assign(s) or users of Lot 1 and/or Lot 2 referenced on the Final Plat of
Subdivision approved for the development of the property immediately to the south of the
vacated right-of-way on this date by ordinance for emergency access only.
There are no City utilities located within the 25' right-of-way. Staff does not have any problems
with vacating the right-of-way. It serves no purpose to the City; however, public works does plow
it following snow events and would not have to do so if it is vacated. Full Circle would own the
property upon vacation and they would improve and maintain it in perpetuity and provide
additional buffer area and landscaping from the Full Circle Development to abutting residential.
It is not required to do this vacation of the alley because building setbacks can be met without
use of it and Full Circle really has no use for it, including access, however staff believes it's a win -
win for all parties involved.
If the right-of-way in question is not vacated but the City Council approves the zoning and
subdivision requests Full Circle will need to amend their final subdivision plat and site, landscape
and other plans previously submitted for the development of the property to reflect the removal
of the alley and it will remain public. These amendments will not substantially affect the plans
being presented tonight for approval however.
RECOMMENDATION:
A three-quarters majority of the current Aldermen holding office or six affirmative votes are
required to vacate the proposed right-of-way. If the City Council is in favor of vacating the
right-of-way north of Pearl Street, south of Broad Street, and east of Richmond Road it is
recommended the attached ordinance be approved.

ORDINANCE NO. 17-
AN ORDINANCE VACATING PUBLIC RIGHT-OF-WAY LOCATED NORTH OF PEARL STREET,
SOUTH OF BROAD STREET AND EAST OF RICHMOND ROAD (ILLINOIS ROUTE 31), IN THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, The City of McHenry, McHenry County, Illinois (the "CITY"), is a home rule
municipality as contemplated under ARTICLE VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this ordinance constitutes an exercise of the city's home rule powers
and functions as granted in the Constitution of the State of Illinois.
WHEREAS, It has been determined that an unimproved public right-of-way north of Pearl
Street, south of Broad Street and east of Richmond Road in the City of McHenry is no longer
needed for public purposes and the public interest will be served by vacating such right-of-way;
and
WHEREAS, Pursuant to 65 ILCS 5/11-91-1, as well as its Home Rule Powers, the City has
the authority to vacate any street or alley, or part thereof, within its jurisdiction when it has been
determined that the public interest will be served; and
WHEREAS, It is the desire of the City that title to the vacated property should be vested
unto FUII Circle Communities Inc., 310 S Peoria #500, Chicago, IL 60607; and
WHEREAS, Said statute requires that an ordinance vacating property be passed by an
affirmative vote of at least three -fourths of the aldermen then holding office; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1:
THE public interest is served by vacating the vacated right-of-way insofar
as the City will not have any further burden or responsibility for maintaining same.
SECTION 2: That the vacated right-of-way, being an unimproved alley is hereby
vacated pursuant to 65 ILCS 5/11-91-1, as well as the City's home rule powers, and title to the
vacated right-of-way shall be vested with the Full Circle Communities Inc. ("OWNER") free and
clear of all liens, obligations and encumbrances in fee simple title. The public right-of-way legally
described and depicted on the Plat of Vacation shall be and hereby is vacated subject to the
following conditions:

be and hereby is authorized and directed to cause a cered copy of this ordinance and the fully
executed plat of vacation to be recorded with the McHenry County Recorder of Deeds, all at the
OWNER'S sole cost and expense.
SECTION 5: If any section, paragraph, subdivision, clause, sentence or provision of this
ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 6: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.

and publication in pamphlet form (which publication is hereby authorized) as provided by law.

If the City Council concurs it's recommended the attached resolution be approved designating
the Importance of Manufacturing to our community and designating October 6, 2017 as

A RESOLUTION RECOGNIZING THE IMPORTANCE OF MANUFACTURING AND
DESIGNATING OCTOBER 6, 2017 AS
NATIONAL MANUFACTURING DAY IN THE CITY OF MCHENRY
WHEREAS, National Manufacturing Day is an annual event, held on the first Friday in
October and highlights the importance of manufacturing to our national economy, providing an
opportunity for manufacturers throughout North America to open their doors to highlight the many
rewarding high -skill jobs available in manufacturing -related industries; and
WHEREAS, the National Manufacturing Day Mission Statement is: "To empower
manufacturers to improve the public perception of manufacturing careers and the sector's value
to the economic health of the U.S. by connecting them to business improvement, community
resources, and next -generation workers; " and
WHEREAS, the manufacturing sector in McHenry County employs a large percentage of
our workforce and a very important economic sector throughout McHenry County; and
WHEREAS, for generations, manufacturing has played a critical role in the United States,
State of Illinois, McHenry County and the City of McHenry's diverse economy; and
WHEREAS, City of McHenry is home to numerous national and international
manufacturers within many different economic sectors including metalworking machinery
manufacturing; medical equipment and supplies manufacturing; plastic resin and synthetic fiber
manufacturing; plastics and rubber and electronics manufacturing; and
WHEREAS, the City of McHenry is fortunate to have numerous business and industrial
parks located throughout the city including McHenry Corporate Center, Sherman Hill Industrial
Park, North Gate West, Prairie Pointe Business Park, Tonyan Industrial Park, Inland Business
Park, Adams Commercial Center, Professional Plaza, and City Centre Business Park; and
WHEREAS, Manufacturing companies in the City of McHenry range in size from less
than ten employees to more than 400 employees occupying buildings from a 2,000 thousand square
feet to more than 650,000 square feet; and
WHEREAS, manufacturing jobs enable City of McHenry families to realize the dreams
of owning a home, sending a child to college and enjoying a secure retirement and, manufacturers
pay millions of dollars annually supporting schools, law enforcement, emergency preparedness,
public works and other essential services; and
WHEREAS, the City of McHenry advocates, supports and promotes the growth of
manufacturing and related industries through numerous plans and programs to enable companies
to expand or relocate to the City of McHenry but also to remain within the City of McHenry; and

