HomeMy WebLinkAboutResolutions - R-99-020 - 05/05/1999 - SUPPORT HEAVY-DUTY DIESEL VEHICLE EMISSION TESTINGRESOLUTION R-99 Resolution supporting heavy —duty diesel vehicle emissions testing in Northeastern Illinoiis as specified in Illinois General Assembly House bill 2031, which limits smoke emissions from heavy-duty diesel engines operating on area roadways, establish procedures for determining violation of those limitations, and establish a schedule of civil fines. WHEREAS, the City of McHenry, hereinafter "City", finds that certain heavy-duty diesel vehicles operating on the City's roadways emit visible and noxious smoke; and WHEREAS, diesel engine exhaust has been found by the Illinois Pollution Control Board, U.S. EPA and by numerous scientific studies to contribute to various acute and chronic health problems, including impairment of the respiratory system, neurological and behavioral changes, and changes in the liver; and WHEREAS, diesel engine exhaust constitutes a public nuisance that endangers public health, causes discomfort to the City's residents, and reduces residents' enjoyment of their own property and of the City's public spaces; and WHEREAS, the Illinois Pollution Control Board has adopted regulations limiting the amount of smoke which may be emitted from on -road heavy-duty diesel vehicles (35 Illinois Administrative Code Part 240); and WHEREAS, the Illinois Pollution Control Board's limitations on heavy-duty diesel Exhaust emissions are not being enforced within the City's boundaries by any entity of state government; and WHEREAS, adherence to the Pollution Control Board's limitations on diesel exhaust emissions is necessary to improve air quality and to protect the health and welfare of the City's residents, and to prevent a public nuisance; and WHEREAS, House Bill 2031 provides that heavy-duty diesel vehicles, such as trucks and buses, registered in the metropolitan Chicago region shall undergo emissions testing at designated locations; and WHEREAS, House bill 2031 authorized random emissions testing on trucks at weigh stations, road side locations, or other reasonable locations. NOW, THEREFORE, BE IT RESOLVED that the City of McHenry supports and endorses the passage of House Bill 2031. Passed and approved this 5th day of May, 1999.
