Community Development Committee Meeting Minutes October 22, 2018 Call to Order/Roll Call Alderwoman Condon called the meeting to order at 7:30 p.m. Members present: Alderman Santi, Alderman Devine and Alderwoman Condon. Others present: Director Polerecky and Deputy Clerk Meadows. Public Comment None. Motion to approve the August 29, 2018 Community Development Meeting Minutes Alderwoman Condon asked if any of the Committee Members had any questions or comments on the August 29th meeting minutes. The Committee Members offered no comments. There being no further discussion on the motion, A Motion was made by Alderman Santi and seconded by Alderman Devine to approve the Aueust 29, 2018 Community Development Meeting Minutes as presented. Roll call: Vote: 3-ayes by unanimous voice vote. 0-nays, 0-abstained. Motion carried. Discussion on Political Signs Director Polerecky provided the Committee Members with an overview of the current political sign ordinance and the section of the ordinance that violates State Statute. He noted that current State Statute prohibits regulating the political signs other than reasonable restrictions as to size. No home rule or non -home rule municipality may prohibit the display of outdoor political campaign signs on residential property during any time period. In addition, any ordinance limiting the number of political signs on a residential property violates this law. Director Polerecky commented on the current City's policy regarding political signs. He reported that currently the Community Development Department Personnel does not tamper with or remove political signs on private or commercial properties. However, if the political signs are located within the public right of way or on City owned property the signs are collected by the Department and placed at the Public Works facility. Candidates are notified where they can retrieve their signs and also are informed of the areas in which they can display their signs. Director Polerecky reported that City Hall is a polling place, during both early voting and Election Day. During that time signs may be placed on the City Hall property, however no closer than 100' E ' from the entrance of the polling area. He went on to report that prior to the campaign season a form letter is sent to all known candidates informing them of the fact that campaign signs are prohibited from being posted in a public right of way. Director Polerecky stated that Attorney McArdle is recommending that the Municipal Code be amended to reflect the changes in State Statutes with respect to political signs. The Committee Members concurred with Attorney McArdle recommendation. This matter will be placed on an upcoming City Council Agenda for consideration. Department Updates Director Polerecky provided the Committee Members with updates regarding the Community Development Department's activities. Director Polerecky reported that the construction of Jexals is moving along with great speed and they are still on track to open sometime next month. Director Polerecky commented on Hidden Pearl's construction progress. He reported that the sidewalk reconstruction has been completed an outside access is now ADA compliant. However, the inside renovations are moving at a slow pace. Director Polerecky commented on Starbucks' plans to take over the Twisted Burger location. He reported that the engineering plans had been submitted. However, a portion of the property is located in a floodway and IDNR and the Armys Corp. of Engineers are involved with addressing this situation. Director Polerecky reported Centegra Hospital's expansion continues to make significant progress. Director Polerecky commented on Speedways' fueling stations, both the North and South locations. He reported that they have received their final engineering plans and both sites are still waiting for IDOT approval. He does not anticipate either location to break ground until spring of next year. Director Polerecky provided the Committee Members with an update on the BP gas station located at the intersection of Crystal Lake Road and Bull Valley. He reported that they have received both their architectural and engineering plans. Director Polerecky commented on the HUB Market's renovation progress. He reported that they are in the process of taping dry wall and he anticipates they will be opening within the next 30 days. Director Polerecky commented on JA Frate's expansion. He reported that they continue to move forward with the construction of the addition. Director Polerecky commented on D. R. Horton's development of The Oaks at Irish Prairie. He reported that they have submitted plans for five single family homes. Director Polerecky noted that since the impact fee reduction was approved he has received several inquiries regarding individual single family lots located within the City limits. Director Poleret, ky reported that he is working with Lennar Homes Builders with respect to the Legend Lakes Subdivision. He anticipates their petition to also amend their current annexation agreement with respect to impact fees will be placed on the November 12th City Council agenda. Director Polerecky reported that Staff has been working with Leopardo Energy to develop a feasibility study to implement an energy conservation program. This program will propose upgrades to City facilities, streetlights and fleet management which will reduce the City's carbon footprint and lower expenses. The study's results will be discussed at an upcoming Council meeting. Director Polerecky concluded his report by noting that Community Development Department Personnel, as time allows, will be completing the Administration and CED departmental move. Motion to adjourn the meeting There being no further public business to discuss, a Motion was made by Alderman Santi and seconded by Alderman Devine to adjourn from the public meeting at 8:20 p.m. Roll call: Vote: 3-ayes by unanimous voice vote. 0-nays, 0- abstained. Many projects have kicked off this 2018 building season with some of them coming to fruition before the first of the year. Attached is a building and code enforcement summary and a list of topics discussed this calendar year. One of the highlights to this year's summary is the changes made to the city's code enforcement mowing program. A motion to forward the recommendations to council was had, these fees have not yet been presented to council. A meeting date schedule was established for 2018. March 2018 - A comprehensive review of the commercial minor building fees was performed and presented to the committee. A motion to forward to the city council for approval was had, these fees have not yet been presented to the council. Changes to the recreational burning ordinance were presented to the CDC. June 2018- The police along with community development staff had a discussion on implementing a community involvement group. August 2018- A discussion on reducing impact and capital development fees to incentivize residential development was had. The topic was forwarded to full council for consideration. October 2018- A discussion on political signs was had with a recommendation to change the McHenry Ordinance to mirror the sate statue.