WHEREAS, on September 27, 2017, from 6:00 p.m. to 8:00 p.m. at the McHenry High
School East Campus Gymnasium, 1012 N Green Street, a Manufacturing, Trades and Industry
(MTI) Career Expo will be held featuring more than 40 industrial/manufacturing companies, as
well as trade organizations throughout McHenry County and programs offered at McHenry
Community High School District 156 and McHenry County College; and
WHEREAS, the Manufacturing, Trades and Industry Expo is a collaborative effort
sponsored by McHenry Community High School District 156 in partnership with the City of
McHenry, McHenry County Economic Development Corporation, McHenry County Workforce
Network, McHenry County College, McHenry Area Chamber of Commerce, Rotary Club of
McHenry Sunrise, and Jett's Heating and Air, Inc; and
WHEREAS, the purpose of the Manufacturing, Trades and Industry Expo is to feature
numerous opportunities local companies offer and to inform parents and students about the
educational pathways that could benefit students as they decide on future careers and to find and
sustain enough skilled people to fill positions throughout McHenry County; and
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF MCHENRY

AGENDA ITEM SUMMARY:
McHenry High School is requesting permission to temporarily close certain sections of John
Street, Green Street, and Kane Avenue, and use of city services for traffic control to facilitate
the 2017 McHenry High School Homecoming parade on Friday, October 13th at 6:15 PM.
BACKGROUND:
The parade will feature activity groups and teams walking to support the football team in the
"March of Champions" tradition. There will be no floats or vehicles in the parade. At
approximately 6:15 PM, the parade will begin at East Campus High School and proceed west to
Green Street; turn south to Kane Street, west on Kane Street and enter the southeast entrance of
McCracken Field. The parade will conclude after circling the track one time.
ANALYSIS:
The parade is brief and in past years, has had minor impact on traffic. Staff reviewed the request
with Police, Public Works, and Parks Department staff. Police Officers will be stationed along
the parade route to provide traffic control.
RECOMMENDED:
If Council concurs, then it is recommended a motion is considered to approve the request
as presented.

The annual McHenry High School Homecoming parade will be held on Friday, October

AGENDA ITEM SUMMARY:
Council is being asked to consider a Temporary Use for the placement of an outdoor spotlight on
the McHenry West High School property during their homecoming dance on October 14, 2017.
BACKGROUND:
A temporary use permit was received from McHenry High School District 156 to place an outdoor
spotlight in their parking lot during the hours of 7:00 pm till 11:00 pm on October 14th. The
spotlight will be light for the duration of the homecoming dance and will be shut off once the
dance ends. District 156 is also requesting a waiver of all fees associate with the temporary use.
Fee associated with this Temporary Use area $30 deposit and a $30 permit fee.
ANALYSIS:
Staff has no concerns with this request, fees associated with not -for -profit and school district
functions have typically been waived in the past.
RECOMMENDATION:
Therefore, if the City Council concurs with staff s analysis it is recommended that a Temporary
Use permit be granted to McHenry High School District 156 for the placement and use of an
outdoor spotlight on October 14t" during the hours of 7&00pm through 1100opm.

at 8:OOpm at West Campus. In order to contribute to the spirited nature of the evening,
and support the homecoming week theme, "A Night in the City", we would like to

pm when students begin arriving for the dance until 11:00pm when the dance
concludes.
In addition, we would like to request the fee associated with the usage of this light be

Agenda Item Summary. Staff is seeking authority to advertise for bids for installation of holiday
tree lighting in Veterans Memorial Park.
Back ound. Annually, the city has contracted services for the installation of holiday tree
lighting in Veterans Memorial Park. A total of $175500 was budgeted this year for the lighting.
Analysis. If approved, lighting would be installed in the park prior to the annual Downtown
Christmas Walk on November 18tn

CHRISTMAS LIGHTS
The City of McHenry will receive sealed bids for services to install, maintain, and remove
Christmas lights on trees at Veterans Memorial Park for the 2017M2018 season until 11:00
a.m., Tuesday, October 10, 2017. All bids shall be addressed to the City Clerk's Office,
City of McHenry, 333 S. Green Street, McHenry, IL 60050. Each proposal must be
sealed and clearly identified on the outside of the envelope as a `BID FOR
CHRISTMAS LIGHTS". Bids will be opened at 11:00 a.m., Tuesday, October 10,
2017 in the City Council Chambers. Award of the bid will be considered at a later
meeting of the McHenry City Council within at least thirty (30) days of the date of
receiving bids.
All bids received prior to the specified date and time, which meet or exceed the minimum
specifications will be considered by the City. The City will review each properly
submitted bid and will make a selection based upon price, availability, quality and other
features of the bid proposals. Bids submitted after 11:00 a.m., local time, will not be
considered and will be returned to the bidder.
The City of McHenry reserves the right to reject any or all bids and to waive irregularities
in the bids, and to select the bid that is considered to be the most advantageous to the City
of McHenry.
Only bids and proposals submitted on forms prepared by the City of McHenry will be

General Specifications
GENERAL DESCRIPTION OF WORK
This work shall generally include all labor, fuel, supplies, vehicles, and equipment to install,
maintain, and then remove Christmas lights on trees at Veterans Memorial Park in the City of
McHenry.
The lights to be installed will be provided by the contractor.
PERFORMANCE BOND
A performance bond is not required for this contract.
INSURANCE REQUIREMENTS
No work under this contract shall be started or performed until the successful bidder has obtained
and provided the City with proof of insurance of the following types and minimum amounts.
a) Worker's compensation and employer's liability in amounts as
required by the State of Illinois.
b) Comprehensive General Liability in an amount of not less than
$150001000.00.
c) Property Damage in an amount not less than $1,000,000.00.
d) Automobile Liability coverage to include all owned, rented,
leased, or hired vehicles in an amount not less the $1,000,000.00.
Each Insurance policy issued for this coverage, and the certificate of insurance issued as proof of
insurance, must also name the City of McHenry as an additional insured for the period of this
contract. In the event that the contractor fails to maintain or renew any insurance coverage
during the period of the contract, the City may cancel the contract at that time without any prior
notification.
No insurance policy issued for this contract maybe allowed to expire prior to the completion of
this contract, without first providing the City with at least 15 days advance notice of the
expiration by certified mail. The contractor shall require any and all subcontractors performing
work on this contract to provide and maintain insurance coverage of the minimum amounts
specified during the period of the work.

Nothing contained in these insurance requirements is to be construed as limiting the extent of the
Contractor's responsibility for payment of damages resulting from his performance and
completion of this work. The contractor agrees to assume all risk of loss and to indemnify and
hold harmless the City of McHenry from any and all liabilities, claims, suits, injuries, losses,
damages, fines or judgments, including litigation costs and attorney's fees, arising out of the
work for this contract, including to the extent allowed by law those liabilities, injuries, claims,
suits, losses, damages, fines or judgments, including litigation costs and attorney's fees, arising
out of or alleged to arise out of, the negligence of the City of McHenry, its officers, agents, and
employees.
SALES TAX
Supplies, materials, and equipment used for or installed as part of this contract are exempt from
retailer's occupational tax in the State of Illinois; this sales tax shall not be included as part of the
bid price. All other applicable taxes and fees shall be the responsibility of the contractor.
SCHEDULE
The City of McHenry requests that all lights be installed and in good working order by Friday,
November 17, 2017. All lights to be installed under this contract are to be completely removed
after February 5, 2018, but no later than February 9, 2018. Please contact Bill Hobson with the
City of McHenry at (815) 363-2159 if there are problems with this schedule.
MAINTENANCE
The Contractor shall be responsible for all maintenance of the lights from the time of installation
to the removal, which shall include, but not be limited to, replacement of bulbs, securing loose
strings of lights, and replacing strings of lights that are not operational. The contractor shall be
required to inspect the lights at least one time per week to make all repairs and complete all
replacements as needed. In addition, the contractor shall be required to complete all maintenance
within 2 working days when reported by the City of McHenry.
NUMBER and LOCATION OF TREES
Services under this contract shall include the installation, maintenance, and removal of lights on
(31) trees within Veterans Memorial Park that are specified on the attached Park map. On the
bid submittal page there is an additional line designated "price per 1,000 lights", this may be
utilized should the city of McHenry choose to add trees to that it wishes to have lit by the
contractor.

PROTECTION OF TREES
The contractor shall complete all work in the best manner possible to protect the trees and to
prevent any damage to the trees and tree limbs. Bucket trucks shall be kept away from the tree
limbs, whenever possible. If the City determines during the installation and the removal work
that excess damage is being done to the trees, the contractor shall be required to stop work
immediately and to revise the means of installation and/or the means of removal in order to
eliminate the damage to the trees. The City will not allow removal of the lights by pulling the
strings from the trees. Instead the lights must be cut off and/or unwrapped from the trees.
INSTALLATION
Installation may include wrapping individual branches OR "draping" over branches to light the
designated trees. Placement and design of the placement shall be reviewed with the contractor
prior to installation. The contractor shall connect the lights at each tree to extension cords that
carry the power from tree to tree to the power supply provided by the City in the park. Every
effort should be made to suspend those cords within the trees and transfer the power to adjacent
trees in the air. Laying extension cords on the ground for long runs will be unacceptable.
All connections and all plugs must be completely wrapped with electricians tape, or covered
with heat shrink plastic, as a moisture barrier.
LIGHTS TO BE PROVIDED
The contractor will be required to supply all the strings of lights in addition to any replacement
bulbs that may be required throughout the season. A commercial grade outdoor light is
recommended. All lights for the park are to be clear or white. The contractor is not required to
salvage the lights at the end of season and will not be required to remove the lights in working
order.
TIMERS TO BE PROVIDED
The contractor will be required to supply timers for all the strings of lights. A plug in style timer
is recommended and should be of a commercial grade or such deemed to handle the electrical
load for the stings of lights. Timers will be located within the sealed electrical boxes however
they should be able to withstand winter temperatures. All timers should be coordinated and set
appropriately for the lights to turn on at 3:00 pm and turn off at 11:00 pm daily.
METHOD OF PAYMENT
The City shall make two-thirds (2/3) payment of the total bid price upon completion and
approval of the installation of all lights within forty-five (45) days of the receipt of invoice. The
City shall pay the remaining one-third (1/3) of the total bid price following the completion of the
required maintenance and after the removal of all lights from all trees within forty-five (45) days
of the receipt of an invoice. The City does reserve the right to make a deduction from the final
payment if the contractor fails to provide necessary maintenance after receipt of written notice
from the City.

RE Request for Class A Liquor License from D.C. Cobbs McHenry located at
1204 N. Green Street, and Ordinance increasing number of Class A liquor
licenses in effect.
ATT: Application and Proposed Ordinance
Agenda Item Summary: Mr. Daniel Hart and Mr. Josh Carstens, principal agents of McHenry
Cobbs, Inc., d/b/a DC Cobbs McHenry located at 1204 N. Green Street, submitted an application
for a Class A liquor license. If approved, the attached ordinance increasing the number of Class
A liquor licenses in effect from twenty-nine (29) to thirty (30) is required.
Background: The Class A license authorizes the sale of alcoholic liquors for consumption on
premises and retail sale of packaged liquors.
DC Cobbs McHenry is currently under construction in conjunction with the new McHenry
Downtown Indoor Theater building. DC Cobbs McHenry is a full service restaurant and bar
serving lunch and dinner with live entertainment.
Mr. Hart currently holds two liquor licenses for DC Cobbs in Woodstock, IT and Hart's Saloon
in Hebron, IL. Mr. Carstens has worked for and managed Buddyz Pizza and Dunhills
Steakhouse, formerly located in McHenry. Both owners are conversant with Illinois Liquor
Control regulations. They have met with Mayor Jett, were successfully fingerprinted by
McHenry Police, submitted all required documentation, and paid all associated fees.
NALYSIS: A
In February 2017, the City Council approved a conditional use permit and variances to allow a
restaurant serving alcohol with outdoor seating and entertainment at this location. Examples of
current Class A licensed businesses in McHenry are Bimbos Italian Restaurant, The Old Bridge
Tavern, and Village Squire of McHenry.
RECOMMENDATION:
The Council will be asked to make a motion to 1) grant a Class A liquor license as
presented and, 2) approve an Ordinance increasing the number of Class A liquor licenses
in effect.

dining experience in Downtown McHenry, right on the Riverwalk. We have

WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality
as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as
granted in the Constitution of the State of Illinois.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY,
McHENRY COUNTY, ILLINOIS, as follows:
SECTION l: Section 4-6(1) of the Municipal Code relating to liquor license
classifications is hereby amended by:

AGENDA ITEM SUMMARY:
The applicant is requesting a Zoning Map Amendment from RS-4, High -Density Single -Family

BACKGROUND:
Many different types of land uses have been proposed on the subject property in the past. In
2005 Advance Auto Parts proposed an approximately 6,900 square -foot freestanding building, and
in 2006 a strip mall consisting of 14,000 square feet, anchored by Cardinal Fitness, was proposed.
Advance Auto Parts received a negative recommendation from the Planning and Zoning
Commission and did not proceed to the City Council. The proposed strip mall received a positive
recommendation from the Planning and Zoning Commission but was not approved by the City

Council. A I nornton's gas station was proposed on the subject property; however the application
was withdrawn prior to going to City Council for consideration. The Veterans Assistance Clinic,
ultimately constructed south of the Municipal Center, was also proposed at this location however
the petition was also withdrawn.
The subject property has been difficult to find an appropriate land use for a couple of reasons
including:
• It is in an infill property in the midst of an established neighborhood;
• Richmond Road, once a two-lane road -now widened to five lane cross-section;
• The property is surrounded by multiple land uses including commercial and residential;
• Traffic and circulation at Pearl and Richmond is heavy and problematic at times and any
use should not spillover and adversely impact adjacent uses -such as create cut -through
traffic through the existing established residential neighborhood;
• Residential is certainly appropriate however single-family residential at this location is not
the highest and best use;
• Commercial is also appropriate however the intensity of a commercial use must not
adversely impact the surrounding neighborhood to an extent where it becomes more of a
nuisance land use than one of convenience and benefit to the residents;
• The property is close to downtown; shopping; located on the Pace Suburban Bus Route;
Veterans Memorial Park, and ideally any use, should allow these amenities to be benefits.
The ideal use should be one that is transitional in nature and one that incorporates some features
of the surrounding neighborhood, but also one that includes more modern conveniences; takes
advantage of the location on the periphery of downtown; access to transit; within walking
distance to parks; shopping and restaurants.
Attached is a request presented by Full Circle Communities: htt/www.fccommunities.org/ in
collaboration with Over the Rainbow http.otrassn.org/ and TLS Veterans
http://www,tlsveterans.org/ on the Project. They are proposing to build 25 apartment units, one
and two bedrooms, of accessible housing coupled with supportive services targeted to residents
with physical and sensory impairments including many Veterans. Attached to the staff report is
an analysis provided by Full Circle that summarizes the relationship between their projects and
surrounding property values.
In summary, the proposed building would be constructed on the eastern half of the property.
Currently the site consists of numerous parcels and a 25' wide public alley/right-of-way lies
directly to the north of the site. The applicant is proposing to rezone the entire site to RM-2 High -
Density Multi -Family Residential, obtain a front yard building setback variance from 30 feet to 15

feet; a variance from the off-street parking and loading requirements from 51 required to 33
spaces provided. Finally, the applicant is seeking preliminary and final subdivision plat approval.
Due to the funding obtained and the potential for a second building in the future, Full Circle
decided to pursue the subdivision of the site into two lots.
ANALYSIS:
Zoning Map Amendment
The subject property poses a unique challenge due to its proximity to downtown, location along
a major roadway and the fact it lies in the middle of an older established residential neighborhood.
The ultimate land use on the subject property needs to dictate the land use pattern traveling north
on Richmond Road to Washington Street. It is in close proximity to many different land uses,
including single-family homes, apartments, a church, a bank drive-thru and office building.
Staff supports the rezoning to RM-2 because it's consistent with the Comprehensive Plan. The
City's Comprehensive Plan designates the site as Medium -Density Residential (4 to 9 units per
acre), and the Core Downtown Sub -Area Plan, adopted by the City Council on August 31, 2009,
states the subject property should be redeveloped as residential. The Sub -Area Plan; however,
identifies that the property is located in an area of transition due to the fact the planning area
which encompasses the subject property does not have a clearly -defined land use pattern. A
variety of land uses currently exist.
During the Thornton's project proposal staff stated that the subject property is an appropriate site
for a commercial user. The subject property poses a unique challenge due to its proximity to
downtown, location along a major roadway and the fact it lies in the middle of an older established
residential neighborhood. It is in close proximity to many different land uses, including single-
family homes, apartments, a church, a bank drive-thru and office building. Staff believed the
proposed VA Clinic with off-street parking was an acceptable use for the site and is compatible
with the surrounding area. The Full Circle project is an ideal transitional use. It is low impact in
terms of traffic; within walking distance to downtown; provides housing to those who for the most
part are unable to work and is indirect proximity to public transportation. The applicant has met
with Pace Suburban Bus which has agreed to construct a transit shelter at the site, close to the
intersection of Richmond Road and Pearl Street, where Pace Fixed Route #806 travels.
Additionally, Pace Route #807 has stops at the old City Hall and 1111 N Green and the Subject
Property could also take advantage of the City's participation in the McRide Paratransit Program
in partnership with McHenry County, Pace and numerous other governmental entities. This is a
curb to curb service.

Variances
A front yard building setback variance from 30 feet to 15 feet; a variance from the off-street
parking and loading requirements from 51 required to 33 spaces have been requested. Full Circle,
through the development of past projects, has data supporting the fact that a standard parking
ratio for apartments is not needed. All of these units will be accessible units. Most of the residents
will not drive. Parking will be needed for support services and guests however having a 1:1 ratio
of parking for this type of use is more practical than a typical apartment parking ratio, which is: 2
spaces for one -bedroom units and 2.33 spaces for 2-bedroom units.
The building setback variance is from 30 feet to 15 feet. In the RM-2 zoning district, the front yard
building setback required is 30 feet and the corner side yard is 15 feet; however due to the
subdivision of the property the front yard, by zoning definition for the proposed building, is on
Pearl Street. Staff believes having the building closer to the road on Pearl Street makes more
sense for a couple of reasons: it provides a more defined streetscape and it's farther from the
residential to the north.
Preliminary and Final Subdivision Plat Approval
The applicant is proposing to subdivide the site into two lots. Proposed Lot 2 is the location of the
25-unit building and proposed Lot 1 would be developed in the future. The primary purpose of
the proposed subdivision is for financing purposes. It should be noted that if a building is
proposed on Lot 1 in the future the applicant would be required to come back to Planning and
Zoning and City Council for approval.
As previously stated, staff is supporting the vacation of the alley with the conditions that it be
paved as a driveway for the two users, only utilized by Full Circle for emergency access and
maintained in perpetuity by Full Circle. If the vacation is not approved by City Council Full Circle
is still required to maintain a 15' landscape buffer to the north and east.
The proposed plat incorporates easements for servicing all three proposed lots with water, sewer,
gas and electric, as well as to accommodate cross access and drainage. There will be no additional
direct access to Richmond Road, with the exception of emergency only access to the subject
property and will be stipulated on the approved plat. Perpetual access easements for benefitting
property owners currently utilizing alley, as well as maintenance of alley, shall be reflected on the
final plat.
The preliminary and final plats are being combined due to the relative simplicity of the request.
In accordance with the Subdivision Control and Development Ordinance "The subdivider may
submit a final plat simultaneously with the submission of a preliminary plat if the proposed
subdivision meets all of the following requirements:

A. The proposed subdivision contains three or fewer lots; and
B. The proposed subdivision does not require or create any new public rights -of -way or
easements for access; and
C. The proposed subdivision requires no extensions of public utilities and no new public
facilities; and
D. The proposed subdivision does not include any territory that is located in a Special Flood
Hazard Area, or contain any proposed lots that may be unbuildable because of the nature
of the soils located thereon."
An initial review of the plats, traffic study and engineering has been completed by the City's
engineer and the project would proceed to City Council once all engineering comments have been
addressed.
PLANNING AND ZONING COMMISSION:
At the August 31, 2017 Special Planning and Zoning Commission Meeting many people spoke in
favor of the proposed project and several had concerns about the project. The concerns primarily
dealt with neighborhood compatibility; building height; traffic; appropriateness of the use for this
location; mass and scale of building to the surrounding area.
The Planning and Zoning Commission unanimously recommended approval of the following:
1) Approval of a zoning map amendment from RS-4 and C-4 to RM-2;
2) Approval of Variances for off-street parking and loading from 51 spaces to 33 spaces and
a front yard building setback variance from 30 feet to 15 feet with the following conditions:
• Site is developed in substantial conformance with site and landscape plans and building
elevations as submitted;
• Full Circle work with Pace Suburban Bus in locating a bus transit shelter in the proximity
of Richmond Road and Pearl Street and incorporated modifications to site plan, at a
minimum -including a canopy and outdoor seating area on the west side (front of the
building) for residents waiting for a Pace Paratransit bus; A conceptual layout shall be
provided to staff prior to City Council consideration;
• If bus shelter and/or canopy/seating area cannot be accommodated Full Circle shall
submit justification/documentation substantiating why this requirement cannot be
met.
3) Approval of the preliminary and final plats of subdivision with the following conditions:

• All recommendations by City engineer to develop property are finalized prior to City
Council consideration;

against both properties so any future owner would be aware of these conditions);
• If alley is vacated by City Council it shall only be utilized by Full Circle (subject property)
for emergency access only and this shall also be included on the final plat;
• Final plat shall reflect front yard setback of 30 feet for Lot 1.
• Full Circle shall prepare a plat of vacation to be consider by the City Council and be
responsible for publication of public hearing notice;
Therefore, if the City Council concurs, it is recommended that the following ordinances be
approved:

THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as
granted in the Constitution of the State of Illinois; and
WHEREAS, Full Circle Communities, Inc. 310 S Peoria #500 Chicago, IL 60607 is requesting
approval of a the Final Plat of Subdivision of Pearl Street Subdivision; and
WHEREAS, the Planning and Zoning Commission has reviewed the final plat at a public
meeting held August 31, 2017 and provided a written record of this meeting and its
recommendation to the City Council; and
WHEREAS, the City Council finds that the approval of the final plat is in conformance with
the Ordinances of the City.

• If alley is vacated by City Council -Full Circle shall provide a 24' paved driveway to
residents currently utilizing alley, as well as a perpetual access easement and agree to
maintain the alley in perpetuity (this shall be included on the final plat and recorded

Clearbrook began in the mid -fifties as the vision of a group of northwest suburban
Micagoland parents in response to the unmet educational needs of their children with
special needs. What started as a small school in the barn of a Rolling Meadows church
grew initially in response to the needs of the children first served by Clearbrook as they
aged: vocational services; employment services and residential services were
developed. Today, adult services include an array of community based residential
options, day program services that include options for individuals with autism, aging
adults with developmental disabilities, employment training and placement services and
a full complement of clinical services. Clearbrook serves over 8,000 children and adults
with intellectual/developmental disabilities in over 160 communities throughout
Chicago and the suburbs.
Nearly 24,000 persons with disabilities live in McHenry County according to the
Census, with over 2,200 calling the City of McHenry home (8.35%). There are very few
affordable and accessible housing options in the area and even fewer that include
supportive services. Full Circle's proposed project will help meet the need for housing
that is affordable and accessible for someone with a disability. The partnership with
TLS Veterans and OTR to provide services to the residents will make this an asset to
the community. We know that a housing development. such as this would greatly benefit
our clients and help them live more independently.
Clearbrook supports this project, believes this development will serve persons with a
disability in the community, and will continue to work with Full Circle to make this
project a reality.

Narrative Description of Proposal — Pearl Street Commons
Full Circle Communities hereby requests consideration and approval of a subdivision, property rezoning, and variances
for minimum parking and minimum front yard for the development of Pearl Street Commons, located at 3512 Pearl
Street.
Background:
Full Circle Communities (FCC) proposes the development of Pearl Street Commons (PSC) located at 3512 Pearl Street on
the northeast corner of Richmond Road and Pearl Street in downtown McHenry. The approximately $7MM project will
convert the existing vacant lot into a high -quality affordable rental community targeted to veterans and persons with a
disability. PSC will consist of 25 units made up of 22 one bedroom units and 3 two bedroom units, designed to be highly
accessible including roll -in showers, accessible kitchens, grab bars, and wider turn -radii (see attached images). In
addition to the units, the building will feature on -site property management, community and service space, library and
computer room, resident storage space, laundry room, patio, and 33 off-street parking spaces. The building will achieve
"green" certifications through Enterprise Green Communities and Energy Star. As a non-profit, FCC commits 75% of
developer fee and ongoing cash flow to provide services to our residents to help enrich their lives and. remain stably
housed. Full Circle is partnering with TLS Veterans and Over the Rainbow Association, local service providers for veterans
and persons with a disability respectively, to make tenant referrals and provide services at no extra cost to the residents.
Full Circle will provide long-term professional property management and will maintain on -site property management
and maintenance staff.
In 2016, FCC originally presented to the Community Development Committee to do a 47-unit development with the
same target population. The initial applications for state funding were unsuccessful. A subsequent round of funding was
released in early 2017 and FCC received an award, however the building could contain no more than 25 units. The 25-
unit Pearl Street Commons is what is being presented to P&Z for consideration and approval of rezoning and variances.
As shown on the plans, FCC hopes to complete a Phase II development of an additional 20-25 units sometime in the
future to get back up to the original scope and provide more housing for veterans and persons with a disability. There is
no timeline set for Phase II and Full Circle has not yet applied for funding. While Phase II is still very conceptual, it is
important to show on the plans to demonstrate FCC's intention. Additionally, FCC is in discussion with the city on the
potential vacation of the public alley on the north side of the site. The potential alley vacation is also shown on the
plans.
Due to characteristics of the proposal and site constraints, the need to apply for subdivision, rezoning, and variances to
tFie minimum front yard and parking minimum is necessary. The following briefly describes the requests.
Subdivision:
Full Circle seeks to subdivide the subject property in order to accommodate the development of Pearl Street Commons
and the future Phase II on separate lots. Subdivision is necessary due to requirements set by the funding sources.
Zoning:
Current zoning for the property is RS-4Righ-Density Single Family Residential and C-4 Downtown Commercial. FCC seeks
a rezoning to RM-2 High -Density Multifamily Residential in order to develop 25 units of quality, accessible multifamily
housing for veterans and persons with a disability. McHenry is home to over 1,300 veterans and over 2,000 persons with
a disability. Additionally, 57% of renters are housing cost burdened, meaning they pay more than 30% of their income
towards housing costs. Accessible rental housing is rare in McHenry, where most buildings have front steps and no
elevator. Affordable, accessible housing will allow veterans and persons with a disability on a fixed income to live
independently and thrive in the community.
Variance —Front Yard Minimum:
FCC is requesting a variance to the minimum front yard under the RM-2 zoning because the proposed project does not
meet the minimum requirement. Under the RM-2 zoning the minimum front yard requirement is 30 feet. The variance
would allow the project to have a front yard setback of 15 feet. Fifteen feet is in line with the neighboring residential
and commercial uses which have front yards of 15 feet or lower. PSC is part of the Core -Downtown Sub -Area which is
characterized by higher density and minimal yard setbacks. Granting a variance to do a 15 foot front yard would be
consistent with adjacent uses and the development character of downtown McHenry.
Variance —Parking Minimum:
FCC also requests a variance to the parking minimum because the proposed project does not meet the minimum
requirement. Under the ordinance, the minimum parking requirement is 2.0 spots per 1-bedroom units and 2.33 spots
per 2+ bedroom units. For PSC this would mean 51 off-street parking spaces, a ratio of 2.04:1. The PSC project includes
25 dwelling units and 33 off-street parking spaces, which comes to 1.32 spots per dwelling unit.
FCC believes that due to characteristics of the resident population, excellent access to public transportation, and parking
usage at comparable properties, the request meets the criteria for granting the variance. The city includes transit~
oriented development as a Comprehensive Plan policy and recognizes that it provides benefits to the community such as
reduced traffic congestion and air pollution. One of the tenets of transit -oriented development is lowered parking ratio
requirements. Even with lowered parking ratio requirements, the typical utilization rates are many times much lower
than 100% at any given time. In a survey of other FCC properties (senior and disabled) that have parking ratios below
0.5:1 we found typical utilization rates around 50-70% (see attached chart).
Additionally, the disability and income status of the tenant population is shown to have limited car use and ownership.
According to research from the University of California — Berkeley, low income individuals and families are less likely to
have access to a car. In the U.S., the percentage of low income residents without access to an automobile is over 20%
compared to just 4% for non -low income residents. Research from the U.S. Department of Transportation states that
persons with a disability are 1.35 times less likely to drive or have access to a car than nondisabled individuals. These
populations typically rely more on public transportation options because of their accessibility and affordability. In the
case of the PSC project in downtown, the site has direct access to Pace bus routes 806 and 807, Metra train, and the
MCRide Dial -a -Ride service.
We are excited about the opportunity to pursue this project in a community that is dedicated to local community
planning and revitalization. We believe our requests for subdivision, rezoning, parking variance, and front yard variance
are reasonable and meet the criteria for approval. Thank you for taking the time to review and consider our application

1. Special Circumstances Not Found Elsewhere
Special circumstances exist that are particular to the property for which the variance is sought and that do not
apply generally to other properties in the same zoning district; and these circumstances are not of so general
or recurrent a nature as to make it reasonably practical to provide a general regulation to cover them.
The subject property is unique for sites zoned RM-2 because it is located in downtown McHenry which is
characterized by higher density, minimal setbacks, and greater public transportation opportunities. This is
unlike the majority of lots zoned RM-2 which are located in less dense, more car -reliant areas of McHepa,
farther removed from downtown. Variances for minimum front yard and minimum parking are more
necessary for RM-2 and more consistent with development trends in the downtown area than RM-2 in other
parts of the city.
2. Circumstances Relate to Property Only
Since a variance will affect the character of its surroundings long after a property changes hands, the special
circumstances referenced herein relate only to the physical character of the land or building(s) for which a
variance is sought, such as dimensions, topography, or soil conditions, and they do not concern any business
or activity the present or prospective owner or tenant carries on or seeks to carry on therein, or to the
personal, business or financial circumstances of such owner or tenant or any other party with interest in the
property.
The requested variances to minimum parking and minimum front yard are specific to and necessary for the
development located at the northeast corner of Richmond Road and Pearl Street. They are necessary only for
the successful completion of Pearl Street Commons and not related to another personal, business, or financial
circumstance of the owner or applicant. Additionally, the variances are specific to the Pearl Street Commons
project which Full Circle will own for a minimum of 30 years the requirements of our funding sources.
3. Not Resulting from Applicant Action
The special circumstances that are the basis for a variance have not resulted from any act of the applicant or
of any other party with interest in the property.
The request for variances to the minimum parking and minimum front yard do not result from applicant
action but rather the size and shape of the site, proximity to public transportation, documented research on
lower car ownership and utilization among the target tenant populations, and intent to be consistent with
downtown development trends.

4. Unnecessary Hardship
The strict application of the provisions of the Zoning Ordinance would result in unnecessary and undue
hardship upon the applicant, as distinguished from a mere inconvenience.

other properties in the same zoning district, and does not confer a special privilege ordinarily denied to other
properties in the district.
Variances for minimum parking and minimum front yard are necessary for the subject property to be able to
develop RM-2 high density multifamily housing on a long -vacant infill site in a downtown setting. These
variances are not necessary, for greenfield RM-2 sites outside of downtown and therefore do not confer a
pecial privilege within the RM-2 district.
6. Necessary for Use of Property
The granting of a variance is necessary not because it will increase the applicant's economic return, although
it may have this effect, but because without a variance the applicant will be deprived of any reasonable use
or enjoyment of the property.
The variances for minimum parking and minimum front yard are necessary for the successful development
of quality, accessible multifamily housing targeted to veterans and persons with a disability. Without the
parking variance more of the subject property would need to be dedicated to parking which would decrease
the amount of housing available for the special needs populations. The subject property has been vacant for
approximately 12 years despite being actively marketed with other proposed uses being unsuccessful

The granting of a variance will not alter the essential character of the locality nor substantially impair
environmental quality, property values, or public safety or welfare in the vicinity.

providing housing to deserving residents. The completed project will deliver a $7MM property, revitalizing
vacant underutilized land The project will create an estimated 3 permanent jobs and 40 temporary
construction jobs The building has an energy efficient design clean air measures (low VOC paints and a no
smoking,�policy) and radon control methods. The building will feature professional, on -site property
management for the benefit of the tenants and the local community. Additionally, the development conforms
with the city's planning and redevelopment efforts to make downtown higher density and mixed use.
8. Consistent with Zoning Ordinance and Comprehensive Plan
The granting of the variance will be in harmony with the general purpose and intent of the Zoning Ordinance
and Comprehensive Plan of the' City, as viewed in light of any changes conditions since their adoption.
Approval of the variances for minimum parking and front yard allows for the construction of Pearl Street
Commons which will provide multifamily housing for veterans and persons with a disability. The
development compliments and furthers the Comprehensive Plan goals to provide high density multifamily
housing in the downtown area (.p.48), near commercial/retail (p.48) and in proximity to transit (p.49),
connecting residents to services jobs and retail in a mixed use environment. The development is also infill

housing that would replace a vacant and underutilized site in an existing neighborhood (p.49). Additionally,
the variances are in line with the intent of the RM-2 district in the Zoning Ordinance to provide for higher
density residential in compatible areas such as downtown McHenry.
9. Minimum Variance Required
The variance requested is the minimum required to provide the applicant with reasonable use and enjoyment
of the property.
The variances for minimum parking and front yard are the necessary minimum in order to develop quality,
accessible multifamily housing for special needs populations. Full Circle has worked closely with city staff
and officials to design a ,project that fits into the RM-2 district and the local downtown development context
in order to minimize the number of requested variances.

_ This memorandum summarizes the results and findings of a site access evaluation conducted by
Kenig, Lindgren, O'Hara, Aboona, Inc. (KLOA, Inc.) for the proposed affordable housing
development in McHenry, Illinois. The site, which is currently vacant, is located in the northeast
quadrant of the intersection of Richmond Road with Pearl Street. Upon full buildout, the housing
development will provide a total of 50 living units in two buildings, to be developed in two phases.

Figure 1 shows the location of the site in relation to the area roadway system. Figure 2 shows
an aerial view of the site area.
The purpose of this traffic planning evaluation was as follows:
1. Determine the existing conditions in the vicinity of the site

Existing Conditions
Existing transportation conditions in the vicinity of the site were documented based on afield
visit conducted by KLOA, Inc. in order to obtain a database for projecting future conditions.
The following provides a description of the geographical location of the site, physical
characteristics of the area roadway system including lane usage and traffic control devices and
existing peak hour traffic volumes.
Site Location
The site is located in the northeast quadrant of the intersection of Richmond Road (IL 31) and Pear
Street and contains an unused parking lot, with two full access drives onto Pearl Street. Land uses
in the vicinity of the site are primarily residential, with single family homes bordering the site to
the north and east. Commercial developments are located south of the site, and St. Mary Church
is located across from the site on Richmond Road.
Existing Roadway System Characteristics
PeaNl Sheet is an east -west collector roadway that in the vicinity of the site provides one lane in
either direction. Pearl Street terminates at its signalized intersection with Richmond Road where
it widens to provide an exclusive left -turn lane and an exclusive right run lane. Pearl Street is under
the jurisdiction of the City of McHenry, carries an annual average daily traffic (AADT) volume of
5,100 vehicles (IDOT AADT 2013) and has a posted speed limit of 25 miles per hour.
Richmond Road (IL 31) is a north -south arterial roadway that in the vicinity of the site provides
two lanes in each direction. At its signalized intersection with Pearl Street, Richmond Road
provides an exclusive through lane and a shared through/right-turn lane on the northbound
approach and an exclusive left turn lane and two exclusive through lanes on the southbound
approach. Richmond Road has a posted speed limit of 35 mph, with a reduced school speed limit
zone of 20 mph north of Pearl Street. Richmond Road is under the jurisdiction of Illinois
Department of Transportation (IDOT), is a designated as a Strategic Regional Arterial (Sl and
carries an ACID I volume ofT7�660 vehicles (IDOT AAA T �Or6).--- --
Existing Traffic Volumes
In order to determine current traffic conditions in the vicinity of the site, KLOA, Inc. conducted
peak period traffic counts using Miovision Scout Video Collection Units on Tuesday, July 25,
2017 during the weekday morning (7:00 A.M. to 9:00 A.M.) and weekday evening (4:00 P.M. to
5:00 P.M.) peak periods. The results of the traffic counts showed that the weekday morning peak
hour of traffic occurs from 8:00 A.M. to 9:00 A.M. and the evening peak hour of traffic occurs
from 4:45 P.M. to 5:45 P.M. Figure 3 Illustrates the existing peak hour traffic volumes. Copies of
the traffic count summary sheets are included in the Appendix.

Traffic Observation
Traffic flow on Pearl Street at its intersection with Richmond Road was observed during the
morning and evening peak hours to determine the length of traffic queue at the traffic signal. Based
on these observations it was determined that the queues did not extend to the proposed location of
the access drive except once during the PM peak hour.
Gap Study
A gap study was perfoiiried on Pearl Street during morning and evening peak hours in order to
determine the availability of gaps or interruptions in the Pearl Street traffic stream. The gap study
was conducted on Tuesday, July 23, 2017 during the same period as the traffic counts. The study
examined gaps in the eastbound direction along Pearl Street, which would allow vehicles to turn
left in from Pearl Street onto the development and right out from the development onto Pearl Street
as well as in both directions that would allow vehicles to turn left out from the development onto
the Pearl Street. The results of the gap study, showing the total number of potential movements
based on gaps available, for the peak hours are summarized in Table 1.

Proposed Development Plan
As proposed, the plans call for developing the site with two 25-unit buildings for a total of 50
apartment units. Access will be provided via a full movement access drive off Pearl Street to be
located approximately 150 feet east of the stop bar on Pearl Street at Richmond Road. This access
drive will provide one inbound lane and one outbound lane with outbound movements under stop -
sign control. A copy of the site plan depicting the proposed development and access is included in
the Appendix.
Development Traffic Generation
The number of peak hour vehicle trips estimated to be generated by the proposed development of 50
apartment units is based on vehicle trip generation rates contained in Trip Generation, 9t' Edition,
published by the Institute of Transportation Engineers (ITE). Given the type of residential
development proposed that will target veterans and persons with disabilities, it is anticipated that the
residents will have limited vehicle use and ownership. Based on parking utilization at similar
residential developments, the site -generated traffic can be expected to be reduced by 30 percent.
Table 2 shows the site -generated traffic volumes for the proposed development.

The existing traffic volumes (Figure 3) were increased by a regional growth factor to account for
the increase in existing traffic related to regional growth in the area (i.e., not attributable to any
particular planned development). Based on ADT projections provided by the Chicago
Metropolitan Agency for Planning (CMAP) in a letter dated August 3, 2017 an increase of
approximately 1.6 percent per year for Pearl Street and an increase of approximately 2.9 percent
for six years (buildout year plus five years) was applied to project Year 2023 conditions. As such,
Pearl Street volumes were increased by 9.6 percent and Richmond Road Volumes by 17.4 percent.
A copy of the CMAP 2040 projections letter is included in the Appendix.
The development generated traffic was added to the existing Traffic volumes accounting for
background growth and the traffic projected to be generated by other nearby developments, to
determine the Year 2023 total projected traffic volumes, show in Figure 4.

Traffic Analyses
Roadway and adjacent or nearby intersection analyses were performed for the weekday morning and
weekday evening peak hour periods for the future projected (Year 2023) conditions.
The traffic analyses were performed using the methodologies outlined in the Transportation Research
Board's Highway Capacity Manual (HCM), 2010 and analyzed using SIMTraffic/Synchro 9
software.
The ability of an intersection to accommodate traffic flow is expressed in teens of level of service,
which is assigned a letter from A to F based on the average control delay experienced by vehicles
passing through the intersection. The Highway Capacity Manual definitions for levels of service
and the corresponding control delay for unsignalized intersections are included in the Appendix of
this report.
Summaries of the haffic analysis results showing the level of service and overall intersection delay
(measured in seconds) for the projected conditions (Year 2023) are presented in Table 3 and 4. A
discussion of the intersections follows.

Discussion and Recommendations
The following summarizes now the intersections are projected to operate and identify any roadway
and traffic control improvements to accommodate the development traffic.
Richmond Road with Pearl Sheet
The results of the capacity analysis indicate that overall this intersection currently operates at level
of service (LOS) A during the weekday morning and evening peak hours and will continue to do
so under projected future conditions. The increase in delay of seven seconds or less for the
westbound approach is primarily attributed to the background growth and is not significant as
agood LOS will be maintained. As such, the proposed development traffic will have a limited
impact on the operations of this intersection and no roadway or traffic control improvements will
be required.
PeaNl St�^eet with Access Drive
The results of the capacity analysis indicate that all movements are projected to operate at LOS B
or better during both the morning and evening peak hours. The inbound left turning movements
will operate at LOS A with delays of less than one second while the outbound traffic will operate
at LOS B or better with delays of less than 12 seconds. This indicates that the proposed access
drive will operate adequately and its location will not impede flow of traffic in and out of the
development or the flow of through traffic on Pearl Street.
The intersections of Pearl Street with Richmond Road and the proposed access drive were fiirther
analyzed by simulating the projected traffic using SimTral c Software. The results of the
simulation found that traffic queues extended beyond the proposed access drive only two percent
Athe time. The low probability of blockage confirms the results of the capacity analysis that the
proposed access drive will be adequate in accommodating site traffic.
Evaluation
As indicated earlier, a gap study was conducted of the traffic flow on Pearl Street during the
morning and evening peak hours. Table 5 shows the total number of potential movements
compared to the number of required gaps that are needed to accommodate the projected traffic
turning onto and from the proposed access drives. As shown in Table 5, there are more than
sufficient gaps in the Pearl Street traffic stream to accommodate the eastbound leftAurns into the
proposed development, southbound right -turns onto Pearl Street and southbound left -turns onto
Pearl Street forAhe weekday morning and evening peals hours of adjacent roadway traffic. These
results indicate that these movements will be completed with minimal delays and further confirm
the adequacy of the location of the proposed access drive.

Based on the preceding analyses and recormnendations, the following conclusions have been
made:
® The proposed development, given its size and type, will generated a limited amount of
traffic during peak hours
• The proposed access drive will be adequate in accommodating site generated traffic.
• The results of the capacity analysis indicate that the roadway system has adequate reserve
capacity to accommodate the increase in traffic. The location of the access drive will not
impede the ability of site traffic to enter and exit the site efficiently and without negatively
impacting flow of traffic.
